CITY MANAGER’S AGENDA  
1. Transmitting communication from Robert W. Healy, City Manager, relative to a Planning Board recommendation on the Rooftop Mechanicals Zoning Petition.

CHARTER RIGHT  
1. An application was received from Kendall Square, LLC, requesting five curb cuts at the premises numbered 364 Third Street; said petition has received approval from Inspectional Services, Traffic, Parking and Transportation with conditions, Historical and Public Works pending Traffic and Parking conditions. Two neighborhood association letters were sent. One neighborhood association approved and the other association responded that it needs more information to make a decision.

2. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 03-87, regarding the planning process for Massachusetts Avenue from the Cambridge Common north to Porter Square.

3. Requesting the City Council go on record reaffirming its strong commitment to affordable housing, opposing the return of rent control to Cambridge, and take no action on the initiative petition for home rule legislation to re-establish rent control, the issue to be decided by the citizens of Cambridge in the November 4, 2003 election.

6. Request the City Manager to direct the Community Development Department to make maximum use of CPA funds to develop affordable housing that is permanently affordable, such as limited equity cooperatives and condos.

UNFINISHED BUSINESS  
11. Petition from Harvard University requesting a sub-surface easement located between 1720 and 1737 Cambridge Street for the purpose of constructing an underground pedestrian and service tunnel beneath Cambridge Street.

12. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor David P. Maher and Councillor Brian Murphy, Co-Chairs of the Ordinance Committee, for a meeting held on July 30, 2003 for the purpose of considering: Petition re-filed by the Planning Board to amend the zoning in the Riverside area and The question comes on passing to be ordained on or after October 13, 2003. Petition expires October 28, 2003. Petition re-filed by Robert S. Carlson et al., to amend the zoning in the same area. The question comes on passing to be ordained on or after October 13, 2003. 13. A communication was received from D. Margaret Drury, City Clerk, transmitting a Certification from the Election Commission of the signatures on an initiative petition entitled "Ordinance Regulating Residential Rents and Evictions." Two objections to the certification have been filed.

14. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor Brian Murphy and Councillor David P. Maher, Co-Chairs of the Ordinance Committee, for a meeting held on September 24, 2003 for the purpose of considering a proposed amendment to the Zoning Ordinance to rezone city parks and recreational facilities as open space. The question comes on passing to be ordained on or after November 3, 2003. Petition expires December 23, 2003.

15. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor Brian Murphy and Councillor David P. Maher, Co-Chairs of the Ordinance Committee, for a meeting held on September 24, 2003 for the purpose of considering a petition to amend the Zoning Ordinance to implement the recommendations of the Rooftop Mechanical Task Force which met from February 2002 to May 2003. 16. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor Brian Murphy and Councillor David P. Maher, Co-Chairs of the Ordinance Committee, for a meeting held on September 24, 2003 for the purpose of considering a proposed amendment to the Zoning Ordinance to modify the Table of Use Regulations in the ordinance to restrict or eliminate some anomalous uses now allowed in open space districts. 17. Transmitting communication from Robert W. Healy, City Manager, relative to the reallocation of the $500,000 in bond proceeds issued on December 15, 2001 to fund the Lafayette Square Reconstruction Project to the Cambridge Street Improvement Project. I am also requesting that the $500,000 appropriation be rescinded. On or after November 3, 2003 the question comes on adoption.

WHEREAS: Governor Romney and the Secretary of Veterans Services have proposed changes to the Code of Massachusetts Regulations (CMR) Section 108 that would eliminate the Retirement/Disabled Allowance for veterans who receive a Service Connected Disability, cap medical assistance to only those Veterans/Spouses at 200 percent or less of the federal poverty level, reimburse only approved Veterans' Grave Flags, and eliminate the State Annuity program in the FY05 State Budget; now therefore be it
RESOLVED: That this City Council go on record opposing the proposed changes to CMR 108; and be it further
RESOLVED: That the City Clerk be and hereby is requested to send a suitably engrossed copy of this resolution to Governor Romney, the Secretary of Veterans Services and the Cambridge delegation to the Massachusetts State Legislature.

WHEREAS: Numerous complaints to health code violations have been filed by residents against an individual who resided on Fayette Street; and
WHEREAS: These complaints were related to mistreated and neglected animals; and
WHEREAS: The individual moved to Boston and then to Watertown; and
WHEREAS: Abutters have incurred large legal fees; and
WHEREAS: Boston and Watertown were able to take swift action to prevent violations to health and animal regulations; now therefore be it
ORDERED: That the City Manager be and hereby is requested to examine the actions taken by Boston and Watertown in an effort to uphold the health and animal regulations and keep residents and animals safe and healthy.

ORDERED: That the City Manager be and hereby is requested to assist the City Council in creating an oversight body whose purpose will be to oversee and implement the Memorandum of Agreement signed by Harvard University and the Riverside neighborhood, particularly the affordable housing units and the open space designs; and be it further
ORDERED: That consideration should be given to various oversight structures, but the final vehicle must include representatives from the Riverside neighborhood, Harvard, the City Council and City Administrative Staff. Particular attention must also be paid to the duration of the discussed building projects, and a timeline for the overall plan completion. The City Manager should report back to the City Council in one month.
