1. Transmitting communication from Robert W. Healy, City Manager, relative to
Awaiting Report Item Number 09-116, regarding a report on the legal requirements
for Citywide mailing for non-binding ballot questions.
2. Transmitting communication from Robert W. Healy, City Manager, relative to a supplemental appropriation of a grant from the MetroNorth Regional Employment Board for $169.00 to the Grant Fund Department of Human Service Programs Salary and Wages account ($156.00) and to the Grant Fund Department of Human Service Programs Other Ordinary Maintenance account ($13.00) and will be used to partially support a six hour per week morning GED preparation class at the Community Learning Center.

Healy, City Manager, relative to the appropriation of the Low Income Heating Assistance Program grant for $1,169,510.00 funded by the Federal Department of Health and Human Services and administered in Massachusetts by the Commonwealth's Department of Housing and Community Development to the Grant Fund Human Service Programs Salary and Wages account ($150,995.00) and to the Grant Fund Human Service Programs Other Ordinary Maintenance account ($1,018,515.00).

4. A communication was received from D. Margaret Drury, City Clerk, transmitting
a report from Councillor Timothy J. Toomey, Jr., Co-Chair of the Ordinance
Committee, for a meeting held on Nov 18, 2004 for the purpose of considering
proposed amendments to Chapter 2.74 of the Cambridge Municipal Code, the Police
Review and Advisory Board Ordinance. The question comes on passing to be
ordained on or after Feb 14, 2005. [Four sections of the proposed amendment were
passed to be ordained as amended. Ordinance #1284. The remaining proposed
amendments to chapter 2.74 remain on Unfinished Business.]
5. Transmitting communication from Robert W. 6. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Vice Mayor Sam Seidel and Councillor David Maher, Co-Chairs of the Ordinance Committee, for a meeting held on June 25, 2009 for the purpose of considering the Historical Committee's recommendation with regard to the Avon Hill Neighborhood Conservation District Boundary Report and Revised Recommendations. Committee Report Number One of Sept 21, 2009 was Accepted and Placed on File, Proposed Ordinance Passed to Second Reading and Order remains on Unfinished Business.

COUNCILLOR KELLEY
WHEREAS: The Route 2/Route 16 junction creates confusing traffic patterns; and
WHEREAS: A particularly problematic part of this junction is where Route 2
merges eastbound into Route 16; and
WHEREAS: Separated by an island, four lanes of traffic merge into two lanes of
traffic, with the additional complication of a popular right turn onto
Whittemore Avenue; and
WHEREAS: Drivers going east onto Route 16 from eastbound Route 2 have to merge
into Route 16 traffic at a challenging angle and without guiding traffic signals
or signs; and
WHEREAS: This intersection is under the control of the Department of
Conversation and Recreation (DCR); now therefore be it
ORDERED: That the City Manager be and hereby is requested to discuss this matter
with relevant City departments and DCR staff and report back to the City Council
on how the eastbound merge of Route 2 and Route 16 could be made less
nerve-wracking.

COUNCILLOR DECKER
WHEREAS: It has come to the attention of this City Council that access provided
by the Council on the Aging to the YMCA exercise facilities for seniors is
limited; and
WHEREAS: The hours of the Council on Aging are much more restrictive than that
of the YMCA and seniors have to go to the Council on Aging office to leave
picture ID in exchange for the key fobs which are used to scan in when entering
the YMCA - a time-consuming and burdensome process; and
WHEREAS: Some seniors require use of the YMCA exercise facilities as part of
physical therapy rehabilitation and as such, need to use the facilities multiple
times during the day and/or week; now therefore be it
ORDERED: That the City Manager be and hereby is requested to confer with the
Council on Aging and ask them to take one of the following actions: issue a
permanent pass to eligible seniors certifying that they are allowed to use the
exercise facilities during all YMCA regular operating hours, leave the actual
membership fobs at the YMCA membership desk, or propose another solution to
allow eligible seniors expanded access to the YMCA exercise facilities than are
currently allowed under the current Council on Aging senior membership
provisions; and be it
ORDERED: That the City Manager be and hereby is requested to report back to the
City Council on this matter.

the City of Cambridge website, there are technical limitations for Mac users -
specifically in their ability to view City Council Meeting videos online because

WHEREAS: It has come to the attention of this City Council that cement provided
by Aggregate Industries of Saugus, MA, may be being used on Cambridge City
construction/sidewalk projects; and
WHEREAS: Aggregate industries is the same company that, according to a 7/21/07
Wicket Local article entitled "Aggregate industries to plead guilty, pay
$50 million in cash" that pled guilty and was forced to "pay $50
million to resolve its criminal and civil liabilities in connection with a
fraudulent scheme to deliver adulterated concrete to the Central Artery/Tunnel
Project, best known as "The Big Dig;" now therefore be it
ORDERED: That the City Manager be and hereby is requested to confer with the
appropriate departments to determine whether or not Aggregate Industries is
indeed providing concrete to any Cambridge City construction or sidewalk
projects; and be it further
