That's All Folks! - Featured Items on the Dec 16, 2019 Cambridge City Council AgendaThe last meeting of the 2018-2019 Cambridge City Council takes place this Monday (thanks to the cancellation of the remaining two meetings). This will also mark the final meeting for both Vice Mayor Jan Devereux (served 2 terms, first elected 2015) and Councillor Craig Kelley (served 7 terms, first elected 2005). With the exit of two of the most reasonable members of the City Council we may well be heading toward the Wild Card Council for 2020-2021 where the only real question will be "how far left?" Here are a few items on this final meeting agenda worthy of note: Unfinished Business #5. A revised Petition has been received from Stephen R. Karp, Trustee of Cambridge Side Galeria Associates trust to amend the Cambridge Zoning Ordinance by adding a new Section 13.100 to Article 13.00 of the Zoning Ordinance and to amend the Zoning Map to add a new PUD-8 District overlay that certain area (which includes parcels and portions of ways and streets) labeled as "PUD-8 district". [Passed to a 2nd Reading on Nov 26, 2019 to be Ordained on or after Dec 16, 2019] Communications & Reports #1. A communication was received from City Clerk Anthony I. Wilson, Esq. transmitting a communication from John E. Twohig, Executive Vice President of New England Development, regarding the proposed CambridgeSide PUD-8 District. [Cover letter] [Redline_CambridgeSide 2.0 - PUD-8 Zoning Text (12.11.19 edits)] [CambridgeSide 2.0 - PUD-8 Zoning Text (12.11.19)] I'll say it one last time before the Council either ordains this on Monday or punts: I hope the City Council passes some form of this thing so that the area can get a shot in the arm, but I find this whole "Let's Make a Deal" aspect of how zoning petitions are approved lately to be very problematic. Rezoning is becoming less about good planning and more about generating revenue and goodies. Order #1. Zoning Amendment Articles 2.00 and 4.32 regarding opposition to permitting on-demand mobile fueling services to operate in Cambridge. Vice Mayor Devereux, Councillor Kelley, Councillor Carlone, Councillor Zondervan This was introduced on Oct 21, 2019 and I can't see any difference between that petition (which expires Mar 9, 2020) and this supposedly amended petition. Order #3. That section 11.202(b) of Article 11.000, entitled SPECIAL REGULATIONS, of the Zoning Ordinance of the City of Cambridge, be amended the table as follows: Jan 28, 2020 (Annual Adjustment) $19.10 per square foot. Councillor Zondervan, Councillor Siddiqui, Councillor Carlone, Mayor McGovern This was discussed at the Dec 9 meeting - an itsy bitsy zoning amendment that changes a dollar amount. Let the hearings begin! Order #5. That all items pending before the City Council and not acted upon by the end of the 2018-2019 Legislative Session be placed in the files of the City Clerk, without prejudice provided that those proposed ordinances which have been passed to a second reading, advertised and listed on the Calendar under "Unfinished Business" during the 2018-2019 City Council term, along with any other pending matters on the Calendar listed as "Unfinished Business," shall be forwarded to the next City Council and further provided that any items pending in committee may, at the discretion of the committee, be forwarded to the next City Council. Mayor McGovern ..... and, of course, 97 Items Awaiting Report. There are 6 responses, so we'll apparently end the term at 91 items awaiting report. Some will be carried over to either languish in Managerial Purgatory or maybe see the light of day. I repeat - let 'em all expire and start fresh. Perhaps for the next City Council term the City Council and City Manager should establish a cap on how many items are allowed to languish on the Awaiting Report pile. Order #6. That the City Manager instruct the City Solicitor to provide and update on the previous two orders requesting draft legislation for a Real Estate Transfer Fee Home Rule petition Councillor Carlone, Councillor Zondervan, Councillor Siddiqui Though this will likely only affect the relatively large real estate transactions, I expect the next City Council will have as a primary goal to separate as much money from property owners - large and small - as they can legally justify. And when that runs out they'll just change the laws for more. Order #7. That the City Manager be and hereby is requested to confer with the CPSD Superintendent to ensure that the CPSD budget is enough to meet the educational needs of all children in Cambridge rather than a formulaic increase over past CPSD budgets. Councillor Kelley I would have thought the statement contained in this Order would have been the rule all along. Order #8. Continued Anti-Bias Training in 2020 and beyond. Councillor Simmons Nevermind. Order #9. Removing Sackler family name from Harvard University Museum. Mayor McGovern I pass by a portrait of David Koch every day at MIT. It has never bothered me. Should we obliterate the family name of everyone whose business interests include some things we don't like even if they have contributed tremendously toward other things that we do appreciate? Cancel Culture is insanity. Communications & Reports #2. A communication was received from Councillor E. Denise Simmons regarding an "End of Term Report from the Housing Committee". Ordaining the Remnants of the 2018-2019 Council - Bits 'n Pieces from the Dec 9, 2019 City Council AgendaWe're down to the last few meetings before the new Council is inaugurated on January 6 ["The city council, elected as aforesaid, shall meet at ten o’clock in the forenoon of the first Monday of January following the regular municipal election, and the members of the city council shall severally make oath, before the city clerk ... to perform faithfully the duties of their respective offices.... Thereupon the city council shall, by a majority vote of all the members elected, elect a mayor and a vice-chairman from its own members...."] Until that little bit of biennial drama occurs, here are some things that are either interesting or up for discussion and/or action this week: Manager's Agenda #4. A report from Councillor Craig Kelley, Chair of the Public Safety Committee, for a public hearing held on Dec 3, 2019 to discuss an amendment to the Surveillance Ordinance. No comment. I fear I'm being watched by the Fusion Center ghoulies. Manager's Agenda #10. A communication transmitted from Louis A. DePasquale, City Manager, relative to a Planning Board recommendation to adopt the Alexandria Grand Junction Overlay District Zoning Petition. Manager's Agenda #11. That the City Manager is requested to provide updated data on enforcement of the city’s short term rental regulations, including (but not limited to) the number of units that have registered with the city, the number of applications that have been rejected, the number of inspections that have been undertaken by the Inspectional Services Department, and the total number of units listed on various short term rental websites including Airbnb. 5:00pm Special City Council meeting to take up the petition by Stephen R. Karp, Trustee of Cambridgeside Galleria Associates Trust, to amend the Zoning Ordinance of the City of Cambridge by adding a Section 13.100 that creates a new PUD-8 District. (Sullivan Chamber - Televised)
OUTCOME: The City Council voted 7-2 (Carlone, Zondervan - NO) to Pass the Petition as Amended to a 2nd Reading.
Turkey Trot - Nov 25, 2019 Cambridge City Council meetingPerhaps we should call this the Lame Turkey Session and give the ducks a break. Here are a few agenda items that caught my eye: Manager's Agenda #8. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the appropriation of $1,924,594.18, associated with Education First’s EF 3 Building, SP#328) from the Mitigation Revenue Stabilization Fund to the Public Investment Public Works Extraordinary Expenditure account which will be used to support utility work associated with the Port Project and were paid by Education First to fulfill their Inflow and Infiltration requirement. This is what "mitigation money" is supposed to be all about - actual mitigation and infrastructure improvement. Contrast this with the current practice of granting upzoning not for the sake of good planning but for cash and prizes - and, of course, subsidized housing units. At least the proposal to glue subsidized housing units onto a self-storage facility didn't fly. Mark my words - this is only going to get weirder in the next City Council term. Manager's Agenda #10. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 19-140, regarding Harvard Square plaza area safety improvements. During my four decades in Cambridge I have seen the Harvard Square pedestrian environment reconfigured several times - each time under the belief that nirvana had been achieved. The last iteration was the "Super Crosswalk" that apparently was never all that super. The next iteration is coming. No matter the outcome, we will be assured that congestion and delay is not a negative consequence but is instead good for us and we should shut up and be grateful - and all parties involved will continue to bend the traffic laws as they see fit. Manager's Agenda #11. Transmitting communication from Louis A. DePasquale, City Manager, relative to the appropriation of $107,000 from Free Cash to the General Fund Finance Other Ordinary Maintenance account as initial support of the recommendations of the Mayor’s Arts Task Force regarding the Central Square Cultural District. Yippee! Money for Central Square! Now if we could only categorize sidewalk repair and improvements to the T station as "art" we'll be all set. Manager's Agenda #12. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 19-122, which requested a legal opinion on the License Commissions authority. This is by far the most important item on this agenda. Though this legal opinion merely states what many of us have known and understood all along, it should put to rest some of the outrageous misunderstandings that have been circulating. That said, I read an opinion today that it was somehow problematic that a quasi-judicial body like the Cambridge License Commission can act without micromanagement by the City Manager - even though any decision of the License Commission can be appealed. Imagine how outraged people would feel if it was suggested that the Planning Board should not issue or deny a Special Permit without the approval of the City Manager. Ultimately the City Manager is "the appointing authority" and could appoint only yes-men (and yes-women) to all the City's Boards and Commissions as well as the Police Commissioner and Fire Chief, but that practice would likely head south pretty quickly. City Solicitor Glowa's legal opinion is both impressive and timely, and I hope it puts to rest some of the falsehoods from the Lower Port to the Upper West. Committee Report #1 & Committee Report #2. A report from Councillor Dennis J. Carlone and Councillor Craig A. Kelley, Co-Chairs of the Ordinance Committee, for a public hearing held on Sept 26, 2019 and Nov 14, 2019 to discuss the petition by Stephen R. Karp, Trustee of Cambridgeside Galleria Associates Trust, to amend the Zoning Ordinance of the City of Cambridge by adding a Section 13.100 that creates a new PUD-8 District and to amend the Zoning Map of the City of Cambridge by adding the new PUD-8 District, which District would include the property located at 100 Cambridgeside Place (currently zoned in the Business A and PUD-4 Districts). I do hope that the City Council passes some version of this zoning amendment solely because I think we could a lot do better in that corner of the city than what exists now, and some reconfiguration of the Cambridgeside Galleria should be part of that. However, I find aspects of the committee report to be problematic, e.g. "the Petitioner will pay the City $50 million dollars in mitigation funding" and "what would happen to the proposed community benefits if the Petitioner decided to proceed under their current zoning" and "she felt that the height and massing could be appropriate depending on the community benefits." In short, approving changes in zoning should be primarily about good planning and not about any "quid pro quo". Unfortunately, this brand of zoning negotiation as commodity trading is not exceptional in Cambridge these days - and it may only grow worse. - Robert Winters |
Lame Duck Walking - November 18, 2019 Cambridge City Council meetingIn between the inevitable hushed meetings to secure the necessary five votes to become mayor for the 2020-21 term, the lame duck session continues quacking. The agenda is quite short, but a few items worth noting are listed below. Honestly, I've been having more fun studying the 2019 ballot data now that the election results were finalized Friday evening [Council][School]. This includes things like the ward/precinct distribution of #1 votes [Council][School], the #2 vote distribution behind each candidate's #1 votes [Council][School], who would replace each of the newly elected members in the event of a future vacancy, and an Instant Runoff simulation to see how the ballots would choose a mayor (which, of course, is not how it's done!). Anyway, back to the Council agenda (with minimal comment)..... Manager's Agenda #5. A communication transmitted from Louis A. DePasquale, City Manager, relative to a Planning Board recommendation to adopt with comments and suggested improvements, the CambridgeSide Galleria Associates Trust Zoning Petition. Manager's Agenda #6. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the appropriation of $4,475,844.18 from Free Cash to the Mitigation Revenue Stabilization Fund which will be used to fund specific future projects, requiring individual appropriations by the City Council at a later date. Manager's Agenda #10. A communication transmitted from Louis A. DePasquale, City Manager, relative to a Planning Board recommendation to adopt the Exterior Building Insulation Zoning Petition. Committee Report #3. A report from Councillor Dennis J. Carlone Co-Chair of the Ordinance Committee, for a public hearing held on Nov 12, 2019 to discuss the Insulation Zoning proposal A communication transmitted from Louis A. DePasquale, City Manager, relative to a petition to amend provisions in Article 5.000 and Article 22.000 pertaining to setback requirements and exterior building insulation. Manager's Agenda #11. A communication transmitted from Louis A. DePasquale, City Manager, relative to a Planning Board recommendation to adopt Article 22 Green Building Requirements Zoning Petition. Committee Report #2. A report from Councillor Dennis J. Carlone Chair of the Ordinance Committee, for a public hearing held on Nov 12 at 12pm to discuss Green Building requirements A communication transmitted from Louis A. DePasquale, City Manager, relative to a petition to amend provisions in Section 22.20, which governs Green Building Requirements, and also applicable definitions contained in Article 2.000. Order #2. That the City Manager is requested to direct the Traffic, Parking and Transportation Department to fully restore sharrows to Broadway, alongside the new door-zone bike lane, as a reminder to motorists that cyclists are always allowed to take the full lane. Councillor Zondervan I completely agree with this Order (as a person who prefers biking along with other traffic on most roads with ordinary speeds), but I continue to marvel at the trend among city councillors to assume roles which previously were the domain of the professional staff. I can't decide if this is great wisdom or micromanagement or just a vote of "no confidence" of City staff. Committee Report #1. A report from Vice Mayor Jan Devereux, Chair of the Government Operations, Rules & Claims Committee, for a public meeting held on Nov 14, 2019 to discuss the Solicitor's Response to Policy Order O-9 from the June 10, 2019 City Council Meeting. I used to be somewhat agnostic regarding campaign donations from people with business before the City Council, but the recent municipal election campaign has pushed me into the camp of those who feel that some limitations should be the rule. I'm still not convinced that public financing of municipal election campaigns would be worth it either practically or bureaucratically. I also can't wrap my head around the fact that some of our local elected officials (and their ardent supporters) feel outrage about the Citizens United court decision that opened the floodgates in campaign spending yet have no qualms whatsoever in doing the same thing at the local level. - Robert Winters |
The Last Thing on their Minds - Nov 4, 2019 Cambridge City Council meetingThis is your classic night-before-Election-Day City Council meeting where Council business places a distant second behind concerns about having all their incumbency protection ducks in a row. If this meeting goes beyond 6:15pm it will likely be because they were forced to listen to the repetitive whining of Public Comment. Anyway, here is my very short list of interesting items on this very short agenda: Manager's Agenda #3. A communication transmitted from Louis A. DePasquale, City Manager, relative to the creation of a new municipal Renewable Energy and Greenhouse Gas (“GHG”) Reduction Revolving Fund (“Revolving Fund”) to serve the City of Cambridge’s (“City”) municipal energy aggregation, and adoption of the proposed new ordinance, Chapter 3.24, entitled “Departmental Revolving Funds.” From the Manager's letter: "The Aggregation adder is expected to raise approximately $650,000 annually, or a total of $1.3 million during the current supplier contract period (January 2019 - December 2020)." Proposed uses are: (a) Invest $1.3 million in a solar energy project located on a municipal building; and (b) Deposit income earned from the sale of generated Net Metering Credits annually into the Revolving Fund. Those funds would subsequently be used to finance other solar energy/renewable energy projects and all resulting GHG reductions would be attributed to the Aggregation’s participants. Seems like a reasonable plan of action. Charter Right #1. That the City Manager is requested to confer with relevant City staff on determining the most appropriate signage and messaging that would best educate cyclists on the importance of following traffic laws, particularly stopping at red lights, for their own safety and the safety of other cyclists and pedestrians. 30 out of 31 Communications in which cyclists recoil in horror because a City Council Order from last week suggested "signage and messaging that would best educate cyclists on the importance of following traffic laws, particularly stopping at red lights, for their own safety and the safety of other cyclists and pedestrians." Only in Cambridge would a resolution calling for enhanced safety yield an avalanche of protest. The turf wars continue. Resolution #5. Congratulations to Sekazi K. Mtingwa. Councillor Simmons Sekazi and I worked together at MIT. I did the math and he did the physics in the MIT Concourse program. I'm glad to see him getting the recognition. Order #3. That the City Manager be and hereby is requested to report back to the Council by the end of this term on progress toward identifying a source of funding and a timetable for the design and construction of a modern roundabout at the Brattle-Sparks-Craigie intersection, to share the consultant’s 2017-18 report on the feasibility of a modern roundabout, and to schedule a community meeting in early 2020 to further discuss this project. Vice Mayor Devereux, Councillor Zondervan, Mayor McGovern, Councillor Carlone I don't know whether or not this is the best alternative for this intersection but it is an interesting proposal. I don't like the way it "pedestrianizes" cyclists and I would likely just ride through the roundabout with the rest of the traffic. It's a bit strange that the Council Order calls for a source of funding and a timetable for the design and construction prior to there being any decision on even doing such a redesign, but it's fair to say that this isn't the first instance of engineering via politics by this Council. Order #5. Resolution in support of the Harvard Graduate Students Union-UAW’S demands for a fair contract now. Councillor Siddiqui, Mayor McGovern, Councillor Simmons, Councillor Mallon Finish your thesis, kids. There are better opportunities than being an ABD (All But Dissertation) graduate student. I'll add that it still seems funny that the United Auto Workers are representing Harvard Graduate students. 99 Items Awaiting Report (sung to the tune of "99 Bottles of Beer on the Wall") Wouldn't it be just marvelous if one of these weeks one of the councillors simply asked the manager to run through the list and say (a) which items he has no intention of reporting (possibly because it's either moot or ridiculous); (b) which items somebody somewhere is actually working on; and (c) which items he considers to be timely and important. For example, should we all be waiting with bated breath on the future of wood-fired ovens or electronic device usage by City-elected officials? I thought that the request for "a comprehensive, independent planning, and parking study of the neighborhood and use of the First Street Garage" had already been completed. Would it be so difficult to report on the "feasibility of allowing small businesses to host live acoustic music performances without a license?" Can anyone shed any light on the proposed Outdoor Lighting Ordinance that has apparently gone missing? - Robert Winters |
Nervously Waiting and Wading through the Campaign Mailers - October 28, 2019 City Council AgendaHere are some items of interest up for discussion/approval/referral this week: Manager's Agenda #7. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the appropriation of $350,000 from Free Cash to the Public Investment Fund Library Extraordinary Expenditures account. This appropriation will fund a feasibility study and interior improvements to the Central Square Branch Library. It's all feasible. The greater questions are (a) whether the City is willing to substantially redesign the Central Sq. library entrance to make it less of a nuisance, and (b) whether there's any interest in adding another level or two of parking to the Green Street Garage to meet existing demand and to compensate for losses elsewhere in the Central Square area. My guess is that they'll do neither. Manager's Agenda #9. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the request for two appropriations of $23,000,000 from Free Cash and $7,000,000 from Cambridge Redevelopment Authority for the Foundry project. The gift that keeps on giving.</sarcasm> Order #9. That the City Manager is requested to confer with relevant City staff on determining the most appropriate signage and messaging that would best educate cyclists on the importance of following traffic laws, particularly stopping at red lights, for their own safety and the safety of other cyclists and pedestrians. Councillor Kelley, Councillor Siddiqui, Councillor Carlone Ensuring cyclists own safety seems like a continuing uphill battle. This past Thursday on my way to teach a lecture I watched two cyclists with no lights ride at around 8:00pm directly across the path of a large truck on Oxford Street below the field of vision of the driver. Near miss. Order #10. That the City Manager is requested to work with the Community Development Department, the Traffic, Parking and Transportation Department and the Department of Public Works to determine what facilities, parking changes, and other improvements to the pavement conditions would be necessary and feasible to make Porter Square and Massachusetts Avenue between Roseland Street and Beech Street a quick-build Complete Street with bus priority. Mayor McGovern, Councillor Zondervan I have minimal knowledge of the best remedy for this area. I can, however, show at least one location where paradoxically the removal of an exclusive bus priority lane would actually make bus traffic move more quickly. Beware of one-size-fits-all solutions. Committee Report #1. A communication was received from Paula Crane, Deputy City Clerk, transmitting a report from Councillor Quinton Zondervan, Co-Chair and Councillor Dennis J. Carlone, Co-Chair of the Neighborhood and Long Term Planning, Public Facilities, Arts and Celebration Committee, for a public hearing held on Sept 24, 2019 to discuss the City policy on sidewalk surface treatments as discussed in Policy Order #16 of July 30, 2019. I like all-brick sidewalks except when I have to shovel them after a snowstorm. Then again, in my neighborhood when an asphalt patch of a concrete sidewalk is made it can take over 5 years to restore the sidewalk. Or never. Especially if the cut was made by Eversource/Neverfinish. Communications & Reports #2. A communication was received from Mayor McGovern, transmitting a report, "The Kind of City which is Desirable and Obtainable:" A brief history of zoning in Cambridge. I love anecdotal and oral histories. They add to the story. As for the political point attempting to be made here, never forget the age-old advice that "correlation does not imply causation." Cambridge zoning was initially done to simply acknowledge and codify what was already built. One definitely gets the impression that the current mayor wants to obliterate existing zoning primarily to facilitate a specific proposal. If you start with a conclusion you can nearly always cobble together a narrative to support it. I am far more interested in the here and now and whether specific modifications to existing zoning might be appropriate to achieve best outcomes, e.g. transit-oriented development, moderate increases in density, and adjusting the table of uses to reflect present-day uses in commercial zones. - Robert Winters |
Coming up at the October 21, 2019 Cambridge City Council meetingMost of the controversial business has been either dispensed with (e.g. Cannabis) or neatly stored away for the sake of incumbency protection (Subsidized Housing Overlay) which leaves the agenda open primarily for targeted advertising (dog owners who vote and followers of Greta Thunberg - How Dare You!). Throw in a few street/sidewalk improvements and you have a normal pre-election sampling. Here are the delightfully few things that caught my eye this week: Manager's Agenda #9. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the appropriation of $5,000,000 from Free Cash to the Public Investment Fund Executive Department Extraordinary Expenditures account for the City’s annual contribution to the Massachusetts Bay Transportation Authority (MBTA) Green Line Extension (GLX) project. Here's what I wrote in January, 2018 on this: "Could this be the new normal, i.e. that developers and host cities who would benefit by new transit should pay for the transit? The realization of the Green Line Extension seems to have been made possible, at least in part, by the promise of financial contributions from Cambridge, Somerville, Medford, and the developer of the NorthPoint area." In any case, it's good to see that progress is being made. Indeed, just yesterday while driving back from leading a Middlesex Canal walk in Billerica I passed through some of the construction in Medford/Somerville. It's really happening. Charter Right #1. An application was received from &Pizza, requesting permission for a sandwich board sign in front of the premises numbered 3 Brattle Street with a start date of Dec 1, 2019 thru Mar 31, 2020 and a start time of 11:00am and an end time of 11:00pm. As I wrote for the last meeting: "As for the sandwich board sign in front of &Pizza, I thought having one of the most prominent locations in the heart of Harvard Square would speak for itself - no extra signage required. I'll add that really good pizza also speaks for itself." Charter Right #2. That the City Manager is requested to work with the Economic Development division of the Community Development Department to retain a financial/economic analyst to conduct a confidential financial analysis of NED’s pro forma to inform the council in confidence on the value of the proposed upzoning. To repeat myself once again: "This may make sense in this specific case since the proponent has offered to provide this financial information, but I hope that we don't go down the road of only approving projects after analyzing the books of the proponents. Ideally zoning should be about good planning and betterment for the city and not on how much profit is permissible in the long run." Applications & Petitions #2. A refiled Zoning Petition has been received from Joseph T. Maguire of Alexandria Real Estate Equities, Inc. transmitting a proposed revised amendment to the zoning ordinance by creating the Grand Junction Pathway Overlay District. This was anticipated. Joe Maguire's feet may be quite warm by the time this reaches the ordination stage. More than a few councillors have promised to hold his feet to the fire in regard to the Eversource substation sub-issue. Order #8. Zoning Amendment Articles 2.00 and 4.32 regarding opposition to permitting on-demand mobile fueling services to operate in Cambridge. Vice Mayor Devereux, Councillor Kelley, Councillor Carlone, Councillor Zondervan Yet more evidence of the lazy ass, "call the servants" times that we now live in. Never Mind Choice - Let's All Ban Together - Oct 7, 2019 City Council Highlights/LowlightsHere's this week's sampler of things interesting and/or infuriating (grouped as appropriate): Manager's Agenda #2. A communication transmitted from Louis A. DePasquale, City Manager, relative to a Planning Board recommendation not to adopt the City Council zoning petition to amend Article 19.000 of the Zoning Ordinance regarding utility and infrastructure impacts of large development projects that require a Project Review Special Permit. Order #8. Public Utilities' Planning and public meetings. Vice Mayor Devereux, Councillor Zondervan, Councillor Carlone The Planning Board basically said in recommending against this petition that though they would like Project Review Special Permit applicants to provide information about energy needs, etc., they don't believe it's in their purview "to make findings with regard to infrastructure that is managed by state-regulated public utilities over which neither the City nor the developer have control." They also expressed concern that the proposed changes might prevent development projects that could otherwise improve existing infrastructure (as mitigation). The Board did acknowledge the value of receiving information on the overall impact of a particular project on the energy system and the cumulative impacts of new development but did not support precluding projects strictly on the basis of such information. The context of this proposal is the proposed Eversource substation on Fulkerson St. and the fact that with new development comes the need for such facilities - unless you are of the belief that all new buildings can be built honestly "net zero". The fact is that most, perhaps all, buildings that are advertised as "net zero" still require energy off the grid. The "net zero" identification is achieved by creative accounting, i.e. by purchasing energy from renewable sources and by buying of energy credits. This doesn't eliminate the need for the infrastructure to deliver the energy. Order #8 seeks "to institute regularly scheduled, public conversations between the Planning Board and public utility representatives from Eversource, the Water Department, Comcast, Verizon, and any other appropriate entities, in order to keep the City and the public informed." That's a good idea regardless how one feels about this specific zoning petition. Manager's Agenda #6. A communication transmitted from Louis A. DePasquale, City Manager, relative to the votes necessary to seek approval from the Massachusetts Department of Revenue of the tax rate for FY2020. Communications #1. A communication was received from Christopher Schmidt, regarding not using excess balances to lower the tax levy. The FY20 property tax levy based on the approved FY20 Budget is $438,128,694, an increase of $28,318,833 or 6.9% from FY19. For comparison sake, the current national inflation rate is 1.7%. The FY20 Adopted Operating Budget increased by 5.7% over the FY19 Adjusted Budget. The FY19 levy was 5.3% over FY18. The FY20 residential tax rate will be $5.75 per thousand dollars of value, subject to Department of Revenue approval - a decrease of $0.19 or -3.2% from FY19. The commercial tax rate will be $12.68 - a decrease of $1.03 or -7.5% from FY19. However, before you pop the champagne corks to celebrate the lower tax rate, note that assessed values continue to soar. Total residential property values increased by 9.9%, and total commercial property values increased by 15.6%, so the median tax bills (including the residential exemption) will all be jumping – 8.9% for single-family homes, 7.4% for two-families, 6.0% for three-families, and just the tiniest of increase of 2.8% for condominiums. I find it interesting and somewhat alarming that at City Council candidate forums some incumbents and challengers continue to celebrate how flush with cash we are and that we should be substantially increasing spending. As the noted letter indicates this also appears to be the sentiment of the major players with endorsing organizations like ABC. There was even one candidate at a forum last night who proposed that the City simply buy up all residential housing in Cambridge and turn it into "social housing". At the signpost up ahead, The Twilight Zone. Charter Right #6. That the City Manager be and hereby is requested to work with the appropriate City departments to determine whether it would be possible to allow a permitted area for serving alcoholic beverages on Danehy Park property during special community-wide events. As I said when this was introduced - great idea, and consistent with policies that the DCR has adopted for some of its parks. Unfinished Business #12. A Zoning Petition has been received from Alexandria Real Estate Equities, Inc. et al proposing a Grand Junction Pathway Overlay District [Ordination Comes on or after Oct 7, 2019] Communications #39. A communication was received from Joseph T. Maguire, Alexandria Real Estate Equities, Inc. regarding Amended Zoning Petition for Grand Junction Pathway Overlay District. Alexandria is asking that the petition be allowed to expire so that it can be re-filed. This matter is also intertwined with the Eversource substation matter. Applications & Petitions #2. Councillor Mallon, Vice Mayor Devereux, Councillor Siddiqui It is worth noting (and celebrating) that the freshly introduced Harvard Square Zoning Petition is the result of collaboration among residents and property owners who haven't always been on speaking terms. Kudos once again to future Nobel Peace Prize nominee Patrick Barrett for helping this process along. We all want to see a Harvard Square revival - and not just for occasional one-day events. A communication was received from Gregg Moree, 25 Fairfield Street, regarding State Senator Sal DiDomenico clear evidence of him going to Florida without permission. Unbelievable. Sometimes I feel that the requirement for candidacy should be something other than just 50 signatures. Communications #13-36. Sundry communications re: support for bike lanes. Basically all the same letter saying the same thing about how the priorities of one group of stakeholders outweigh all other considerations and there is one and only one way to make cycling safer. Order #3. That the full City Council ask the City Solicitor to report back on the legal authority of the City to ban the use of natural gas in newly constructed buildings. Councillor Zondervan Order #19. That the City Manager is requested to direct the City Solicitor, Community Development, Public Works, Inspectional Services and any other related departments to review the proposed amendments regarding the prohibition of Natural Gas Infrastructure in New Buildings. Councillor Zondervan, Councillor Carlone, Councillor Siddiqui, Vice Mayor Devereux Committee Report #1. A report from Vice Mayor Jan Devereux and Councillor Quinton Zondervan, Co-Chairs of the Health and Environment Committee for a public hearing held on Sept 25, 2019 regarding banning natural (fracked) gas infrastructure in Cambridge. As I wrote elsewhere regarding candidates, some want to mandate change and remove choice. The better candidates want to encourage change and provide incentives. It's a big difference. Some candidates think primarily in terms of bans and reducing options. Others believe in expanding choice and providing good alternatives from which to choose. I personally prefer using a gas stove. I also believe my natural gas heat is considerably less expensive than the electric alternative.
Order #4. That the City Manager be and hereby is requested to direct the Arts Council and the Department of Public Works, in conjunction with the Rindge School of Technical Arts, to determine the best re-use for the four honey locust logs from Inman Square to create public art for the community. Councillor Zondervan Committee Report #2. A communication was received from Paula Crane, Deputy City Clerk, transmitting a report from Councillor Quinton Zondervan, Co-Chair and Councillor Dennis J. Carlone, Co-Chair of the Neighborhood and Long Term Planning, Public Facilities, Arts and Celebration Committee, for a public hearing held on Sept 17, 2019 to discuss the preserved Inman Square tree trunks and receive input from the public on possible future uses of the wood, which is a public resource. This is perhaps one of the tiniest of agenda items, but I really like the idea of using the wood from identified trees either as public art or as mementos. I have a little circular box made from the famous Washington Elm that once stood at Garden and Mason Streets. I have other pieces of that tree as well. Order #5. That the City Manager have appropriate city staff review the proposed Welcoming Community Ordinance. Councillor Kelley, Councillor Mallon, Vice Mayor Devereux, Councillor Carlone, Councillor Zondervan, Councillor Siddiqui Committee Report #3. A report from Councillor Dennis J. Carlone and Councillor Craig A. Kelley, Co-Chairs of the Ordinance Committee, for a public hearing held on Oct 2, 2019 at 3pm to discuss the Welcoming Community Ordinance. This is basically just an updated version of the existing Sanctuary City resolution but in the form of an ordinance that specifically addresses how the Cambridge Police and other City departments should interact with ICE (Immigration and Customs Enforcement). The City Solicitor expressed that Council should be careful when limiting a police officer’s discretion to enforce laws, and I agree completely. I do find merit in Sanctuary City principles in that I certainly don't want people to stop reporting crimes or contacting the Fire Dept. or other services out of fear of being nailed for their immigration status. Order #7. Fuel pump warning labels. Vice Mayor Devereux, Mayor McGovern, Councillor Carlone, Councillor Zondervan Sign, sign everywhere a sign blocking out the scenery breakin my mind. Do this, don't do that, can't you read the sign? Order #11. That the City Manager be and hereby is requested to allocate more funds in the FY21 budget to Inspectional Services to help combat the city-wide rodent issue and report back on the feasibility of providing monetary compensation to homeowners who have had to self-finance traps and what funds could be allocated in the future to help homeowners buy traps. Councillor Toomey What about those of us who live next to a building where the property owner (and tenants) don't properly address their rodent infestation even after the City has been contacted, fines have been issued, and the problems persist? Getting reimbursed for partially addressing problems on an adjacent property that spills over onto your own property hardly seems like a solution. Order #13. That the City Manager is requested to confer with the Budget Department, the Assessor's Department and the Community Development Department to consider directing a portion of future PILOT funds into the Affordable Housing Trust starting in FY21. Vice Mayor Devereux, Councillor Siddiqui, Councillor Carlone, Councillor Zondervan Earmarking funds in this way is generally a bad idea. Same goes for previous notions of dedicating cannabis-related funds toward purposes unrelated to its impacts. Priorities and needs change and restricting in-lieu-of-tax funds from universities to one purpose is short-sighted. Order #15. That the City Council go on record in support of House Bill 3116, Senate Bill 2034, and the establishment of Governor Baker’s Low-speed Mobility Device Advisory Working Group as part of the Safe Driving Legislation, Senate Bill 7. Councillor Kelley, Vice Mayor Devereux, Councillor Mallon, Councillor Siddiqui This is a good idea and overdue. That said, if anyone thinks that electric scooters and skateboards are going to go a long way toward solving transportation needs, think again. Order #16. Creating the Director of Arts and Culture Position. Councillor Mallon, Mayor McGovern, Councillor Zondervan, Councillor Simmons I have to seriously question the motivation for this Order. If some councillors have questions about how the Cambridge Arts Council prioritizes arts and cultural matters in the city, that's a totally reasonable inquiry. If they believe that additional staff may be required, that's also a reasonable thing to ask of the City Manager in the next Budget cycle. However, asking to create a highly specific "Director of Arts and Culture" position seems like these councillors are stepping way over the line into city management. Should the whole universe of how the City supports arts and culture be reviewed periodically? Absolutely, and the City Manager should regularly challenge the Arts Council and other City-supported entities (like CMAC) to be the best they can be. We currently have an especially good Executive Director of the Arts Council in Jason Weeks, and I fail to see how creating a separate and parallel position will in any way further any goals that may have been expressed as part of the recent Arts Task Force. Order #17. Fire Up That Doobie - Cannabis, CPA Funding and the rest of the Sept 23, 2019 Cambridge City Council meetingAfter an eventful week of Courthouse Controversy and Picking Winners in the Cannabis Sweepstakes, here are the things that struck me as interesting on this week's agenda: Manager's Agenda #4. A communication transmitted from Louis A. DePasquale, City Manager, relative to recommendations of the Community Preservation Act Committee (CPAC) for FY2020. It will be the maximum 80% to the Affordable Housing Trust, and the minimum 10% for Open Space Acquisition and 10% for Historic Preservation - non-negotiable, of course. Manager's Agenda #5. A communication transmitted from Louis A. DePasquale, City Manager, relative to a petition to amend provisions in Section 22.20, which governs Green Building Requirements, and also applicable definitions contained in Article 2.000. If I'm reading this correctly, it appears that the City is ditching the costly LEED certification process for "green" buildings in favor of an in-house process that achieves the same goals or better. It's also noteworthy that this proposal is for larger projects, so ordinary homeowners should not worry yet about the City monkey-wrenching with ordinary home improvements. Manager's Agenda #6. DePasquale, City Manager, relative to a petition to amend provisions in Article 5.000 and Article 22.000 pertaining to setback requirements and exterior building insulation. This appears to be a reasonable minor proposal to allow additional building insulation that might previously have extended into yard setbacks. We're talking inches here, not feet. Charter Right #1. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 19-56, regarding a report on the feasibility of constructing a quick-build complete streets project to provide separated bike lanes on Massachusetts Avenue in Central Square, from Sidney Street to Putnam Avenue. Communications #22. A communication was received from Michael Monestime, Central Square Business Improvement District, and Nathanael Fillmore, Cambridge Bicycle Safety, expressing their joint support for building protected bicycle lanes on Massachusetts Avenue between Sidney Street and Putnam Avenue in the near future. The velo-zealots will likely be out in force once again proving their inability to understand words like "reasonable" or "compromise" or anything relating to vehicles with more than two wheels. ON OR AFTER APR 22, 2019 THE QUESTION COMES ON PASSAGE TO BE ORDAINED Committee Report #2. A communication was received from Donna P. Lopez, City Clerk, transmitting a report from Councillor Dennis J. Carlone and Councillor Craig A. Kelley, Co-Chairs of the Ordinance Committee, for a public hearing held on Aug 14, 2019 to continue discussions on a proposed amendment to the Municipal Code to create a Cannabis Business Permitting ordinance including amendments submitted at the July 30, 2019 Special City Council meeting. The Ordinance Committee apparently decided to go with the two-year moratorium to allow various "economic empowerment" applicants to have a head start before the medical dispensaries can also dip into the pot of Acapulco Gold. By the way, is there anyone who was not offended by the "Slave Amendment" postcard that was sent citywide by Richard Harding and his cannabis pals? I'm really starting to dislike everyone associated with this business. Order #6. Alcoholic beverage permitting in large parks. Vice Mayor Devereux, Councillor Siddiqui, Councillor Kelley As the Order says: "A better experience would be ensured for participants if a regulated, enclosed, and permitted beer garden could be located within a large park such as Danehy during a special event." Quite true, and Vice Mayor Devereux deserves a lot of credit for following up on this after this year's sizzling Jazz Festival that would be so much nicer if it can be moved back to a field of real grass with a permitted beer garden. That the City Manager is requested to work with the Department of Human Services and the Cambridge Public Library system to hire a social worker in the FY2021 budget for the Central Square Library branch. Manager's Agenda #12. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 19-56, regarding a report on the feasibility of constructing a quick-build complete streets project to provide separated bike lanes on Massachusetts Avenue in Central Square, from Sidney Street to Putnam Avenue. Perhaps the most important statement in the report is this: "It is also important to note that the continued success of Central Square as a vibrant and livable community hub for business, culture, and government relies on a delicate balance of different activities that go beyond transportation. Any planning related to complete streets and reconfiguring Central Square for the benefit of street users of all ages and abilities must take into account a broad range of factors and stakeholders, to avoid taking any actions that would change that balance in a negative way. We want to ensure that as we contemplate changes that serve our City goals related to promoting sustainable transportation and improving access to community resources and economic opportunities, we do not inadvertently make it more difficult to achieve other goals that we have related to Central Square." I fully expect the velo-zealots will demand that only their concerns should be addressed and that all others should just get on board. Hopefully reason will prevail and we won't have people boarding buses while cyclists weave through the line of passengers, or have every cyclist in town dialing up See-Click-Fix because somebody had to make a delivery and had no choice but to encroach on their turf. DePasquale, City Manager, relative to Awaiting Report Item Number 19-69, regarding a report on the timeline and process for the Net Zero Action Plan 5-Year Review. We all want energy efficiency but I seriously hope that the mandates don't come crashing down on reasonable people living in older homes. Manager's Agenda #17. I have no particular opinion on this zoning petition, but it is worth noting that the Planning Board gave it a negative recommendation. The other thing worth noting is that it seems like standard operation procedure nowadays in Cambridge that no matter what the proposal you just promise to throw in a few "affordable housing" units and you're good to go. Maybe even a tree or two if you still need that extra vote. On the Table #1. A communication was received from Anthony I. I hope we never have to suffer through this again but it would be naive to think this is how it will play out. The ABC zealots are already attacking "those wealthy anti-housing people" as part of their election strategy. I personally feel this matter was tabled last week primarily so that its supporters and potential supporters could weather the November election and then ram it through afterwards without fear. The fact is that it remains a shabbily crafted attempt to rewrite all of Cambridge housing policy so that policy-makers don't have to address the general issue of affordability of housing locally and regionally. ON OR AFTER APR 22, 2019 THE QUESTION COMES ON PASSAGE TO BE ORDAINED The Ordinance Committee hearing on this that was recessed in chaos will reconvene this Wednesday as they once again try to decide the winners in the "Who Wants to be a Millionnaire" sweepstakes. That the City Manager is requested to instruct the License Commission and City Solicitor’s office to drop all charges against UpperWest and its owners, to reconsider UpperWest’s package store application, and to issue a public apology to UpperWest and its owners. That the City Manager be and hereby is requested to obtain a legal opinion from the City Solicitor regarding the License Commission's authority with regard to the issuance, denial, suspension or revocation of liquor licenses in the City of Cambridge. That the City Manager is requested to work with the Police Commissioner, the Cambridge Carnival Committee, and the community to organize an alternative event to take place in Cambridge on the Carnival’s rain date, that will allow vendors to sell their products and potentially recover at least some of the costs. While I think this is a good idea, the fact that violence has followed this Carnival is not something that can be ignored, and I seriously doubt if the organizers will be compensating the City for the additional police presence. Many of us would welcome additional options for Internet and TV service, but my greatest fear is that whatever technology is used to build such a network could become obsolete the day after it's put in place. That the City Council urge the MBTA to take whatever emergency measures are necessary to fast-track repairs to the elevators in the Central Square and Harvard Square MBTA stations, and to share these plans with the City Council in a timely manner. Councillor Simmons You can add to this the work on the new entrance to City Hall Annex at 344 Broadway. It seems that the new construction standard is to do a week of work, walk away for three weeks, then rinse and repeat. Politics, Posturing, Preaching, or Practical Solutions? - Sept 9, 2019 Cambridge City Council meetingThe City Council returns from vacation this week with a loaded agenda and more than a few hidden agendas. Perhaps the biggest deal is the hearing and presumably the vote on disposition of a portion of the parking spaces in the First Street Garage to support the proposed rehabilitation and reuse of the Courthouse Building on Thorndike Street. This has recently become politically superheated by State Misrepresentative Connolly and his Revolutionary Guard who, in Bernie-esque fashion, have promised the moon with no means to fulfill those promises. On the other hand, perhaps the necessary six votes may materialize to begin the asbestos remediation and reactivation of this building as well as revitalization of the First Street Garage and its retail corridor. Hope springs eternal. The other big items are the reports from the Ordinance Committee and the Planning Board on the "Affordable Housing Overlay" proposal, a.k.a. the "Abominable Hubris Overlay", to replace privately-owned residential property with higher density public housing, i.e. housing accessible only to people who apply through the City for this benefit. Any notion that this would be a temporary "emergency" policy was put to rest when proposals for a "sunset clause" were eliminated in the Ordinance Committee. So this would effectively become a policy to permanently prioritize higher density government-regulated housing over ordinary residential development at prevailing heights and densities. Mayor Machiavelli has done all that he can to ram this through while attempting to seal off any means via which residents of the city can challenge plans by unelected bodies to inflict whatever they wish whenever and wherever they wish. There are already apparently three NO votes on this matter so it may all come down to whether one other councillor can be purchased by The Prince. The action item for this meeting would be to pass the matter to a 2nd Reading and put it in the queue for possible ordination on Sept 23, and there appears to be 5 votes to do that. Ordination will require 6 votes. One other possibility, should it be unclear whether the necessary two-thirds majority exists, is to allow the matter to expire and be re-filed so that it can be voted after the municipal election when there are fewer political asses on the line. A more appropriate course of action would be to take a huge step back and reconsider housing policy regionally and rationally, but I seriously doubt if this group of nine is up to that task. Regardless of the ultimate outcome it's fair to say that this one issue has served to realign civic and political lines in a way that will continue for years to come. UPDATE: The vote was to table the Overlay so that it could expire without a negative vote. This will allow it to be "re-filed so that it can be voted after the municipal election when there are fewer political asses on the line." They also punted on the the vote on disposition of a portion of the parking spaces in the First Street Garage. That discussion (and presumably the vote) will reconvene on Sept 18 at 3:00pm, but since the hearing was recessed there will be presumably no additional public comment. Affirmative action is great, but there comes a point where this becomes simple political patronage. On Preferential Treatment for Certain Developers in Perpetuity Committee Report #1. Crane, Interim City Clerk, transmitting a memorandum from Councillor Mallon and Mayor McGovern regarding Amendments to the Affordable Housing Overlay. Regardless how one feels about this Overlay business, it is very clear that this proposal should properly be viewed as an emergency measure and that there should be a sunset clause after which it goes away unless it is freshly reauthorized at some point - perhaps 3-5 years from now. That said, each iteration of this dreadful proposal moves further toward making it permanent, i.e. a permanent mechanism for converting privately-owned residential property into public or quasi-publicly owned residential property. Sunset is being replaced with "review" which means precisely nothing. Apparently, the current group of nine councillors seems hell-bent on literally turning Cambridge into the Peoples Republic of Cambridge where the notion of private property is met with nothing but disdain. Zoning should be about predictability and consistency so that when properties change hands there can be reasonable expectations. This proposal replaces consistency with chaos. This proposal should not pass, but if it does I hope that nobody ranks any of its supporters anywhere on their City Council ballot. This includes some people who I have considered friends, but they will not even get an honorable mention on my ballot if they vote in favor of this travesty. There may be other proposals that are worthy of support, but they are not currently before this City Council. Zoning regulations should not be authored by the beneficiaries of preferential zoning. Everything Else Manager's Agenda #32. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-60, regarding small business parking pilot. The City Solicitor's opinion regarding how such a program could jeopardize Resident Parking is quite interesting. Applications & Petitions #10. A revised Petition has been received from Stephen R. Karp, Trustee of Cambridge Side Galeria Associates trust to amend the Cambridge Zoning Ordinance by adding a new Section 13.100 to Article 13.00 of the Zoning Ordinance and to amend the Zoning Map to add a new PUD-8 District overlay that certain area (which includes parcels and portions of ways and streets) labeled as "PUD-8 district". The proposal could help to make this area much more vital and inviting than it is today. This re-filed version reduces some of the heights of the prior proposal with added community benefits. It will be interesting to see how this fares and if the City administration is capable of weaving this together with other developments in the area into a unified whole. Order #6. City Council opposition to any proposal that would increase allowable semi-truck weight or trailer length without the ability to regulate such at the municipal level. Vice Mayor Devereux, Councillor Kelley, Councillor Zondervan, Councillor Siddiqui As a resident of one of the "corridors" that some councillors seem to use so frequently as political fodder, I am very interested in lessening the impact of the larger tractor-trailers that inevitably seem to find their way onto streets like mine. Whatever happened to the notion that local delivery vehicles should be used for local deliveries? Order #7. That the Government Operations/Rules and Claims Committee be and hereby is requested to coordinate with relevant representatives from the Attorney General’s office and the City Manager’s office to hold a meeting, to include City staff, to review Open Meeting Law requirements for elected and appointed City officials. Councillor Kelley, Vice Mayor Devereux, Councillor Siddiqui, Councillor Zondervan Pardon my iconoclasm, but as long as there is plenty of disclosure and sufficient notice and a very public discussion for at least a week or two prior to an important vote, I have no issue with elected officials hashing out some details out of public view. Order #11. That the Government Operations/Rules and Claims Committee is requested to coordinate with relevant staff to hold a meeting to discuss the feasibility of adding a private attorney budget item to the City Council budget. Councillor Kelley, Vice Mayor Devereux This request has been made and rejected countless times, and it should be rejected again. What would be better (and simpler) is to establish a protocol where the City Council can request that the Law Department work directly with the City Council or its committees on specific matters where it may be warranted. The last thing we need is to have a City Council attorney and the Law Department doing battle. Bear in mind that even though the City Manager has a contract, he still serves "at the pleasure of the City Council." Order #16. That the Neighborhood and Long Term Planning Committee is requested to hold a hearing to review City policy on sidewalk surface treatments, with the goal of clearly establishing that where sidewalks are or traditionally were made of brick, the sidewalks should remain or become brick, when feasible after sidewalk work. Councillor Kelley, Councillor Zondervan, Vice Mayor Devereux This has long been the established policy of the City when it comes to sidewalk replacement. Has this changed? Order #17. That the proposed zoning amendments to Articles 2.00 and 4.32 of the Cambridge Zoning Ordinance to permit Shared Mobility be referred to the Ordinance Committee for further review. Mayor McGovern, Councillor Kelley, Councillor Siddiqui It's one thing to oppose the use of facial recognition software for combing through images solely for the purpose of (correctly or incorrectly) identifying "bad guys" in the absence of a specific crime, but there are some very good reasons for using it after a crime has been committed in helping to identify a potential culprit. I would make the same comment regarding the use of surveillance cameras. Order #25. I am all for preferential treatment for long-time Cambridge residents and those for whom relocation isn't a reasonable option, e.g. seniors or parents with young children. That said, we seem to be moving steadily toward an environment where the government is becoming the primary landlord and where benefits are more likely to go to those who are connected. Anxiously Waiting for Summer Recess - and Nomination Papers - June 24, 2019 at the Cambridge City CouncilThis will be the last meeting until the Midsummer Meeting in late July. Committee meetings will continue here and there. Dance Party at City Hall this Friday. Candidates can pick up nomination papers for the municipal election starting next Monday (July 1). Here's my first pass at the tastier items on the meeting menu: Manager's Agenda #10. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the appropriation of $150,000 from excess FY19 parking fund revenue to the Public Investment Traffic and Parking Department Extraordinary Expenditures account, to establish 20 Mile Per Hour (MPH) Safety Zones on primarily local access streets across the City. Sooner or later the argument will be made that 15mph is even safer. And so on. In truth, 20mph makes a lot of sense of some streets, but there are plenty of other streets where 20mph or even 25mph feels like an unnecessary crawl. Then again, with traffic congestion worse (by design), it's all academic since you might rarely break 20mph anyway. Manager's Agenda #11. A communication transmitted from Louis A. The cannabis train keeps on rolling (slowly) along. The voters approved it but the really wacky part of this is the way some councillors are trying to microscopically tailor the language of the Permitting Ordinance in order to effectively select who will get the greatest advantage in obtaining a permit to operate a cannabis retail store and even how much shelf space will be allocated to what products. Communications #2. A communication was received from Gregg Moree, 25 Fairfield Street, regarding several issues he needs the Cambridge Police Department's help rectifying. If ever there was something in writing that should disqualify a City Council candidate, perhaps this is it. I won't bother to link to the text. This man is an embarrassment. Resolution #1. Resolution on the death of Professor Ifeanyi Menkiti. Councillor Toomey, Councillor Kelley I remember riding the MIT-Wellesley Exchange Bus with Professor Menkiti when I worked at Wellesley College. Farewell, sir. Order #3. That the City Manager is requested to work with the Community Development Department and the City Solicitor to draft a zoning amendment that will count a portion of a new or substantially renovated building's rooftop mechanicals (excluding solar installations) toward its allowed height and/or FAR. Vice Mayor Devereux, Councillor Carlone, Councillor Zondervan This isn't the first time this matter has been addressed. There was the Citywide Rezoning Petition (Sept 2000) that considered issues of bulk and height related to rooftop mechanical equipment (among other things). There was also a zoning petition on this topic introduced in August 2003 and ordained Nov 3, 2003. This followed the Rooftop Mechanicals Task Force Recommendations of June 2003 which also looked at visual and acoustic issues. This new proposal appears to be primarily about height and density and the fact that some of these installations today are much larger than in days of yore. Order #4. That the City Manager is requested to confer with the City Solicitor and the City Hall building staff to identify a suitable location other than the Sullivan Chamber where the state flag may be displayed in compliance with state law. Mayor McGovern, Vice Mayor Devereux, Councillor Siddiqui, Councillor Zondervan We may soon need a "trigger alert" read at the start of every City Council meeting so that nobody is offended or traumatized by symbols or fabric or furniture or floor coverings. This Order actually symbolizes the distracted priorities of some councillors. Order #5. That the City Manager is requested to work with the Community Development Department, Assessor’s Office, and the City Solicitor’s Office on developing a Vacant Storefront Registration Policy. Councillor Siddiqui, Councillor Mallon, Vice Mayor Devereux, Councillor Zondervan Collecting data and developing a database of such vacancies may be useful information, but the real question comes down to how that information will be used. There was a previous Order a couple of years ago that would have taxed such properties into oblivion. A far more thoughtful approach would be to provide incentives and guidance to get most of these properties back into active use - the carrot, not the stick. Order #10. That the City Manager is requested to explain how Newport Construction was selected to work on the Inman Square redesign despite the serious allegations pending against them in Somerville. Councillor Zondervan, Councillor Kelley, Councillor Carlone Apparently the chosen contractor cut some trees down in Somerville. In the case of Inman Square, the City beat them to it. Order #12. That the City Manager is requested to confer with the Department of Finance and Department of Human Services to explore options for incorporating additional line items in the FY20 Budget to allocate supplemental funds for legal aid services, housing stabilization and tenant education and organizing to prevent displacement and address its ramifications on Cambridge residents and families. Councillor Siddiqui, Mayor McGovern, Councillor Simmons, Councillor Mallon These are basically all good ideas aimed at addressing things at a scale that actually matters, i.e. helping individuals rather than a wholesale policy change such as the proposed "100% Affordable Housing Overlay District" that seeks to move privately-owned residential property into public and quasi-public hands by allowing some select property developers to operate under radically different rules than other property owners. Communications & Reports #2. A communication was received from Interim City Clerk Paula M. Crane transmitting a communication from Councillor Mallon, transmitting notes for the meeting of the ninth and last meeting of the Mayor's Arts Task. [Links to all Task Force reports] While the intention of this Task Force is laudable, some of the comments and recommendations of its members cross way over into the political, i.e. echoes of the Sanders campaign and the Occupy phenomenon of a few years back. Former and new City Council candidates have not hesitated to shower fellow Task Force members with self-serving stump speeches. I'm sure some good actions will grow out of this Task Force and a place like Central Square will be better for it, but I hope that delivering personal or political benefits to outspoken Task Force members should not be among the benefits. It's right and proper that we should take a step back every few years and reconsider the various arts initiatives and institutions supported by the City to make sure they are delivering best outcomes for all the residents of the city. However, this really shouldn't be driven by the discontinuation of one person's arrangement with the Cambridge Multicultural Arts Center (CMAC) or the loss of a rehearsal space in the old EMF building in Cambridgeport. - Robert Winters |

City Council support of S.2213, An Act Relative to Gender Identity on Massachusetts Identification. Mayor McGovern, Councillor Simmons One curious consequence of this period of gender redefinition is that rather than introducing the alphabet soup of gender alternatives (actually it's just X in addition to M and F), the Secretary of State's Office apparently will no longer include the gender field in the registered voter database provided to candidates and others. It won't be nearly as easy to do gender-targeted campaign mailings (though I suppose you can still sort by first name and make some assumptions). The Cambridge Election Commission recently voted to adopt this deletion. Order #3. That the City Manager is requested to confer with the appropriate City staff and report back to the City Council in greater detail as to why the construction cost estimates for the Inman Square redesign project were so inaccurately low, what steps are being taken to ensure that the project will not lead to further cost estimate overruns, how such inaccurate cost estimates will be avoided for all projects in the future and interim steps that are being taken to ensure maximum safety in this area. Councillor Kelley, Councillor Toomey, Councillor Simmons The initial estimate was under $3 million which grew to $6 million when approved by the City Council. The successful bid came in at $7.9 million. I would still like some evidence that the desired benefits were not achieved or achievable with the simple addition of the green painted bike lanes now passing through Inman Square. Order #4. That the City Manager is requested to confer with the appropriate City staff and Eversource personnel to determine why the signals at Broadway and Elliott, which add an element of confusion to this intersection, were installed without Eversource’s being able to connect them to the grid in a more responsive manner. Councillor Kelley, Councillor Simmons, Councillor Toomey, Mayor McGovern As a resident of Broadway who had underground electric service until it failed and was never restored (temporary connections have been in place for nearly 5 years now - in my case an electric line screwed into a live tree and draped over a branch), this situation resonates with me. Convincing Eversource to maintain its existing assets remains an uphill battle. Apparently even the City of Cambridge shares this frustration. Last week a new zoning petition appeared that would allow the granting of a Special Permit for any new development project "only if it finds that the utility impacts of the project would not be significant". The problem is not so much what impacts a new project might have (since only then does Eversource carry out any upgrades), but rather in how Eversource maintains (or fails to maintain) its existing assets. Dealing the Dope - June 3, 2019 Cambridge City Council meetingIt's possible that the City Council might at this meeting settle on the final patronage rules for which "social equity" or "economic empowerment" applicants get preference in opening up marijuana outlets in Cambridge. The Acapulco Gold Rush is definitely in full swing with all sorts of applicants trying to get in on the ground floor of this lucrative cash business. So maybe they'll finalize the Special Rules for Special People at this meeting or perhaps that will come later this month. In any case, here a few things on the agenda that might interest me: Manager's Agenda #3. Transmitting Communication from Louis A. It's difficult to draw too many conclusions from this graphical data due to such factors as weather and construction, but my sense is that although bicycle use in Cambridge rapidly grew over the last 15 years there does seem to be some leveling off - not surprising when you factor in New England weather and various convenience factors. This data doesn't really show it but I would say that Councillor Kelley's frequent comments on the growth of other (non-bicycle) mobility devices are now starting to ring out loud and clear. Communications from Peter Valentine: Peter has apparently been very busy lately. Resolution #2. Retirement of Mark McCabe from the Animal Commission. The juggernaut toward replacing private residential property with "social housing" continues. I'm sure the potential beneficiaries of the proposed double standards will be busing in lots of supporters to pack the upcoming Planning Board and Ordinance Committee meetings. I find Order #3 especially amusing. If the authors did a little research they'd learn that once deed restrictions are established on a residential property the taxable value of the property plummets. In many cases these properties produce only the legal minimum in real estate taxes. Every such deed restriction shifts the residential tax burden further onto the remaining privately-owned residential properties (unless the City presses for additional commercial development to make up the difference). Order #5. That the City Manager is requested to instruct the City Solicitor to work with the local taxi industry and other interested parties to prepare a Home Rule Petition for the City Council to submit to the State Legislature that would address Cambridge-specific issues and give the City Council the ability to ensure TNCs operate in a safe and responsible manner. Councillor Kelley, Councillor Mallon, Councillor Simmons Note: The proposed Home Rule Petition comes from the Cambridge Taxi Drivers Owner Association. Is this about safety or protectionism for the taxi medallion owners? Order #8. That the City Manager is requested to report back to the City Council on the timeline and process for the creation of a stakeholder group to conduct the Cambridge Net Zero Action Plan review, as well as any other details on the process by which the quinquennial review will be conducted in 2020. Councillor Zondervan, Councillor Siddiqui, Councillor Mallon, Vice Mayor Devereux My sense is that if you need some building work done and you don't want to pay enormously more for that work, you may want to get that work done sooner than later even if you have every intention of increasing your energy efficiency. Unless there are generous grant programs coming to cover some of the costs, new requirements may well cost you a small fortune. Your elected officials don't trust you to exercise good judgment. Order #10. That the City Manager is requested to confer with the Department of Public Works, the Community Development Department, and the Department of Conservation and Recreation on the feasibility of implementing suggested restoration projects in the area surrounding Jerry’s Pond, in order to make the Pond more accessible and inviting to the community. Councillor Siddiqui, Vice Mayor Devereux, Councillor Carlone Actual restoration of Jerry's Pond as an aesthetic or recreational resource is highly unlikely, but at least they could dress up the surrounding area. That the City Manager hereby is requested to direct the Community Development Department to obtain data from Eversource on electrical demand projections by year until at least 2030, including a breakdown of commercial vs residential demand growth, as well as a ten year historical look back. Councillor Zondervan, Councillor Carlone So what happens if, as I suspect, Eversource comes back with accurate projections that electrical demand will continue to increase significantly, especially if people choose to migrate away from fossil fuels? It's hard to say whether there will be any push-back on this. Perhaps there will be some questions raised regarding the tax-exempt status of Parcel C for approximately 16 years during which the taxable value of all neighboring properties soared. It's likely now all just water under the bridge, but it does raise some questions. Applications & Petitions #1. A re-filing of a zoning petition has been received from Joseph T. Maguire of Alexandria Real Estate Equities, Inc. transmitting a proposed revised amendment to the zoning ordinance by creating the Grand Junction Pathway Overlay District. It's hard to say whether or not this proposal will fare better than the previous one given the increasingly hostile political context of the area when factoring in the controversies surrounding the nearby Eversource site and other proposals in East Cambridge. It should be possible for reasonable people to assess this proposal independent of these other matters. Committee Report #4. A communication was received from Paula M. Crane, Deputy City Clerk, transmitting a report from Councilor E. Denise Simmons, Co-Chair and Councillor Sumbul Siddiqui, Co-Chair of the Housing Committee for a public hearing held on Mar 28, 2019 to discuss Affordable Housing Overlay District. The juggernaut continues. It's remarkable just how comfortable some people have become with double standards. Communications & Reports from City Officers #1. A communication was received from City Clerk Donna P. Lopez, transmitting a communication from Councillor Mallon, transmitting notes for the meeting of the Mayor's Arts Task Force held on May 9, 2019. Most of the ideas floated seem all well and good, but I am a bit skeptical about the idea of having a "City-owned arts facility, akin to the EMF building." There is often a fundamental conflict between governmental control and artistic freedom, and the result can often be mediocrity. There is also the problem of political patronage in deciding which artists should be granted money, jobs, and status. This report suggests that "the Task Force could continue on and become an adjudicator based on an equity rubric." This Task Force was appointed by the Mayor, by the way. There is one suggestion contained in the meeting notes that reflects something I have been emphasizing for several years: "The Baptist church as an arts and culture space". The truth is that there are quite a few older church buildings in the neighborhoods abutting Central Square that would benefit from partnering with various charitable uses, including arts-related functions. Indeed, I have to wonder whether the Cambridge Redevelopment Authority has considered such possibilities as it discusses rescuing the building at 99 Bishop Allen Drive in order to preseve affordable space for the various nonprofit entities now housed there. Dwindling congregations, deferred maintenance, and charitable activities strongly suggest possible mutual solutions. - Robert Winters |
Preview – May 13, 2019 Cambridge City Council meetingHere are a few items that might be of interest (or not): Manager's Agenda #4. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-139, regarding the possibility of planting a tree at the corner of Inman Street and Massachusetts Avenue, directly in front of City Hall. This responds to a City Council Order that sought to "make a statement" by planting a prominent tree in front of City Hall. There are, of course, other statements that might go along with that gesture. As the response notes: "the area on the east lawn in front of City Hall has become an increasingly popular with families and neighbors who enjoy the afternoon and evening sun. Finally, there are concerns that the planting of an additional tree in front of a landmark building would obscure the view of City Hall and detract from the restoration of the landscaping that occurred during the 2000s." Active use is a statement. Historic preservation and restoration are also statements. I would say that our esteemed Public Works Commissioner has offered a rather perfect remedy to plant one tree at the corner and three along the Inman Street side of City Hall - an otherwise forgetable patch of lawn that could use some dressing up. I'm sure former Councillor Born (who spearheaded the restoration of the area in front of City Hall two decades ago) will approve. Communications #1. Written Protest to the zoning petition filed by Stephen R. Karp, Trustee of Cambridgeside Galleria Associates Trust (c/o New England Development), to amend the Zoning Ordinance by adding a Section 13.100 that creates a new PUD-8 District and to amend the Zoning Map by adding the new PUD-8 District, which District would include the property located at 100 Cambridgeside Place (currently zoned in the Business A and PUD-4 Districts). This degree of protest may well cause this petition to require 7 of 9 votes to pass - a steep hill to climb. Perhaps if the petition were amended to replace the Cambridgeside Galleria with 100% subsidized housing it would sail through. Perhaps a local socialist State Representative would even get on board since it would involve smashing capitalism. I expect we may simply see some alteration of the proposed development, e.g. some height reductions. Order #2. That the City Manager is requested to work with the Community Development Department, Traffic, Parking and Transportation Department and Department of Public Works to determine what facilities, parking changes, and other improvements to the pavement conditions would be necessary and feasible to make Massachusetts Avenue a quick-build Complete Street between Sidney Street and Putnam Avenue. Vice Mayor Devereux, Mayor McGovern, Councillor Siddiqui, Councillor Carlone Do elected officials even bother any more to confer with the various stakeholders, e.g. business owners, transit agencies and their passengers, delivery vehicles? Or does it all come down to sucking up to social media savvy interest groups in a municipal election year? At the very least I would have expected the City Council Order to look more holistically at the parallel streets as part of any plan for better accommodating all vehicles passing through this part of Cambridge. Order #3. City Council support of special commission to recommend changes to the seal and motto of the Commonwealth of Massachusetts. Mayor McGovern, Councillor Siddiqui, Councillor Carlone I'll repeat what I wrote 3 years ago when this last came up: Here's what Wikipedia has to say on the subject: 'The seal was adopted by the Provincial Congress on Dec 13, 1780. The shield depicts an Algonquian Native American with bow and arrow; the arrow is pointed downward, signifying peace. A white star with five points appears next to the figure's head. Even better, spend some time learning about the recycling industry - from recovery of materials through the end markets. Recycling is as much about practicality as it is about idealism, and getting out too far ahead of the curve can often be counterproductive. Order #7. That the City Manager is requested to direct the Electrical Department, Department of Public Works, Traffic, Parking and Transportation Department and the Community Development Department to explore a pilot for Level 1 (110V) EV and Micromobility charging stations on street light poles throughout the city. Lopez, City Clerk, transmitting a report from Vice Mayor Jan Devereux, Chair of the Government Operations, Rules & Claims Committee, for a public hearing held on Apr 10, 2019 to discuss the possibility of pursuing a home rule petition to lower the voting age in City elections to 16 years old. Trade in those diapers for ballots! Seriously, even though age thresholds are pretty arbitrary I have not yet heard a convincing argument in favor of this change. As one person at this hearing pointed out - if a 16-year old can vote can he/she also run as a candidate? Would he/she need parental permission to be a candidate? More Monday Madness - May 6, 2019 Cambridge City Council CuriositiesThe Nine will again convene to recite their ABCs. Here are a few things I thought looked marginally interesting: Manager's Agenda #4. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-143, regarding requiring a Business Entity’s Beneficial Ownership and Residential Real Estate Beneficial Ownership Transactions be Disclosed in all Cambridge Real Estate Transactions. I would certainly like to know who is gobbling up Cambridge real estate and apparently there may be a way to get some of this information. I am a bit curious about the questions posed by our esteemed City Solicitor, specifically: "would it apply to both for-profit and non-profit organizations; would it apply to trusts, or only to corporations; and if the corporation's beneficial owner is another corporation, would the disclosure of the name of that other corporation be sufficient?" My cynicism leads me to believe that no matter what disclosure requirement might be established there will always be a way to obscure things. That said, I am steadily becoming more distrustful of the City's possible intent in getting hold of this information. It is becoming clear that our ever-controlling City Council has preferences regarding which entities should own property in Cambridge. Applications & Petitions #5. A petition was received from residents at Thomas Graves Landing opposing PUD-8 by New England Development requesting Special Permit to exceed the 85' height limit at CambridgeSide. I honestly don't know how to feel about all this. The Cambridgeside Galeria could use a little re-envisioning (though perhaps a less loaded term would be preferable). First Street is a failure by any standard, and shopping centers all over are being reinvented as mixed-use developments. The Galeria owners apparently are seeking heights up to 185 feet. Is that necessary or desirable in order to reinvent the complex? Is anyone in the City administration looking at the Bigger Picture (and I don't mean height) that includes the Galeria complex, the not-too-distant Sullivan Courthouse development (assuming that doesn't become a Million Dollar Per Unit Affordable Housing Contradiction), the future redevelopment of the Lechmere site after the Green Line Extension relocates the station, and what is sure to be a very different-looking McGrath/O'Brien Highway? [By the way, did anyone ever talk about any of this during the "Envision" process?] Applications & Petitions #6. A Zoning Petition has been received from the Self Storage Group, regarding a revised Zoning Petition seeking to create the New Street Overlay District. Based on the feedback received concerning their earlier petition. This is the 2nd pass at this. Order #1. City Council support of bills opposing Weymouth Compressor Station/Fracked Gas. Vice Mayor Devereux, Mayor McGovern, Councillor Zondervan, Councillor Carlone I do have an opinion about this, but I'm afraid to say it publicly lest I have Mothers Out Front of my house holding signs. Order #4. That the City Manager is requested to confer with the Cambridge Police Department and other relevant City staff on how media collected by hand-held photo/video recording devices is used, stored, and shared. Councillor Kelley, Councillor Siddiqui Perhaps we can reinvent the Fusion Center as a suburban mall for people who don't trust the government. Order #7. That the City Manager is requested to work with the Traffic, Parking and Transportation Department and the License Commission to establish a "play streets" permit. Councillor Mallon, Vice Mayor Devereux, Councillor Siddiqui I actually like ideas like this. An easier solution would be to just post Do Not Enter signs at both ends of the street. Order #8. Welcoming Community Ordinance. Councillor Carlone, Councillor Siddiqui, Councillor Mallon, Vice Mayor Devereux As near as I can tell, this is mainly a rebranding of "Sanctuary City" as "Welcoming City" just to confuse the President. Committee Report #1. A communication was received from Paula M. Crane, Deputy City Clerk, transmitting a report from Councilor E. Denise Simmons, Co-Chair and Councilor Sumbul Siddiqui Co-Chair of the Housing Committee for a public hearing held on Apr 25, 2019 at 6:00pm in the Sullivan Chamber to continue discussion on the Affordable Housing Overlay District and other related matters. This travesty is apparently not yet filed as a zoning petition. The proposed Order contained in the committee report says: "ORDERED: That the Housing Committee requests that the Chairs of the Ordinance Committee schedule hearings to further review and discuss the attached draft of the proposed citywide Affordable Housing Overlay District as prepared by the Community Development Department." It will be rammed through soon enough as a zoning petition and the clock will then start ticking. Will there actually be any substantive discussions or just continuous streams of virtue signaling and innuendo directed toward anyone who questions the "wisdom" of this proposal to have different zoning codes for different players? Will there be a sunset provision or will this stand as a permanent policy to transform private property to "social ownership" in the Peoples Republik of Cambridge? Will this relieve our neighboring cities and towns from the burden of zoning modifications to permit multifamily housing? Inquiring minds want to know. Amateur Hour - Items of interest at the April 29, 2019 Cambridge City Council meetingThe Nine will meet at the appointed hour on Monday to go through the usual ritualistic motions and possibly assist in the proliferation of cannabis retailers as they redefine Cambridge retail. Soon they'll take up the question of how to replace existing privately-owned residential housing with "social housing" where you have to apply to a City department to access the new dense-pack housing units. Honestly, I don't even know these councillors any more. Here are some items that may get some attention (or not) - with minimal comment: Manager's Agenda #8. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the transfer of $24,000 from the General Fund City Clerk Salary and Wages account to the General Fund City Clerk Other Ordinary Maintenance account to pay for costs associated with required legal advertising for legal notices, hearings and petitions through the end of the fiscal year. A few years ago the Massachusetts Legislature considered a bill that would have replaced the requirement that legal notices be placed in "a paper of general circulation" with alternatives like web listings. Living on a Budget (A Big Budget) - April 22, 2019 Cambridge City Council meetingAs the councillors play their fiddles and cannabis outlets poke up through the ground like spring crocuses, the Manager will deliver the FY2020 Budget on Monday. Two departmental budgets appear to have vanished - General Services and Weights & Measures. The full budget details won't be available until the actual meeting, but the summaries are available now. Here are some agenda items that piqued my interest (grouped as appropriate). The agenda is pretty full on its own, so I'll keep my comments to a minimum: Manager's Agenda #1. A communication transmitted from Louis A. DePasquale, City Manager, relative to the FY2020 submitted budget and appropriation orders. City Manager's Budget Message and Significant Budget Modifications The Bottom Line is that the total proposed FY2020 Budget is $665,550,940. That's up 6.9% over last year's FY2019 budget of $622,477,255. You may want to take a longer view at the multi-year comparisons. Communications & Reports #1. A communication was received from City Clerk Donna P. Lopez, transmitting a memorandum regarding the School Department FY20 Budget. [At the Regular Meeting of Apr 2, 2019, the School Committee voted that the General Fund Budget of the Cambridge Public Schools be adopted in the sum of $201,770,255 for FY20.] That's a 5.6% increase over last year's School Department budget. Manager's Agenda #2 through 9: The Annual Big Loan Orders (appropriation and authorization to borrow) for: #2 - $800,000 to provide funds for various Schools for repairs to entrance doors, upgrade of energy management software, replacement of analog phone system with the voice over internet protocol (VOIP), and the replacement of an emergency generator. #3 - $22,000,000 to provide funds for the construction of improvements at the Fire Station Headquarters Building located at 491 Broadway. #4 - $4,000,000 to provide funds for the reconstruction of various City streets and sidewalks. #5 - $20,500,000 to provide funds for various water pollution abatement projects, including construction of sewer separation, storm water management and combined sewer overflow reduction elimination improvements within the Alewife area. #6 - $4,000,000 to provide design and construction of Eliot Street between JFK St. and Brattle St. which is a continuation of the Harvard Square Kiosk and Plaza and Surface Enhancement project. #7 - $10,000,000 to provide funds for the construction of improvements at City Hall. #8 - $3,000,000 to provide funds for the Municipal Facilities Improvement Plan. #9 - $10,000,000 to provide funds for the design and reconstruction of the Tobin School building. In addition to the Operating Budget, the City also each year seeks authorization to borrow significant amounts for various capital projects (presumably at very favorable interest rates thanks to our multiple AAA bond ratings). City Council support for H.692 extending voting rights to certain noncitizens. Mayor McGovern, Councillor Siddiqui, Councillor Zondervan Order #5. City Council support of the EMPOWER Act (H.720/S.389: An Act ensuring municipal participation of the widest eligible range). Vice Mayor Devereux, Councillor Siddiqui, Councillor Zondervan Order #6. City Council support of H.78: A proposal for a legislative amendment to the constitution to provide for no excuse absentee voting. Vice Mayor Devereux, Councillor Siddiqui, Councillor Zondervan Variations of these pop up every few years - generally when some politicians are desperate for attention. Of the three Orders listed above the only one that has merit (and a lot of merit) is the one calling for "no excuse absentee voting". This will require a state constitutional amendment to make it so, but this is by far the best way to increase flexibility in when registered voters can cast their ballots. In my view citizenship equals the right to vote to elect your government. Non-citizens are welcome to be residents and to pay taxes and receive services, but voting to determine the government should be for actual citizens of the United States, the Commonwealth of Massachusetts, and the City of Cambridge. As for lowering the voting age to 16 or 17, my feeling is that you have to draw the line somewhere, and maybe that line is somewhat arbitrary, but age 18 seems about right. Even if there was a strong movement to adjust that age downward, such a change would have to be uniform across the Commonwealth or across the country. It should not vary from town to town. Fundamentally, it's just populist horse pucky. Order #2. That the City Manager is requested to provide an update from Eversource and any other relevant City departments regarding the finance, health and safety, building design and the long-term electricity needs that was requested by the City Council before the construction of a substation on Fulkerson Street in East Cambridge. Councillor Toomey, Councillor Mallon, Mayor McGovern, Councillor Siddiqui Order #3. That the City Council go on record in opposition to the site owned by Eversource on Fulkerson Street to have a substation and that the City Manager be and hereby is requested to urge Eversource to reconsider its acquisition of the property. Councillor Toomey, Councillor Mallon, Mayor McGovern, Councillor Siddiqui I have my own issues with Eversource, but from these Orders you would almost think that nobody in East Cambridge or Kendall Square uses electricity or that the demand is dropping. Lopez, transmitting a communication from Councillor Kelley, transmitting a memorandum regarding CPSD, the Achievement Gap, and a Review of 8th Grade Math MCAS Results. Various iterations of the Cambridge School Committee and the Cambridge School Department have been talking and talking about "The Achievement Gap" for decades, and all that talk has accomplished little. Perhaps at some point they should readjust their focus on simply doing the best possible job teaching and motivating students and just let the chips fall where they may. For What It's Worth - Select Items on the April 8, 2019 Cambridge City Council AgendaThese agenda items seem marginally interesting: Manager's Agenda #4. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the appropriation of $1,280,000 from Free Cash to the Public Investment Fund Library Extraordinary Expenditure account to support the creation of a new STEAM creativity zone, The Hive, at the Cambridge Public Library. I have been a mathematics teacher for decades and currently have many future engineers in my MIT classroom, so of course I think this is a great step forward. On the other hand, I am also mindful that when computers became standard in households and we were supposedly entering a "paperless society", inkjet printers proliferated and more paper was wasted than ever before. On the other hand, digital media killed off much of print media - less paper I suppose, but overall maybe not the best thing. Right now, STEAM (science, technology, engineering, arts and math) is all the rage (as it should be), but will STEAM initiatives actually accomplish the desired goals or will we just have another facility or program that's not well-utilized? It's all in the details and implementation. Is mathematics proficiency in the Cambridge Public Schools really where it should be? Will this initiative help? I sure hope so. Order #2. That the City Manager is requested to work with the Department of Human Services to develop a plan for implementation of a City-Wide Workforce Development Consortium. Councillor Siddiqui, Councillor Mallon, Vice Mayor Devereux, Councillor Simmons The goal behind this order may well be the single most important goal expressed during the otherwise uninspired "Envision Cambridge" exercise. Matching people growing up in Cambridge to the economic opportunities all around us matters more than all the virtue-signaling, intrusive other initiatives that have been thrust to the forefront. Earning a good income will open more doors and provide economic security than anything else. This obviously requires people to be qualified for those jobs. See above. Wishful thinking is not empowerment. Order #4. That the City Manager is requested to direct the appropriate City personnel to compile a full accounting of streets, schools, and public buildings that may be named in honor of those who have ties to the American slave trade, and to work towards renaming all of these streets, schools, and buildings as soon as possible. Councillor Simmons I just want to know what the new names will be for Jefferson Park and Jefferson Street. Order #7. That the City Manager is requested to direct the Commissioner of the Department of Public Works to provide an update on the small business recycling program pilot indicating any recalibration or reconsideration of the proposed program that may be necessary and any plans for expansion. Councillor Toomey Order #11. That the City Manager is requested to direct the Commissioner of the Department of Public Works to provide an update on the feasibility study of expanding curbside composting program to small businesses and non-profits by the end of 2019. Councillor Toomey, Mayor McGovern, Vice Mayor Devereux, Councillor Mallon I will once again remind everyone that Councillor Toomey has the longest record for supporting recycling initiatives in the history of Cambridge, and he practices what he preaches. Order #9. That the City Manager is requested to instruct the City Solicitor to review whether the MBTA is out of compliance with the amended MBTA/BCIL settlement agreement through the delay in completion of the elevator replacement and concurrent hazardous condition of the stairwells related to Central Square. Vice Mayor Devereux, Councillor Zondervan, Councillor Simmons, Councillor Mallon Each major T Station should have a dedicated stationmaster who advocates for the needs of their respective stations. Instead, we get red-jacketed "ambassadors" who spend more time chatting with each other than assisting passengers. The problem with the MBTA is their own bureaucracy. Bureaucrats should try paying more attention to bricks and stairs and elevators and all the other things that passengers deal with every day. This is not rocket science. Order #18. Preview - April 1, 2019 Cambridge City Council meetingThese days I don't know whether to watch or simply look away as this City Council behaves in ways that sow the seeds of doubt in even the most ardent supporters of the Plan E Charter like me. As much as I believe in proportional representation (PR) and Ranked Choice Voting (RCV) I find myself asking the simple question: Proportional to what? I am seriously doubting if I have any representation at all, and there isn't all that much promise among the emerging new candidates, some of whom are just waiting to feed at the trough of the latest iteration of political action committees (PACs). I sincerely hope that some new candidates emerge who actually understand the ins and outs of Cambridge and who are not just ready to ride the latest round of hot button single issues. So far most of the new candidates look like they were printed on a 3D-printer at the Bernie Sanders clone factory. Meanwhile, these agenda items stand out: Manager's Agenda #1. A communication transmitted from Louis A. DePasquale, City Manager, relative to a recommendation from City Engineer Katherine Watkins, to eliminate and rename certain streets in the Northpoint/Cambridge Crossing area. I have a mild fascination with the naming (and renaming) of streets. I like these recommendations, especially the theme represented by streets named for Harriet A. Jacobs and Gertrude Wright Morgan. For those who don't already know, there's a very strong theme in Cambridgeport based on the War of 1812. You can look it up. Manager's Agenda #3. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the appropriation of $300,000 from Free Cash to the Public Investment Fund Public Works Extraordinary Expenditures account which will support the expansion of the curbside organics program to 13+ unit households in FY20 and be used for the purchase of collection bins and outreach efforts. It will surprise no one to learn that I'm happy to see this, but beyond organics collection there are some troubling realities in recycling these days. American investment in materials recovery (new technology, better processing facilities, and better end markets) has to increase now that we can no longer count on dumping our low quality recycled materials in places like China. Cambridge residents may also soon have to learn to be a bit more thoughtful in how they handle their recyclable waste. Ease of disposal is nice but quality markets for recyclable materials is nicer. Manager's Agenda #6. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-61 regarding a report on commissioning a public art piece, statue or memorial that would commemorate the dedication of women in Cambridge to passing the Nineteenth Amendment. I am very glad to see this moving along. Please give consideration to Central Square as a potentially ideal location for such public art. Manager's Agenda #16. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 19-12, regarding a report on legality and constitutionality of the proposed "Cambridge Publicly Financed Municipal Election Program" and the "Cambridge Municipal Election People's Pledge", and Awaiting Report Item Number 18-136 regarding a report on submitting a proposal that candidates would agree to not accept donations from persons outside of the Commonwealth of Massachusetts. [Legal Opinion] Our City Solicitor really does her homework when researching these questions. Even if there is some merit in public financing of local campaigns (and I am not yet convinced), I have never known the proponents to consider all the consequences and potential problems associated with their proposals. Kelley, Co-Chairs of the Ordinance Committee, for a public hearing held on Feb 27, 2019 to discuss a proposed amendment to the Municipal Code in Title Twelve entitled “Streets, Sidewalks and Public Places” by adding a new Chapter 12.22 entitled “Cycling Safety Ordinance” ON OR AFTER APR 8, 2019 THE QUESTION COMES ON PASSAGE TO BE ORDAINED I have no doubt that this will be ordained even though I seriously disagree with the concept of mandating road design by ordinance. Resolution #3. Resolution on the death of retired Cambridge Police Officer Edward "Eddie" Burke. Councillor Toomey One of the great things about living in Cambridge for a long time (even if you weren't born here) is that you get to know a lot of people in the Cambridge Police Department, the Cambridge Fire Department, and the Department of Public Works. This also means that you share in the heartbreak when people you've come to know pass away. My condolences go to Eddie's entire extended family. Order #3. That the City Manager is requested to work with the appropriate departments to provide more information and analysis as it relates to the 100% Affordable Housing Overlay District. Vice Mayor Devereux, Councillor Zondervan, Councillor Carlone I am glad at least some city councillors are asking questions about this. I served on the Envision Cambridge Housing Working Group that supposedly recommended this proposal, and I asked many questions and raised many concerns about this from the first moment the proposal was presented. I attended every meeting and spoke at every one of them. I was resolutely ignored, and not because my concerns were off the mark. The outcome had been determined when the appointments were made and before the committee ever met. Some things can be amended to make them better. Other things need to be discarded so that something better can be found. This entire concept should be discarded. Has anyone considered the possibility that Inclusionary Zoning was a pretty good idea and that maybe you should just be happy with that? Order #4. That the City Manager is requested to direct the appropriate City personnel to ensure that the Housing Committee hearing scheduled for Apr 25, 2019 be televised and livestreamed, to ensure that as many people as possible will have the opportunity to view this hearing. Councillor Simmons Order #9. That the City Manager is requested to direct the appropriate City personnel to ensure that the Housing Committee hearing scheduled for Apr 16, 2019 be televised and livestreamed. Councillor Simmons These meetings have been little more than Bad Theater - more of a competition between mailing lists of those wishing to pack the meetings than anything substantive. Order #5. That the City Manager is requested to confer with relevant City, Department of Conservation and Recreation, and MassDOT staff, as well as with representatives of the communities through which the Minuteman Bikeway passes, to review infrastructure designs and investigate ways, to include speed limits, enforcement, striping, construction projects, signage and education efforts, to maximize safety for all users of these regional bike-related amenities. Councillor Kelley, Mayor McGovern, Councillor Simmons, Councillor Toomey This Order follows the recent head-on bicycle collision that fatally injured an Arlington man. Sure, put up signs and lay down paint and maybe bolt some plastic poles to the ground, but this still comes down to people learning to travel responsibly. This goes beyond hardware and regulations. That the City Manager is requested to confer with the appropriate City departments to televise and record the Government Operations, Rules and Claims Committee hearing scheduled for Wed, Apr 10, 2019 at 4:00pm. Vice Mayor Devereux The purpose of this public hearing is to discuss the logistics and feasibility of implementing early voting in City Elections and to discuss the possibility of pursuing a Home Rule petition to lower the voting age to City elections to 16 years old. As to the former, it may have a marginal benefit but it will likely come at a considerable cost. Furthermore, there's a chance it will somewhat bias the municipal election toward areas where early voting sites are located. As for lowering the voting age for municipal elections to 16 years old, my belief is that the minimum voting age should be the same across the entire Commonwealth and not vary from town to town. If you want to make the case for this, try to convince the state legislature to do it statewide or pursue other matters. Order #12. That the City Council go on record in enthusiastic support of H.2865, “An Act to Establish a Net Zero Energy Stretch Code. Councillor Zondervan, Vice Mayor Devereux, Councillor Carlone Even if every single suggestion in such a revised code is a good idea, there is little doubt that the costs to anyone doing a renovation will be substantial. A Few Items of Interest - March 25, 2019 Cambridge City Council AgendaIt is getting more difficult every week to watch and listen to this City Council, but here are a few things that have at least some interest:: Manager's Agenda #1. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-114, regarding bicycle signage on Brattle Street. The City's transportation planners acknowledged that they did at one point consider restoring the one-way section of Brattle Street to two-way operation at reduced speed, but they chose instead to go with only the segregated two-way bike lane. The problems associated with this configuration are many, especially at the Brattle Square end, and all the signage in the world will not cure them. Manager's Agenda #11. A communication transmitted from Louis A. DePasquale, City Manager, relative to recommendations for the block rates for water consumption and sewer use for the period beginning Apr 1, 2019 and ending Mar 31, 2020. [Manager's Letter] [Order] Continuing the pattern of the last several years, there will be no increase in the water rate, but there will be a 7% increase in the sewer rate yielding an overall 5.2% increase in the water/sewer combined rate.

Applications & Petitions #2. A Zoning Petition has been received from Hemenway & Barnes LLP. on behalf of Verizon New England Inc., seeking to amend the Zoning Map to certain provisions of Article 20 of the Zoning Ordinance to allow the creation of a "Ware Street Innovation Space" Overlay District. Note that Ware Street is the only property affected by this petition. This seems like a good idea for this seriously anomalous old telephone switching building on Ware Street, but it does seem odd that this change is being proposed via zoning petition rather than by seeking a variance. I expect we will again have to be tutored on what is and what is not considered "spot zoning". Order #6. That a Roundtable meeting be scheduled for Tues, Apr 9, 2019, at 5:30pm in the Sullivan Chamber, City Hall, for the purpose of discussing the Affordable Housing Zoning Overlay proposal. Mayor McGovern This aberrant "Overlay" proposal that would trash all expectations associated with zoning districts across the city continues like a runaway train. The whole concept is based on a perversion of zoning that says that certain parties may play by one set of rules while others must play by a different set of rules. Zoning is really all about managing expectations, and if this proposal passes all such expectations will change whenever a property changes hands. If you think that the maximum height and density in an area will shape what can be built, you will have to abandon that expectation and accept the fact that you will no longer have a right to even object. Furthermore, if you have issues with this proposal expect to have your reputation trashed as easy as ABC. There are good cases to be made for allowing some additional density where it makes sense, but those are not before this City Council. Order #11. That the City Manager is requested to direct the appropriate City staff to examine the need and possibility of implementing the Pilot Displacement Preference program in Cambridge, especially when new housing is constructed in an existing neighborhood where displacement is occurring. Councillor Carlone, Councillor Zondervan, Mayor McGovern, Councillor Siddiqui There may be some worthwhile ideas embedded within, but the bottom line is that this City Council apparently doesn't believe that people can sort things out without their intervention, and that the composition of neighborhoods in Cambridge, Boston, and elsewhere should never change. Order #12. That the City Manager is requested to double the annual funding (from the FY19 Adopted Budget) over the next 3 to 5 years to reach a combined total minimum of $30 million per year (plus any additional use of “Free Cash”) in the areas of Affordable housing construction, tree canopy, Preschool enrollment scholarships/space, Central Square revitalization and Cultural Arts District and the arts in general. Councillor Carlone, Councillor Zondervan, Mayor McGovern, Councillor Siddiqui Take note of the fact that part of the sales pitch for the "Overlay" proposal is that it would yield only modest changes based on available funding. In advertising this is known as the "soft sell". This Order asks that this funding be dramatically increased. Furthermore, there are also proposals pending for a Real Estate Transfer Tax that could potentially lead to even more dramatic increases. The "Overlay" proposal would permanently lock in place a mechanism by which privately-owned residential property will be transitioned to "social ownership" and a future where access to much of the city's housing will be done via application to the local government. Deed restrictions on such housing translate into the fact that they pay only the bare legal minimum in real estate taxes, so that tax burden will be transferred to the remaining unregulated housing. The remedy for that may well be to significantly increase commercial development. I will be very surprised if any of the current group of councillors even discuss these long-term effects. They really should scrap the whole concept and start from scratch. - Robert Winters |
Pre-Spring Fling - Select Items from the March 18, 2019 Cambridge City Council AgendaHere's my first pass at what seems comment-worthy: Manager's Agenda #1. A communication transmitted from Louis A. DePasquale, City Manager, relative to the bi-annual City of Cambridge Resident Telephone Survey for 2018. [Manager's message] [aggregate responses] [longer report] The wording of the questions and the meaning of the choices can have a tremendous effect on surveys such as this. For example, if the question "What do you think is the single most important issue facing the City of Cambridge today—the one that affects you and your family the most?" simply lists one option as "Affordable housing/housing", then it's not at all surprising that this will be the overwhelming first choice. However, does this mean access to subsidized housing or, more likely, does this mean that most renters feel that their rent is higher than they would like it to be and that most buyers feel that purchase costs are much higher than they would like it to be? This is an important distinction because this survey may be used to justify only the expansion of subsidized housing without addressing what most people actually meant by their response in the survey. Order #2. Reappointment of James Monagle as City Auditor. Mayor McGovern, Vice Mayor Devereux Good choice. Do it. Bikes, Buses, Scooters & other Transportation: Manager's Agenda #5. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-142, regarding a report on efforts to educate cyclists about riding safety and sharing the road especially at intersections. That the City Manager is requested to confer with the Community Development Department and other relevant staff about updating the bike data count chart, along with other data tables and charts, in the Cambridge Bicycle Plan to reflect 2016 and 2018 data. That the City Manager is requested to confer with the Community Development Department and other relevant staff to report to the City Council on how the data collected from the Broadway Eco-Display is used to inform the City’s transportation planning efforts and to address the possibility of installing additional Eco-Display counters at the highest trafficked bicycle locations to provide more comprehensive information about bike use and other vehicles such as scooters. That the City Manager is requested to confer with City Staff and report back to the City Council on the status of any micro-mobility pilot programs or partnerships in Cambridge. Councillor Kelley I'll be interested in seeing the requested data (with appropriate documentation to support its validity). I have come to believe that when you start factoring in such things as weather, the need to run multiple errands, electric vehicles and micro-cars, TNCs, and various micro-mobility options, as well as age/condition, we may conclude that Cambridge is not actually located in The Netherlands and that the choice of bicycle transportation may have a natural upper limit no matter how many flex-posts you bolt to the road. Committee Report #2. A communication was received from Donna P. Lopez, City Clerk, transmitting a report from Vice Mayor Jan Devereux, Chair of the Transportation and Public Utilities Committee, for a public hearing held on Feb 26, 2019 to discuss the MBTA’s Better Bus Project report as it relates to proposed changes to bus lines and service throughout Cambridge. If Better Bus means little more than Cutting Corners then there's not a whole lot to like here. I do, however, think that folding the CT1 into the #1 Bus with more frequent service is a good idea, but only if they can finally solve the problem of Bus Bunching. Committee Report #4. A communication was received from Donna P. Lopez, City Clerk, transmitting a report from Councillor Dennis J. Carlone and Councillor Craig A. Kelley, Co-Chairs of the Ordinance Committee, for a public hearing held on Feb 27, 2019 to discuss a proposed amendment to the Municipal Code in Title Twelve entitled “Streets, Sidewalks and Public Places” by adding a new Chapter 12.22 entitled “Cycling Safety Ordinance”. The key question I would have asked is whether or not this proposal unnecessary restricts the ability of the City Manager and City Departments from using good judgment and appropriate discretion in deciding how future road projects should proceed. As near as I can tell, everything that was and is on the table came from just one lobbying group. Then again, that seems to be the way this City Council operates. Order #5. Thanks to Mayor McGovern and all members of the Harm Reduction Commission and the Cambridge Opioid Working Group for their leadership and service and that a Human Services and Veterans Committee hold a future hearing to receive an update on the recommendations in these reports and on efforts in Cambridge to address substance use disorder and the opioid crisis. Vice Mayor Devereux, Councillor Siddiqui, Councillor Mallon Prelude to the Mayor enabling a "safe injection site" to be located inevitably in Central Square to supplement the existing Needle Exchange and other sites enabling IV drug users to flock to Central Square. Wouldn't it be great if we instead concentrated on things that helped to attract families with children to Central Square? Housing-Related: Order #8. City Council endorsement of the American Housing and Economic Mobility Act. Mayor McGovern, Councillor Siddiqui, Councillor Mallon This Order seems to be setting up for the case to be made that current Cambridge zoning is too restrictive and must be changed to allow for significantly increased density. Note the sponsors. It is curious how the extremely strict zoning restrictions of the suburbs and exurbs are somehow being invoked to make the case that Cambridge, with one of the highest population densities and highest proportions of subsidized housing in Massachusetts, is somehow comparable to Weston. Mendacity seems to be the new official language of Cambridge. Order #13. City Council support for fully funding the Section 8 Housing Choice Tenant-Based Voucher Program. Councillor Zondervan, Mayor McGovern, Councillor Siddiqui, Councillor Carlone Good idea and more to the point than what is otherwise being discussed these days. Order #14. That the City Manager direct the appropriate City staff to examine the need and possibility of neighborhood preference in Cambridge in the short and long-terms. The only other consequential thing in the meeting was the back-and-forth posturing of Councillors Zondervan, Siddiqui, Mallon, Carlone, Devereux, and McGovern over Councillor Zondervan's "initial thoughts" memo on the Public Housing Expansion Initiative, a.k.a. the "Affordable Housing Overlay". Vice Mayor Devereux handled herself rather well. Councillor Mallon argued in favor having her own Maple Ave. be a preferred site for new Public Housing. Councillors Kelley, Simmons, and Toomey wisely remained silent. |

It comes with other annual traditions - activists expressing dismay at Cambridge's fiscal position and elected officials using it to argue that more "free cash" should be poured into their favorite pet projects. Order #3. City Council support of H.3118/SD.2042, An Act to reduce traffic fatalities. Vice Mayor Devereux, Councillor Zondervan, Councillor Carlone, Councillor Kelley This bill is comprised of common sense measures: a) requiring rear lights on bikes; b) mandating that motor vehicle operators MUST give a wide berth to vulnerable users (like bikes and pedestrians) when passing; c) minimizing "blind spots" for motor vehicles; d) requiring guards on trucks to minimize the likelihood of someone going under the wheels; e) reducing speed limits to 25mph on state highways in thickly settled areas and business districts. I'm not sure if the requirement of safe passing distance applies to bikes passing pedestrians, but it should. Order #7. That the City Manager is requested to instruct the Assessor’s Office to provide Up-To-Date Condo Conversion Data. Councillor Siddiqui, Mayor McGovern I am interested in this information, but most of those horses left the barn a while ago. Multi-family homes on the scale of two-family and triple-deckers were the single most effective affordable housing mechanism in Cambridge for most of the last century. As the condo craze swept through some people were able to get a piece of the action, but the mechanism for a working class family to house themselves and provide housing at affordable rents to cover the mortgage is now just a minor (but still important) part of the Cambridge housing picture. If limits on condominium conversion were ever to have happened it should have happened 20 years ago. Order #8. City Council support of H1850: An act ensuring safe patient access to emergency care and H1346: An act removing the liability cap for malpractice resulting in serious injury or death. Councillor Mallon, Vice Mayor Devereux, Councillor Simmons, Councillor Siddiqui I'm all for H1850: An act ensuring safe patient access to emergency care. As for the other bill, there are good reasons for liability caps, and no amount of money will ever bring back someone who has died. Committee Report #1. A communication was received from Donna P. Not So Great Expectations - Feb 25, 2019 City Council AgendaPerhaps the biggest draw for this meeting will be the anticipated vote on a proposed moratorium on property owners removing any tree above a certain diameter without City permission and an onerous fine. Though I understand there may be some amendments, the current proposal would allow the removal of only "dead, diseased, or dangerous" trees. The background motivation is that some Big Developers removed some trees, so therefore every small property owner must be penalized or prevented from making difficult choices about how to manage their property. I'm still hoping that some wisdom may emerge from this hopelessly politicized travesty, but I expect to be disappointed. I suppose I should start getting used to it because this group of nine city councillors may continue to disappoint as the year progresses as they set the stage for the November municipal election. The script is basically to declare an emergency and then use it to justify loss of freedom and flexibility. Sound familiar? Here are the relevant items: Unfinished Business #5. DePasquale, City Manager, relative to Awaiting Report Item Number 18-105, regarding the feasibility of placing a condition in the public bidding documents prohibiting municipal contractors from displaying any signage other than company makers and contact information on vehicles. [City Solicitor's Response] If you recall, this requested legal analysis stems from that rather shallow reaction by some city councillors some months ago to a construction vehicle that carried a political message not to their liking. The City Solicitor's response confirms what everyone surely must have known when this Order was filed. Free speech may not always be what you want to hear, but it is protected. That's what has long been Great about America. Manager's Agenda #5. Transmitting communication from Louis A. DePasquale, City Manager, relative to the appropriation of $600,000 from Free Cash to the Public Investment Executive Department Extraordinary Expenditures, to be used for shoreline and landscape improvements at Magazine Beach. This continues to be one of the most refreshing collaborations in recent memory between local residents, their City and State government, and the Mass. Dept. of Conservation & Recreation (DCR). There will, of course, be hundreds of pages of gibberish filed by our local "Goose Guy" accusing all parties of every sort of malfeasance. Free speech, you know. Applications & Petitions #4. A Zoning Petition has been received from the residents of the City of Cambridge requesting that the City Council amend Chapter 8.16 "Noise Control" of the Cambridge Municipal Code. [They are proposing an outright ban on leaf blowers.] I suppose regulating leaf blowers just wasn't enough for some people. It's got to be a ban. There is a Cambridge subculture that really must be modeling their behavior on Boston's old Watch & Ward Society. Will books be next on the list of Things to be Banned? I'm already expecting to have the future Climate Police one day impound by gas-fired boiler and the internal combustion engine from my VW Bus. Please don't tell them that I also eat meat. Resolution #5. Resolution on the death of Paula Sharaga. Councillor Zondervan, Mayor McGovern, Councillor Carlone I knew Paula and considered her one of the most likable politically active people I have met in years. I don't have the words to say just how much of a tragedy this was and how much of a shock it was to hear the news of her death while she was bicycling in the Fenway area. Resolution #7. Appreciation for Red Mitchell. Councillor Simmons I want to join with Councillor Simmons in this appreciation. Red is a wonderful guy and a scholar of history. He and I will have to one day soon take a trip down to the Adams Homestead in Quincy, MA to indulge our shared interests. Order #1. City Council opposition to MBTA Fare Increase Proposal. Vice Mayor Devereux, Councillor Zondervan, Councillor Siddiqui, Councillor Mallon I was looking for the clause in this Order with suggestions for other funding mechanisms for the MBTA. I'll keep looking. I'm sure it's in there somewhere. Order #3. That the City Manager is requested to confer with the Community Development Department on a process for establishing a formal, thorough review of the City’s Affordable Home Ownership programs, incorporating a plan for obtaining and analyzing substantial quantitative data inclusive of all types of units. Councillor Siddiqui, Councillor Simmons, Mayor McGovern, Councillor Toomey I suppose the requested information may prove interesting, but the whole concept strikes me as somewhat artificial. If you don't really have the freedom to do with your property as you see fit (within the bounds of applicable zoning), is it really yours? Order #5. That the City Manager is requested to confer with the appropriate City department to discuss the feasibility of allowing small businesses to host live acoustic music performances without a license, and if feasible, present the City Council with a proposal to allow such performances. Vice Mayor Devereux, Councillor Mallon, Mayor McGovern The requirement of a license simply gives the City (and abutters) some recourse in the event that problems or abuses arise. Perhaps a better idea would be to establish a very simple and very inexpensive (maybe even free) licensing procedure for acoustic music performances. Maybe even have it be an over-the-counter transaction where you simply pick up the list of expectations with the license and we simply trust that they'll be followed. Order #7. That the City Manager is requested to confer with the Community Development Department and any other relevant City departments to amend the Zoning Ordinance “Table of Uses” to allow for lodging houses in Residential A1, A2, and B Zoning Districts and to determine what tax incentives could be utilized to assist in the conversion of single-family/multi-family houses into lodging houses. Councillor Toomey, Councillor Simmons, Councillor Siddiqui, Mayor McGovern I think this could be a good thing that might provide some housing opportunities. The truth is that some people in these districts have been taking in boarders for ages. No whistle, no foul. I don't see the harm even if the whole building is given over to such a use - as long as a resident manager is required to live in the building and keep an eye on things. This idea is a lot better than some other proposals currently being considered, e.g. the "Affordable Housing Overlay". Order #9. City Council support of retirement fund fossil fuel divestment bill. Vice Mayor Devereux, Councillor Zondervan, Councillor Carlone There is something unsettling about city councillors dictating conditions on how public employees' pension money should be invested. I can certainly understand the City Council appealing to a retirement board to factor in the potentially negative consequences of their investment choices, but instructing them where they can and cannot invest those funds is a bit of an overreach. How would the City Council feel if the Retirement Board made recommendations about City Council salary and benefits? Order #10. That the City Manager provide the City Council with information that is offered to limited equity condominium owners regarding the ability to recoup extraordinary repair and maintenance costs, the procedure that is in place to inform purchasers of existing or possible construction and maintenance issues that may result in higher-than expected condo fees, and the possibility of allowing roommates to cover unexpected expenses. Councillor Kelley, Councillor Simmons, Mayor McGovern, Councillor Toomey In an ideal world, limited equity condominium arrangements should be independent of City agencies. The fact that this Order is being filed only highlights the shortcomings of having the City play an oversized role in the affairs of such buildings. If questions of "the ability of owners of limited equity condominiums to recoup extraordinary repair and maintenance costs" even have to be asked, then maybe the real question should be about the sustainability of this kind of housing model. The order also asks about "the possibility of allowing limited equity owners to have roommates to allow them to cover these sorts of unexpected expenses". If you don't have the right to take in roommates to help cover your expenses, then you don't really own anything. This is more like "pretend ownership". Order #13. That the City Manager be and hereby is requested to confer with the Economic Development Department on expediting zoning based on the 2015 Commercial Land Use Classification Study and exploring the feasibility of hiring more zoning planners. Councillor Siddiqui, Councillor Mallon, Councillor Zondervan, Councillor Carlone I still fail to see why this has taken so long. When we reach the point where a City Council order is filed suggesting how a City department should be managed and how many people should be hired, then something has gone terribly wrong. I haven't seen any City Council orders lately offering managerial advice to the Department of Public Works or the Department of Human Service Programs. Order #14. That the City Manager is requested to provide the City Council with information regarding accessory dwelling units. Councillor Carlone, Councillor Siddiqui Committee Report #3. A communication was received from Donna P. Lopez, City Clerk, transmitting a report from Councillor Dennis J. Carlone and Councillor Craig A. Kelley, Co-Chairs of the Ordinance Committee, for a public hearing held on Feb 5, 2019 to discuss the petition filed by the City Council to amend the Zoning Ordinances in Section 4.22 to allow for a special permit for the alteration of a single, two-family or accessory structure in existence as of January 2019. I think there are definitely more opportunities out there for accessory dwelling units as a good way to provide housing and flexibility. February Falderol - Feb 11, 2019 Cambridge City Council Agenda and OMFUGIn between bemoaning divine trees at Harvard and ordaining a Tree Tribunal, here are a few mundane Monday items up for City Council consideration: Manager's Agenda #1. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 19-08, regarding the Craigie Street Water Main break. This is the kind of topic-specific response I especially like. For example: "The Cambridge water transmission and distribution system consists of about 185 miles of underground pipe, 4,450 valves and 1,800 hydrants (the “Water System”). All these pipes and appurtenances are documented in the City’s GIS system. Each water main is defined by its age (date installed), material, size and whether it is cement lined or not." And this: "CWD has replaced, repaired or added over 2,730 valves in the Water System since 1980 and has also formalized a valve exercising program." And this: "CWD has replaced/rehabilitated or improved about 43 miles of pipe within the Water System since 1992." And this: "In the 50’s and 60’s, all of the large transmission mains were cement lined. In the 90’s, about 9,500 feet of pipe were cement lined as well." Cambridge residents should really try to get a basic idea of what it takes to keep the most basic elements of their city functioning - things like water, sewer, electric supply, natural gas infrastructure, roadways as well as things like rubbish disposal and recycling. Call it civic education. Manager's Agenda #6. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-111, regarding a report on TNC vehicles blocking travel lanes. TNC stands for "Transportation Network Company", a relatively new term necessitated by the advent of entities like Uber and Lyft that do all they can to distinguish themselves from the (regulated) taxi industry. By their account, they're just referral services that connect customers to drivers. One big difference is that there is built-in accountability for taxis, e.g., you could lose your right to operate as penalty for frequent or egregious violations. In contrast, many TNC drivers are just people with a license to drive with no special requirements for either customer service, geographical knowledge of an area, or expertise in lawful driving. Bending and breaking rules are common. This response from Police Commissioner Bard is primarily about short-term blocking of bike lanes for pickup/dropoff of passengers. Designated curb space for this purpose would help, and some existing taxi zones should be re-purposed for this. I don't personally buy the notion that brief stops in bike lanes endanger either cyclists or pedestrians, but it is an inconvenience and the prevalence of these TNC vehicles warrants better allocation of space. However, congested areas with competing needs will never operate like a Swiss watch and it's foolish to believe they ever will. Everybody has to give a little. Unfinished Business #5. A communication was received from Donna P. Lopez, City Clerk, transmitting a report from Councillor Dennis J. Carlone and Councillor Craig A. Kelley, Co-Chairs of the Ordinance Committee, for a public hearing held on Jan 9, 2019 to discuss a proposed amendment to the Municipal Code in Chapter 8.66 entitled “Tree Protection” to amend section 8.66.40 entitled “Applicability” and by adding a new section 8.66.055 entitled “Procedure for other projects.” [THE QUESTION COMES ON PASSAGE TO BE ORDAINED ON OR AFTER FEB 18, 2019.] It will be interesting to see if any actual wisdom emerges from the Feb 14 hearing on this (which some hasty councillors wanted to prevent). This has never been as simple as "Thou Shalt Not Cut That Tree No Matter What", and property owners deserve some flexibility in managing their property. Even if a tree is not currently dead, diseased, or dangerous there are situations when removal is still the best long-term option, especially if the removal may lead to better-situated, healthier trees thriving in the long term. Applications & Petitions #1. A Zoning Petition has been received from Stephen R. Karp, Trustee of Cambridge Side Galeria Associates trust to amend the Cambridge Zoning Ordinance by adding a new Section 13.100 to Article 13.00 of the Zoning Ordinance and to amend the Zoning Map to add a new PUD-8 District overlay that certain area (which includes parcels and portions of ways and streets) labeled as "PUD-8 district". It would be premature to comment much about this, but I definitely will look forward to a revitalized First Street, greater permeability through the site, and more diverse uses (including some housing), and improved architecture. I'm looking forward to hearing what the Planning Board and Councillor Carlone (who was involved in the original planning and development of the site) have to say as this petition makes its way through the hearings. Order #1. That the City Council go on record reaffirming its support of the homeless issues bills awaiting action in the House and Senate, and entreats its elected delegation in both bodies to actively work on moving these measures out of their respective committees on toward adoption. Mayor McGovern, Councillor Siddiqui, Councillor Mallon, Councillor Simmons Order #2. City Council support of legislation that protects children. Mayor McGovern, Councillor Siddiqui, Councillor Mallon, Councillor Simmons Order #7. That the City Council go on record in support of an “Act relative to the Massachusetts Rental Voucher Program” and an “Act to ensure right to counsel in eviction proceedings". Mayor McGovern, Councillor Simmons, Councillor Mallon, Councillor Siddiqui These three Orders encompass support for a range of proposals that shouldn't be particularly controversial. Order #6. That the City Manager is requested to report back to the City Council on the Apr 23, 2018 Policy Order seeking additional funding for affordable housing concerns. Councillor Simmons, Councillor Siddiqui, Councillor Mallon, Mayor McGovern This Order really should be understood in the context of other housing-related proposals currently being considered. These include the "Overlay" proposal to facilitate the transfer of private property to public or quasi-public ownership, support for a real estate transfer tax either via Home Rule or enabling legislation at the state level to fund this property transfer, and other initiatives. The City's policy seems to be centered on transferring as much privately-owned property into public or quasi-public ownership as possible. I'm not so sure that this is a very good long-term policy in spite of any short- or medium-term housing affordability issues. Order #9. That Rule 39, "Rules of Travel" under the “Rules of the City Council” hereby be amended to be titled "Rules of Travel and Other Council-Related Expenditures." Councillor Kelley, Councillor Toomey The basic idea here is that some councillors want more flexibility in funds available to them for hosting constituents and similar purposes. Do they realize that this is the reason there is a City Council office with a budget and staff? When has it not been the case that a city councillor could simply ask the staff to make arrangements for such get-togethers? Communications & Reports #2. A communication was received from City Clerk Donna P. Lopez transmitting a memorandum from Councillor Siddiqui, transmitting the submission of the Mayor's Blue-Ribbon Task Force on Tenant Displacement Jan 29, 2018 meeting minutes. It will be interesting to see if this task force actually focuses on practical ways to address these difficulties. Awaiting Report: 5 from 2016, 2 from 2017, 56 from 2018 (8 resolved this week), and 16 from 2019 (1 resolved this week). That's a total of 79 items awaiting a response with 9 of them addressed in this agenda. That's better than most weeks. It really is ridiculous to be dragging along items from so long ago without a response. If there really is neither the need nor the willingness to act on some of these, a simple response to the effect of "Not now, Councillors" would be better than leaving so many of these things to moulder. Seriously, is anyone still all that fired up to modify zoning to restrict restaurants where a wood-fired oven is used? If the City would just come back with a very basic proposal for an Outdoor Lighting Ordinance, we could scratch a couple more items off the list. Save the Groundhogs - Feb 4, 2019 Cambridge City Council AgendaResearch indicates that the groundhog population in Cambridge has reached an historic low. The consequences in terms of city planning will likely be devastating. While contemplating this impending disaster, consider the following items up for discussion as we enter the last six weeks of winter. Manager's Agenda #3. A communication transmitted from Louis A. DePasquale, City Manager, requesting that the City Council vote to accept Massachusetts General Laws Chapter 64N, Section 3 (“G.L.c.64N, §3”), which is the state law that allows municipalities to impose a local excise tax of up to 3% on retail sales of cannabis within the City. Into the General Fund, please. No earmarks. Manager's Agenda #4. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-104, regarding a report on a list of streets where it is recommended that the speed be reduced to 20 MPH. If you look at the map, this is pretty close to a citywide 20mph speed limit. Addendum: Sign, sign, everywhere a sign; Blockin' out the scenery, breakin' my mind; Do this, don't do that, can't you read the sign? Apparently there are over 400 streets that will have to get a 20mph sign because, you know, state law. You can't paint it on the roadway, and you can't just post the whole city as 20mph with the roads (including numbered highways) with slightly high speed limits being the exception. Logic vs. legislation. Charter Right #2. That the City Manager is requested to direct the appropriate City departments to conduct a formal and professional financial assessment of the additional value created for the owner/petitioner by up-zonings for developments of more than 50,000 square feet. The information will be interesting and useful, but I'm still concerned about the quid-pro-quo aspect of zoning for sale whether it be for cash or subsidized housing units. Addendum: The Mayor amended the Order to also assess the added benefit to the City associated with upzoning. I pointed out to the Mayor after the meeting that similar analysis should accompany downzoning petitions as well. About 20 years ago downzoning was all the rage and this definitely reduced the value of many properties. Some of the upzonings in recent years simply added back the height/density that had been taken away. Resolution #5. Retirement of Paul Burke from the Cambridge Police Department. Mayor McGovern, Councillor Mallon I have met many members of the Cambridge Police over the years, and Paul Burke ranks among my most favorite. Happy trails, Paul, and I hope to see you around town. Order #1. Dedication sign in honor of Tom and Ray Magliozzi. Mayor McGovern Ray worked on my VW Bus once, but he'll never admit it. Dewey, Cheatem, and Howe. Order #3. That the City Manager confer with Eversource and the appropriate City departments to undertake a series of studies and analyses related to finance, health and safety, building design, and long-term electricity needs before the construction of a substation in East Cambridge. Councillor Mallon, Mayor McGovern, Councillor Toomey, Councillor Siddiqui Anyone who has ever dealt with Eversource knows that they rarely do long-term planning - just reaction to developments being built, so let's just look at this as a way of assisting them. I'm sure they do need the new substation. The only question is where it should be located. Addendum: There were concerns expressed during Public Comment and by some city councillors regarding potential adverse health effects associated with the electromagnetic fields adjacent to major electrical infrastructure such as the one proposed on Fulkerson Street. I wonder if they are aware that there are several high voltage underground transmission lines criss-crossing the city. Should we all run for the exits? Order #5. That the Central Square Massachusetts Avenue sidewalk maintenance/repairs and replacement tree planting become part of the River Street/Barron Plaza project to bring Central Square back to the original circa 1990 intent. Councillor Carlone, Mayor McGovern, Councillor Simmons, Councillor Mallon Sure, fix up the sidewalks of Central Square and then some. I'm not sure that the "1990 intent" is necessarily the appropriate standard. There have been many reconfigurations of the sidewalks and streets of Central Square over the years and not all have been for the best. Order #6. City Council support of traffic safety bills SD.847/HD.1653, SD.1461 and SD.1383/HD.1534. Vice Mayor Devereux, Mayor McGovern The most significant of these (to me) is the setting of a safe passing distance of vulnerable road users, including cyclists. Nobody should get buzzed by a ton or more of flying steel, and that includes people standing on the sides of roadways. I also like the use of red light cameras, but you know all too well this will lead to hours of pointless debate about the evils of surveillance and the inalienable rights of scofflaws. Order #7. Proclaim Feb 12, 2019 as Darwin Day in Cambridge. Councillor Zondervan, Mayor McGovern, Vice Mayor Devereux, Councillor Carlone You can use the opportunity to announce the Darwin Awards. Late Order #12. City Council support of “An Act promoting housing opportunity and mobility through eviction sealing (SD 526 and HD 3815 HOMES).” Councillor Siddiqui, Councillor Mallon, Councillor Simmons, Councillor Toomey The concern expressed in the Order is that if a tenant files a complaint against a landlord it will go on the tenant's "permanent record" and may make renting more difficult in the future. That's a perfectly reasonable concern, though I don't have much sympathy for repeat offenders. Committee Report #1. A communication was received from Paula Crane, Deputy City Clerk, transmitting a report from Councillor Sumbul Siddiqui, Chair of the Economic Development and University Relations Committee, for a public hearing held on Dec 12, 2018 to discuss formation of a city commission dedicated to providing a forum for exploring and addressing the concerns of undergraduate, graduate, post-graduate and other post-high school students in Cambridge. I wish I could have attended this hearing, but I was busy teaching some of the very same people this proposal is about. I do wonder if the students the City Council hears from are really a representative sample. I somehow doubt it. Addendum: Several councillors chimed in on this. I have to say that forming a commission of young people that deliberates only about things of concern to young people seems awfully self-serving. A much better perspective (and one expressed by some councillors) was the importance of aggressive outreach to younger people who might serve on the whole range of City Boards & Commissions - maybe even some new ones. My suggestion is that we create the Board of Fun and charge it with coming up with ways to make Cambridge more fun for people of all ages. I can't imagine the Planning Board ever generating plans for miniature golf and/or batting cages. It took the Charles River Conservancy to bring the skate park to North Point. Communications & Reports #1. A communication was received from City Clerk Donna P. Lopez, transmitting a memorandum from Councillor Kelley regarding Tree Removal Comments. Councillor Kelley makes some good points in his memo. The real problem, however, is the complete inflexibility of the moratorium proposal some councillors are backing. The inability last week of four city councillors to understand the meaning of due process continues to stun me. Will blind zeal rule the day or will an adult legislator emerge with a thoughtful compromise that provides some flexibility for homeowners faced with difficult decisions? Picking through the pieces of the Jan 28, 2019 Cambridge City Council AgendaHere's my initial selection of the agenda items that either I find interesting or which are sure to bring out a crowd: Manager's Agenda #3. Transmitting Communication from Louis A. DePasquale, City Manager, relative to the appropriation of $175,000 from Free Cash to the Public Investment Fund Public Works Department Extraordinary Expenditures account to fund a Climate Change Resilience Analysis which will focus on zoning recommendations. Another $175,000 for a Climate Change Resilience Analysis? Didn't we do this not so long ago? Applications & Petitions #4. A Zoning Petition Has been received from Melissa Grippo and Christian Grippo, et al, requesting the City Council to vote to amend Section 5.30.11 of the Zoning Ordinance by adding the following sentence at the end of that section: “Notwithstanding the foregoing, in the Industry B District, a hotel use (Section 4.31.2), shall be governed by the second number (4.0) for purposes of determining the Maximum Ratio of Floor Area to Lot Area.” I don't know nuthin' about it, but there's now another zoning petition in the queue. Order #1. That the City Manager is requested to review the City’s communications and emergency response policies and protocols related to flooding resulting from infrastructure failures. Vice Mayor Devereux, Councillor Zondervan, Councillor Kelley Order #2. City Council support for I-90 Hybrid Plan with request for further review. Mayor McGovern, Vice Mayor Devereux, Councillor Zondervan BIG projects can be fun because when the scale of spending is large it creates opportunities to do some creative things around the edges of the necessary stuff. Envision that. Order #5. City Council support of HD2395: An act to further provide a rental arrearage program. Councillor Mallon, Councillor Simmons, Mayor McGovern, Councillor Siddiqui This is the kind of idea I can get behind - assisting people to get through a bad patch with some transitional assistance. It makes a lot more sense than some of the other proposals that have been floating around over the past year. Order #6. That the City Manager is requested to direct the appropriate City departments to conduct a formal and professional financial assessment of the additional value created for the owner/petitioner by up-zonings for developments of more than 50,000 square feet. Councillor Carlone, Vice Mayor Devereux, Councillor Zondervan I suspect the motivation behind this is not just information-gathering. It sure seems like a prelude to extracting more "community benefit" money out of proposed developments - or maybe just creating a political basis for not granting zoning relief at all. Naively, I would still like to believe that zoning should be based on good planning rather than on who's going to share the spoils. Committee Report #3. A communication was received from Donna P. That the tree protection ordinance amendment discussed at the Ordinance Committee hearing held on Wed, Jan 9, 2019 and referenced in Committee Report #3 of Jan 28, 2019 be further amended per additional language. Councillor Zondervan, Vice Mayor Devereux, Councillor Kelley Basically, the sponsors want to enact a one-year moratorium on tree "removal permits" (where have we heard that phrase before) except for dead, diseased, or dangerous trees. This doesn't seem to allow any discretion at all to property owners, and it treats ordinary small-scale homeowners just as harshly as those big evil developers. If you violate this prohibition they'll make you pay into a tree replacement fund. I'm sure this committee report and order will bring out the troops to public comment, but there are some serious problems with this proposal. Beyond the simple fact that there has not been proper legal notice (a moratorium is a lot stricter than a requirement to seek approval by the City Arborist), it also completely disrespects the rights of property owners to manage their own property. Furthermore, it would appear that the required payment for violating the moratorium will likely be well in excess of the cost of the tree removal. Most property owners would probably be OK with a reasonable ordinance that would dissuade them from wholesale deforestation of their property, but I seriously doubt whether there would be support for an ordinance that removed all discretion. Most property owners actually remove trees reluctantly and they certainly don't want to have to appear before the Tree Tribunal whenever they are faced with such a decision. This is a municipal election year and it's pretty clear that some people are trying to make tree protection a defining issue for the upcoming election. So let me dabble in a little political calculus for you. There are two, maybe three city councillors who stand to gain politically by being the tree champions. The councillors who will be collecting those #1 Votes are the ones who already have them from those voters who are rallying around this moratorium proposal. Any other councillors will be getting a #3 at best, and those preferences will count for nothing. On the other hand, there are a lot of homeowners - and that includes a lot of environmentally-conscious homeowners - who will not be particularly keen about having their hands tied even though they probably won't be reaching for the axe anytime during the next 12 months. Every week it seems like the current City Council shows just how little faith they have in the people who elect them. UPDATE: The City Council passed to a 2nd Reading the proposed revision to the Tree Ordinance included in the Committee Report (as amended in the report). Though there was spirited public comment favoring Order #7 - the proposed moratorium and punitive fines ($300/day) for removing a significant tree, the City Council voted 5-4 to send that proposal to the Ordinance Committee for an actual hearing and possible revision. This was really the only reasonable course of action, but Councillors Zondervan and Devereux apparently feel that discretionary tree removal, even by a homeowner, is the moral equivalent of murder. Councillors Kelley, Mallon, Simmons, Toomey, and Mayor McGovern voted in favor of due process; while Councillors Carlone, Devereux, Siddiqui, and Zondervan would have preferred immediate action without any public notice. There has never been any hearing where this punitive moratorium was on the agenda and where property owners could address their concerns. Councillors Zondervan and Devereux made it quite clear that they believe that informing people after a law is passed constitutes adequate notice. Democracy, representation, and due process apparently mean little to these councillors. - RW Order #8. That the City Manager is requested to instruct the City Solicitor, in consultation with the Election Commission, to report back on the legality and constitutionality of the proposed “Cambridge Publicly Financed Municipal Election Program” and the “Cambridge Municipal Election People’s Pledge.” Councillor Toomey, Councillor Kelley Though I would like to see the legal opinion on these ideas, I still think they are ill-conceived for Cambridge municipal elections. What's Coming Up at the Jan 14, 2019 Cambridge City Council meeting?Here's my take on the interesting stuff this week: Manager's Agenda #2. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-126, regarding the River Street Infrastructure and Streetscape Project. The basics: The outreach and design processes will occur throughout 2019 and into early 2020. Construction is anticipated to begin in 2020. $34 million has already been appropriated for the design and construction of sewer and drainage infrastructure improvements and surface enhancements on River Street between Memorial Drive and Central Square, including Carl Barron Plaza. Manager's Agenda #6. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-120, regarding the focus of Envision Cambridge goals during community presentations. If you read the infographic and fact sheet that's meant "to clarify the 100% affordable housing overlay concept and address any misconceptions related to its potential implementation or impact" it becomes abundantly clear that the Community Development Department has already made its decisions and is now in the process of conducting an advertising campaign to sell it (even though it has received dismal reviews in most venues where it was presented - for good reasons). DePasquale, City Manager, relative to Awaiting Report Item Number 18-97, regarding a report on updating vacant property database and reviewing strategies presented in the Storefront Vacancies Best Practices Report. I just hope people understand that popup/activation/placemaking or art displays in vacant storefronts is a pretty lame substitute for the real thing. This is really about finding a new economic equilibrium between retail demand and the costs associated with occupying commercial space - and you can't blame it all on Amazon. My own admittedly naive view is that for multi-story buildings with ground floor retail, that retail space should be re-conceived as something akin to the utilities in the basement - an essential part of the building that should not necessarily be viewed as a primary revenue-generator for the property. Let the upper floors pick up some of the tab. Resolution #10. Retirement of Timothy MacDonald from the Water Department. Mayor McGovern Resolution #12. Retirement of Robert Reardon from the Assessing Department. Mayor McGovern This is a double-whammy for me personally. I have known Tim MacDonald for over 30 years - ever since I served on a Water & Sewer Advisory Committee appointed by then-Mayor Al Vellucci. Tim served as Manager of Water Operations and Director of Water Operations. Blessed with a sense of humor and good nature to go along with his experience and expertise, Tim has long been one of the greatest assets of the Water Department. Robert Reardon may be one of the most qualified people in his field in the Commonwealth of Massachusetts. He's also one of my all-time favorite people in City Hall. He could write a book on the political history of Cambridge. Maybe he should now that he'll have time on his hands. I don't know whether to congratulate him or to beg him to reconsider. Order #1. That the City Manager is requested to direct the appropriate City personnel to compile a report outlining how a prolonged Federal Government shut-down may impact the people of Cambridge. Councillor Simmons, Councillor Mallon, Councillor Toomey, Councillor Siddiqui There are two sides to this inquiry. First, how will the lack of federal services and funds (for things like housing vouchers) affect residents who need those services and how many residents are affected? Second, how many residents of Cambridge have been furloughed from federal jobs? I'll add that banks, landlords, utilities, etc. should really step up and grant time extensions on bills and maybe even extend low or zero-interest loans in lieu of paychecks since (I hope) we all know this can't go on for too much longer. Order #3. That the City Manager is requested to confer with the Managing Director of the Water Department on whether the department is monitoring aged pipelines to prevent unexpected breaks and if information on the age of the pipes is readily available. Councillor Toomey This provides an appropriate follow-up to last week's Order on the age and maintenance of the city's water mains. Order #5. That the Neighborhood and Long-Term Planning Committee hold a public hearing to explore the feasibility of Transit X and their potential to provide an affordable, equitable, safe, practical, congestion-reducing, and eco-friendly public transportation solution for our community. Councillor Kelley, Councillor Zondervan, Councillor Carlone There was a guy going around maybe a year ago trying to sell people on this idea of mini-monorails running all over the city. It still seems a bit like something from a Fritz Lang film. Order #6. That the City Manager is requested to confer with the Community Development Department and the City’s legal services providers on establishing a system of information-sharing and/ or alternative method for making available that data which may be of beneficial use to the City in analyzing displacement. Councillor Siddiqui, Councillor Simmons, Councillor Mallon, Councillor Carlone Analysis is good, but please don't unfairly punish small-scale owner-occupant landlords who are just trying to manage their modest investment. I grow increasingly suspicious every week of the City Council's intentions. The Order provides a list of 46 outcomes of an eviction proceeding and not once does it make reference to an eviction being fairly carried out for justifiable reasons. Order #8. That the City Manager is requested to work with the Community Development Department and the Massachusetts Department of Public Utilities (DPU) to explore the feasibility of designing the next iteration of the Cambridge Community Electricity program. Kicking Off the New Year - Jan 7, 2019 Cambridge City Council Agenda HighlightsThe beginning of a municipal election year often features some table-setting, i.e. framing some of the issues that are bound to play out as we work our way to the November election. If bike lanes were the AOC of 2017, then trees, battles over density, and the next round of challenges to property ownership are taking the early lead in the 2019 rhetorical derby. Here are some of the agenda items that drew my attention this week. Resolution #3. Resolution on the death of Bob Richards. Mayor McGovern, Councillor Toomey Bob passed away on December 19. He has been a long-time friend and neighbor, one of the founders of the Antrim Street Block Party - the longest in the city, a CRLS teacher, and a dependable ally on the Ward 6 Democratic Committee. The phrase "he will be missed" is often said, but I will really miss the frequent conversations Bob and I have had over many years - and not all about politics. Order #1. Creating Gender X on Cambridge Birth Certificates. Mayor McGovern, Councillor Simmons, Councillor Mallon, Councillor Siddiqui I have lived in Cambridge now for over 40 years and can honestly say that I identify as a True Cantabrigian. I have even been accepted by many native Cantabrigians as something more than a carpetbagger. That said, my birth certificate identifies me as a New Yorker. I would like the option to have my birth certificate revised to better reflect my current identity. Order #4. Accessing revenue generated from new short-term rental legislation. Mayor McGovern This is a timely Order now that the Commonwealth passed short-term rental legislation late in the previous session. Communications & Reports #1. A communication was received from City Clerk Donna P. Lopez, transmitting a communication from Councillor Mallon, transmitting notes of the 3rd meeting of the Mayor's Arts Task Force. Order #5. That the City Manager work with the Cambridge Arts Council and Department of Finance to allocate a percentage of hotel/motel tax revenue and adult use cannabis tax revenue to the arts in the FY20 budget. Councillor Mallon, Mayor McGovern Order #6. That the City Manager work with the Cambridge Arts Council, Traffic and Parking Department, Community Development Department, and Central Square Advisory Committee to establish the Central Square Improvement Fund and allocate no less than 25% of funds generated to the arts. Councillor Mallon, Mayor McGovern Order #7. That the City Manager work with the Cambridge Arts Council and Community Development Department to make the appropriate updates to the City's 1% for arts ordinance. Councillor Mallon, Mayor McGovern As a long-time booster for Central Square, I suppose I should be thrilled with these Orders - and I am, but with reservations. I dislike the whole idea of earmarking revenues generated from specific activities for the exclusive use of very specific purposes - even if these purposes are things I support. Why should revenue generated by the cannabis industry be dedicated for arts purposes rather than early childhood education (just to give one example)? Why should 25% or more of a proposed Central Square Improvement Fund be dedicated toward arts projects? This is reminiscent of the whole Foundry Kerfuffle where some councillors felt that this building should be dedicated toward very specific arts-related purposes but other councillors had different priorities. There is something of a "cutting the line" in all this - proposing specific earmarking before other priorities have been considered. It's not the first time we've seen this, e.g. there have been and continue to be proposals to earmark revenue for the purpose of buying up residential buildings and properties solely for use as subsidized housing. Priorities do change from year to year. As for the One Percent for the Arts Ordinance, some revision may be in order, especially in regard to the rather harsh division between the commissioning of outside artists and the artistic talents of some of the people actually building publicly-funded projects. However, the rather simple math is that because a fixed percentage of the project funding is to be dedicated toward artistic components of a project, then as projects become more expensive the money dedicated for art rises proportionately. Order #8. Support Green New Deal. Councillor Zondervan, Mayor McGovern, Vice Mayor Devereux, Councillor Siddiqui Translation: This Order proposes to reject the plans proposed by the new House Democratic Leadership (Nancy Pelosi and Co.) in favor of a proposal from a newly elected member of Congress (AOC-NY). The Order also suggests corruption among Ms. Pelosi's leadership team ("will include legislators who have accepted contributions from or who have themselves made significant investments in the fossil fuel industry"). Please, councillors, edit out some of the WHEREAS's before voting on this symbolic Order. Order #9. Water Mains Age and Maintenance Update. Vice Mayor Devereux, Mayor McGovern The requested report is one I will definitely look forward to reading. Yes, I am an Infrastructure Geek. It says so on my birth certificate. Order #10. City Manager is requested to instruct the City Solicitor to prepare a draft Home Rule petition for a Real Estate Transfer fee. Councillor Carlone, Mayor McGovern, Councillor Siddiqui Insofar as this might cool down speculative investment in Cambridge real estate, I might be supportive. I do not, however, agree that any revenue generated should be dedicated exclusively toward the acquisition of property to be turned into subsidized housing. [See above remarks re: earmarking.] There is, however, a larger issue. Last year opened with a "Right of First Refusal" proposal to lay a heavy hand on who would have first preference in purchasing residential property put up for sale. Last year ended with the non-support of a state initiative re: housing growth and changes in the threshold for certain zoning changes based on concerns that there should be greater tenant protections (which often translates into greater restrictions on property owners). Councillor Siddiqui at one meeting referred to about 150 additional measures that could be considered in this vein. It is not at all surprising that property owners become concerned about all this - including many landlords who might otherwise be supportive of some of these proposals. Here's a suggestion: How about the City Council make a Declaration to the effect that "The City Council shall pass no law infringing on the rights of small property owners to engage in the ordinary business of renting their property in accordance with general laws." If small property owners were not (justifiably) fearful that their local City Council was planning to make their lives especially difficult, they might be a lot more supportive of proposals floated by the Council. Order #12. Amendment to the Municipal Code to create a new Chapter entitled "Cycling Safety Ordinance". Mayor McGovern, Vice Mayor Devereux, Councillor Siddiqui, Councillor Carlone Translation: This Order proposes to mandate via Ordinance that whatever the aspirational Cambridge Bicycle Plan (or any plan superseding it) says, then the City must implement those plans on any City-owned street under the City’s Five-Year Sidewalk and Street Reconstruction Plan unless there are extraordinary reasons for not doing so. It's amazing how wish lists becoming mandates [see Envision] has become the foundation for How We Do Planning in Cambridge. Order #13. Volpe Project Updates. Vice Mayor Devereux, Councillor Zondervan, Councillor Carlone I will look forward to hearing more about this. As the Order points out: "As a federal facility, the new Volpe Center will not be subject to the zoning or special permit requirements set out in the PUD-7 Zoning District that the City Council created in October 2017." Order #14. Major Public Building Projects Selection Committee Representation. Vice Mayor Devereux, Councillor Zondervan, Councillor Carlone We are once again nibbling away at the edges of the Plan E Charter. This Order proposes that there be "at least one City Councillor on the Selection Committee for any major public building project." In short, the Order wants to have an elected councillor involved in the awarding of City contracts. Red Flag. Committee Report #2. A communication was received from Donna P. Lopez, City Clerk transmitting a report from Councillor Zondervan and Vice Mayor Jan Devereux, Co-Chairs of the Health and Environment Committee for a public hearing held on Dec 4, 2018 to discuss reviewing the preliminary LiDAR-based canopy study results from Apr 1, 2018 and to discuss potential reasons for the precipitous decline in our tree canopy and any other related matter. There is a related campaign being floated to declare a Moratorium on the cutting of any tree on private property above a relatively low caliper except for reasons of safety. I actually do have very good reasons to cut down a significant tree in my yard, so give me at least a week's warning before you declare any Moratorium so I can take care of things. - Robert Winters, Native Cantabrigian |
