ORDERED: That the Cambridge Masonic Temple, 1950 Massachusetts Avenue, be designated as a protected landmark pursuant to Chapter 2.78, Article III, Section 2.78.180 of the Code of the City of Cambridge, as recommended by vote of the Cambridge Historical Commission on Oct 8, 2009. These premises so designated is the land defined as parcels Parcel 118 of assessor’s map 178 and the building thereon and the premises described in a deed recorded in book 2274, page 422 of the South Middlesex Registry of Deeds.
This designation is justified by the important architectural and historical associations the property embodies as one of two extant fraternal buildings in Cambridge, and as the largest and most elaborate building in Cambridge designed by builder Frederick Furbish.
The effect of this designation shall be that review by the Cambridge Historical Commission and the issuance of a Certificate of Appropriateness, Hardship or Non-Applicability shall be required before any construction activity can take place within the designated premises or any action can be taken affecting the appearance of the premises, that would in either case be visible from the public way. In making determinations, the Commission shall be guided by the terms of the final landmark designation report, dated Oct 8, 2009, with respect to the designated premises, by Section VII, Standards and Criteria of said report, and by the applicable sections of Chapter 2.78, Article III, of the Cambridge Municipal Code.

In response to Awaiting Report Item Number 09-128, regarding a report on whether or not listing public notices on the City website could fulfill the obligation of the City of public legal notices, please be advised of the following:
The current state laws do not allow a municipal website to substitute for publication in a newspaper of general circulation of legal notices. However, legislation is pending as part of the "municipal relief" package that would allow this to occur.

13. Transmitting communication from Robert W. Healy, City Manager, relative to a License Commission recommendation to disapprove the Jitney application of Cambridge Airport Shuttle, Inc.
14. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of the Agenda for Children’s Talk and Read grant in the amount of $4,186.00 received from the Cambridge Public Health Department to the Grant Fund Human Service Programs Salary and Wages account ($2,324.00) and to the Grant Fund Human Service Programs Other Ordinary Maintenance account ($1,862.00) and will be used to support the Community Learning Center in recruiting students to participate in training and arrange for them to present to CLC students who are parents and also partially supports one full-time coordinator and contracted student leaders for their training and presentation time.
15. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of the Friends of the Community Learning Center (CLC) donation in the amount of $17,500.00 to the Grant Fund Human Service Programs Salary and Wages account ($16,938.00) and to the Grant Fund Human Service Programs Other Ordinary Maintenance account ($562.00) and will support part-time lab assistants who work with students in the computer lab.
16. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of the Friends of the Community Learning Center (CLC) donation funded by the Cambridge Community Foundation under their Immigrant Initiative in the amount of $30,000.00 to the Grant Fund Human Service Programs Salary and Wages account ($27,635.00) and to the Grant Fund Human Service Programs Other Ordinary Maintenance account ($2,365.00) and will support two intermediate ESOL classes at 19 Brookline Street in the Community Learning Center.
17. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of the Friends of the Community Learning Center (CLC) Bridge to College Program donation in the amount of $23,000.00 to the Grant Fund Human Service Programs Salary and Wages account ($22,302.00), to the Grant Fund Human Service Programs Other Ordinary Maintenance account ($98.00), and to the Grant Fund Human Service Programs Travel and Training account ($600.00) which will support the Bridge to College program which consists of one class that meets two evenings per week for a total of six hours of instruction per week.
18. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of 21 Proof Training donations in the amount of $20,000.00 to the Grant Fund Human Service Programs Salary and Wages account ($18,500.00), to the Grant Fund Human Service Programs Other Ordinary Maintenance account ($500.00), and to the Grant Fund Human Service Programs Travel and Training account ($1,000.00) which were received to from numerous alcohol-serving establishments in Cambridge to allow for the Cambridge Prevention Coalition to conducting 21 Proof server training.
19. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of the American Red Cross of Massachusetts Bay (ARCMB) grant in the amount of $25,602.00 received from the Metro North Regional Employment Board originating from the American Recovery and Reinvestment Act funds to the Grant Fund Human Service Programs Salary and Wages account ($24,102.00) and to the Grant Fund Human Service Programs Other Ordinary Maintenance account ($1,500.00) to provide an integrated ESOL/Nurse Assistant/Home Health Aide training.
20. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of the Friends of the Community Learning Center (CLC) donation in the amount of $16,000.00 to the Grant Fund Human Service Programs Salary and Wages account ($15,946.00) and to the Grant Fund Human Service Programs Other Ordinary Maintenance account ($54.00) which will support two ESOL classes at the Community Learning Center.
21. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of the STOP Act grant program for $50,000.00 funded by the Substance and Mental Health Services Administration to the Grant Fund Department of Human Service Programs Salary and Wages account ($6,939.00), to the Grant Fund Department of Human Service Programs Other Ordinary Maintenance account ($41,061.00), and to the Grant Fund Department of Human Service Programs Travel and Training account ($2,000.00) and will be used to create new 21 Proof trainings for security personnel, and to create marketing campaigns, including both print and electronic media, to reduce social access of alcohol to those under 21.

Healy, City Manager, relative to the transfer of funds from the Low Income Heating Assistance Program (LIHEAP) in the amount of $5,689.86 from the Grant Fund Human Service Programs Travel and Training account to the Grant Fund Human Service Programs Other Ordinary Maintenance account due to staff not being able to attend the national conference because of work obligations, plus the state overnight conference being cancelled and instead being held in Boston, MA.

4. A communication was received from D. Margaret Drury, City Clerk, transmitting
a report from Councillor Timothy J. Toomey, Jr., Co-Chair of the Ordinance
Committee, for a meeting held on Nov 18, 2004 for the purpose of considering
proposed amendments to Chapter 2.74 of the Cambridge Municipal Code, the Police
Review and Advisory Board Ordinance. The question comes on passing to be
ordained on or after Feb 14, 2005. [Four sections of the proposed amendment were
passed to be ordained as amended. Ordinance #1284. The remaining proposed
amendments to chapter 2.74 remain on Unfinished Business.]

6. A communication was received from D. WHEREAS: The Cambridge Housing Authority is holding a hearing on the evening of
November 16, 2009, in direct conflict with a regularly scheduled City Council
meeting; and
WHEREAS: The purpose of the Cambridge Housing Authority's hearing is to discuss
the proposed federalizing of state public housing in Cambridge; and
WHEREAS: The federalizing of state public housing in Cambridge has the
potential to render many immigrant and low-income individuals and families
homeless due to stringent federal reporting and documentation requirements, and
it may also extend the length of time that other people on the housing waitlists
will need to wait before securing viable housing; and
WHEREAS: Cambridge is a Sanctuary City committed to protecting its
immigrant residents; Cambridge is also a city that is regularly working to find
homes for its homeless and under-housed population, and local officials are
mindful of the great difficulties that this population already faces in this
regard; and
WHEREAS: After a thoughtful review and discussion process, the City of
Somerville has opted not to select federalizing of its state public housing; now
therefore be it
ORDERED: That the City Manager be and hereby is requested to ask the Cambridge
Housing Authority to postpone making a decision on federalizing until the City
Council has had a sufficient opportunity to analyze and discuss this matter, and
to determine what short-term and long-term impact such a move would have upon
the City; and be it further
ORDERED: That the City Council go on record expressing its regret that the
Cambridge Housing Authority scheduled a public hearing on this important matter
at a time when City Councillors were not able to attend the housing hearing.
