CITY MANAGER’S AGENDA
1. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of a grant from the Massachusetts Cultural Council for $5,400 to the Grant Fund Historical Salaries and Wages account ($4,200) and to the Grant Fund Historical Other Ordinary Maintenance account ($1,200) which will primarily fund an archives assistant who provides support for on-going maintenance of the Commission's public archive as well as assisting members of the public with research requests.

2. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of a Massachusetts Water Resources Authority Grant for $4,987.57 to the Public Works Grant Fund Other Ordinary Maintenance account which provides reimbursement to the City for installing a total of 21 dual-flush toilets or low-flow toilet retrofits in various municipal buildings.

Healy, City Manager, relative to the appropriation of $154,730 in the General Fund Election Commission Other Ordinary Maintenance account to support the two special elections which are scheduled for Dec 8, 2009 (primary election) and Jan 19, 2010 (general election) for the vacant U.S. Senate seat and will be supported by Free Cash ($128,000) and an estimated State reimbursement of ($26,730) for the extended polling hours.

4. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of $958,388 in interest earnings associated with the $10.7 million Massachusetts Public Construction grant received from the Massachusetts Board of Library Commissioners to the Public Investment Fund Library Extraordinary Expenditures account to offset the construction costs of the new main library.

To the Honorable, the City Council:

I am hereby requesting the appropriation of $958,388 in interest earnings associated with the $10.7 million Massachusetts Public Construction grant received from the Massachusetts Board of Library Commissioners to the Public Investment Fund Library Extraordinary Expenditures account to offset the construction costs of the new main library. The appropriation of interest earnings was anticipated as part of the terms of the grant award. The use of interest earnings was planned for as part of the final funding component of this project as it comes to a close.

In exchange for the partial release of easement, BHX has agreed to grant a new, relocated water, sewer and utility easement in favor of the City in other portions of northwest Cambridge within Cambridge Discovery Park, and construct new utility facilities in these easement corridors.

UNFINISHED BUSINESS
4. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor Timothy J. Toomey, Jr., Co-Chair of the Ordinance Committee, for a meeting held on Nov 18, 2004 for the purpose of considering proposed amendments to Chapter 2.74 of the Cambridge Municipal Code, the Police Review and Advisory Board Ordinance. The question comes on passing to be ordained on or after Feb 14, 2005. [Four sections of the proposed amendment were passed to be ordained as amended. Ordinance #1284. The remaining proposed amendments to chapter 2.74 remain on Unfinished Business.]

TEXT OF COMMITTEE REPORTS
Committee Report #1
The Transportation, Traffic and Parking Committee conducted a public meeting on Tues, Sept 29, 2009 at five o'clock and thirty-nine minutes p. m. in the Sullivan Chamber.

The purpose of the meeting was to discuss clarification of the city's policy of parking motorcycles and motor scooters on city sidewalks.

Present at the meeting were Councillor Kelley, Chair of the committee; Sue Clippinger, Director, Traffic, Parking and Transportation; Cara Seiderman, Transportation Planner, Environmental and Transportation Planning Division, Community Development Department; Sergeant Kathy Murphy, Police Department; and Donna P. Lopez, Deputy City Clerk.

Also present was Astrid Dodds.

Councillor Kelley convened the meeting and stated the purpose. This matter was referred to this committee pursuant to an order submitted by Councillor Toomey (O #24 of May 11, 2009). A response was received from Police Commissioner Haas on June 12, 2009 (ATTACHMENT A). He stated that his issue was if motorcycles back up on the sidewalk they are too big and should not be on the sidewalk.

Ms. Clippinger stated that a motorcycle has a plate and therefore it is illegal to park on the sidewalk. If a motorcycle has a license plate and is on the public sidewalk it should be tagged. It can, however, be parked on private property. There is no issue with the Traffic, Parking and Transportation Department if a motorcycle is parked on private property. The city receives more complaints on mopeds. Ms. Seiderman stated that complaints are received about motorcycles parked at bike ramps. A moped versus motorcycles is the issue.

Councillor Kelley asked if there is a problem should there be a regulatory system established. Ms. Clippinger stated that a parking ticket is issued when a plate is identified. Councillor Kelley asked if moped and motorcycles are causing problems. Ms. Dodds responded that if they are parked at a bus stop it is a problem.

Ms. Clippinger stated that moped decals are numbered. The address and name of owner are obtained from the Police Department. A motorized vehicle that travels under 30 MPH that is determined by the Registry to be a moped and a moped decal is required. A new law went into effect on July 31, 2009, Chapter 523 of the Acts of 2008, which requires that these vehicles be regulated and registered. Councillor Kelley stated his concern about motorized scooters and bikes. Ms. Seiderman stated that the law was changed without input from the police. Motorized bikes are the new moped.

Ms. Clippinger stated that if low speed vehicles are given plates the RMV treats these vehicles the same as any other vehicle with plates. Enforcement is simple. However it will be onerous to get the name and address of the vehicle owner. This is an accessibility issue and will be treated like an abandoned bike.

Mopeds and limited speed vehicles are in various places in the City commented Ms. Clippinger. Councillor Kelley asked if this is an issue. Ms. Clippinger stated that the City benefits with the use of mixed vehicles without traveling at high speeds. It is hard to say use a parking space to park these vehicles because the owners are afraid of the vehicle being stolen. Motorcycles are not allowed on sidewalks and are subject to be tagged. It is not a regulatory or intent issue if a vehicle is on the public way - the vehicle should be tagged. The issue is Vespa scooters. These vehicles are not being ticketed because the City cannot obtain the name and address of the owners. They will be ticketed if there are numerous violations. There is an issue of new vehicle classification between motorcycles and mopeds.

Councillor Kelley stated that now the new vehicle classification is low speed vehicles which can travel up to 30 MPH and requires that the operator must be sixteen and the vehicle needs to be insured and registered before traveling on public ways.

Ms. Seiderman stated there is an issued with these vehicles parking on the sidewalk because they are usurping parking spaces. The Pedestrian Committee would like parking spaces provided for these vehicles. Ms. Dodds commented that the renovations to Porter Square ruined bike parking spaces because the bike racks were placed on the sidewalk. She inquired if there is a city that is using parking spaces for dedicated bike parking. Councillor Kelley stated that it is not reasonable to take away car parking spaces for scooter or bike parking. He had a concern about scooters or motorcycles being dropped on the sidewalk. These vehicles need a designated place and enforcement is needed. Ms. Dodds spoke about drivers of bikes, scooters or motorized vehicles driving over sidewalks.

A discussion ensued about the number of complaints. Ms. Clippinger stated that complaints have been received about scooters parked on sidewalks and scooters parked at bike racks, preventing bike being able to park. Councillor Kelley stated that a different design is needed for scooter parking than for bike parking. Ms. Seiderman explained a design of scooter parking at the curb where a scooter could be chained to a low rail. This design could accommodate five scooters per rail. Ms. Clippinger spoke about the work done to develop more bike parking and now there is a whole new vehicle that requires parking. Ms. Dodds complained about too many bikes parked at the north bound bus stop in Porter Square. Sergeant Murphy stated that the Police Department would contact the MBTA about the bikes left at the bike racks.

Councillor Kelley asked if it was legal for the new low speed vehicles to travel in the bike lanes. Ms. Seiderman stated that it is not clear how this decision was made. Ms. Clippinger stated this new regulation could cause problems at "right on red" turns because these vehicles travel faster than bikes.

Sergeant Murphy suggested a wait and see attitude about the regulatory process. Ms. Clippinger added that the moped plates expire in December. The problem is hard to solve across the city all at once. This may be a problem next spring. The City will respond to the problem as it arises.

Councillor Kelley stated that he did not want to discourage the use of these vehicles instead of cars. Ms. Seiderman stated that mopeds should be parked like cars with dedicated moped parking spaces. Ms. Dodds stated that more bike parking is needed on the Somerville side of Porter Square. Ms. Seiderman informed Ms. Dodds that there is a list of 125 bike rack installations that the City is working on this year. Porter Square is on the list. The squares are the highest priority for bike racks; but the resources are limited. The MBTA elevator construction will include bike racks. Ms. Clippinger added that there is more bike parking in Harvard Square than on-site parking.

Ms. Clippinger stated that enforcement of motorized vehicles can occur if the plate information is put into the system. If vehicle is parked illegally it should be ticketed. Sergeant Murphy commented that mopeds are not used in inclement weather. The price of gas is the cause for the increased use in bikes and mopeds.
