To the Honorable, the City Council:

Listed below are the recommendations of the Community Preservation Act (CPA) Committee for FY2008. For additional information, please see attachments from CPA Committee Chair, Richard Rossi, dated 9/6/07.

In accordance with the CPA Committee’s recommendations, I am requesting that the City Council formally appropriate CPA funds raised by the City’s FY2008 CPA surcharge, the FY2007 state match funds received in FY2008 and the existing CPA fund balance.

For this appropriation, it is estimated that the net local receipts from the CPA surcharge for FY2008 will total $5,800,000 with an additional state match of approximately $5,800,000. In addition, $1,007,500 from CPA Fund Balance is being recommended for appropriation. The total of these appropriations from these funding sources is $12,607,500.

On Sept 5, 2007, the CPA Committee made recommendations for allocation of these FY08 funds. By unanimous vote, the CPA Committee recommended to the City Manager that the CPA funds be allocated and appropriated as follows:

While it is expected that the City will receive in FY08 a 100% match for CPA funds received in 2007, the state will not release these matching funds until October of this year, which is the first half of FY08. For this appropriation, the estimated state match would result in an additional $5,800,000 to be used for CPA purposes. The Committee recommends that these funds be used as follows:

Re: Allocation and Appropriation of CPA Funds

The purpose of this memo is to summarize the meeting of the Community Preservation Act Committee on Sept 5, 2007 and to convey their recommendations for the use of CPA funds for FY2008 appropriation. See list of Committee members and City staff present at the meeting, below.

Recommendations made by the Committee on Sept 5th were based on input from the City Manager and the City Council’s goals statement, as well as the staff presentations and public comment heard at the CPA public meeting held on Aug 22, 2007. Approximately 50 members of the public attended this publicly advertised meeting. Of that number, 33 people spoke. In addition, two letters were received from people who were unable to attend, who both supported continuing the 80% allocation to affordable housing. The great majority of public speakers supported continuation of the 80-10-10 split of CPA funds in favor of affordable housing. A number of East Cambridge residents voiced their interest in seeing the allocation of funds to Open Space increased, if not this year, in future years. A few specifically spoke in support of an athletic field or other recreational facilities for East Cambridge. An explanation regarding other non-CPA sources of funding for Open Space was provided, including the allocation of more than $8 million on open space and recreational projects in recent years.

Based on this input, the Committee recognized that the creation and preservation of affordable housing clearly remains the CPA Committee’s and residents’ highest priority. In addition, the projects listed below in the areas of historic preservation and open space were also identified for funding and generated support at the community meeting.

Accordingly, on Sept 5, 2007, the CPA Committee voted unanimously to recommend to the City Council, through the City Manager, that the CPA funds be allocated and appropriated as follows:

COUNCILLOR KELLEY
WHEREAS: The Cambridge Noise Ordinance has specific limits on what levels of noise are permissible from various types of equipment at what times of day; and
WHEREAS: Newly installed equipment such as air conditioning units and heating vents often require building permits and a contractor's signature on the Noise Affidavit; and
WHEREAS: If the newly installed equipment does not meet the requirements of the Noise Ordinance it is up to neighbors to lodge a complaint to get the issue addressed which can strain neighbors' relationships with each other; and
WHEREAS: Neighbors would not be placed in the awkward position of complaining about other neighbors' noisy equipment if the City ensured compliance with the Noise Ordinance before granting a Certificate of Occupancy or otherwise approving a project's completion; and
WHEREAS: Other code enforcement programs in the City, such as electrical or plumbing, require an inspector to visit a project and sign off that th relevant work has been properly completed: and
WHEREAS: Inspectors with noise meters could visit project and measure noise levels from newly installed equipment to ensure that the equipment does not violate Cambridge's Noise ordinance before issuing a Certificate of Occupancy or otherwise approving a project's completion; now therefore be it
ORDERED: That the City Manager be and hereby is requested to confer with relevant Department heads about the estimated costs and feasibility of changing the City's code requirements so that City officials measure the noise from any newly installed equipment for which a Noise Affidavit has been completed prior to final approval of the project or granting of the Certificate of Occupancy; and be it further

WHEREAS: The following programs need to be retained and fully funded: the Farmers Market Promotion Program, the Specialty Crop Block Grant Program, the Farm to School Program, the Farmland Protection and Farmland Viability Programs, the Fruit and Vegetable Pilot Program, and the Senior Farmers’ Market Nutrition Program; and
WHEREAS: The Community Food Projects program needs mandatory funding at the level of $30 million dollars; now therefore be it

WHEREAS: The city is paying hundreds of thousands of dollars annually to rent spaces for the Community Learning Center and The Multi-Service Center, and through the school department budget for the school department’s central administration; and
WHEREAS: There have been discussions to relocate those three uses to the current Police Headquarters site, after the new site is built and after renovations to the current Police Headquarters site; and
WHEREAS: The costs of the School Department central administration are not eligible for state reimbursement; and
WHEREAS: It is anticipated that the cost of needed renovations to the current Police Headquarters site will be extremely high; now therefore be it

WHEREAS: Recent changes to the pedestrian signals at the junction of Rindge and Massachusetts Avenue have resulted in confusion amongst pedestrians who did not realize that, initially, the pedestrian button was no longer activated and, later, that pushing the pedestrian button was necessary to get a "Walk" signal across Massachusetts Avenue; and
WHEREAS: Confused about why the walk cycle did not seem to be working, pedestrians sometimes tried to cross Massachusetts Avenue during the "Don't Walk" cycle, resulting in a more dangerous crossing for them; and
WHEREAS: Notices of changed timing or signal cycles posted at signalized crosswalks could help alleviate confusion and ensure that pedestrians cross during the safer "Walk" cycle; now therefore be it
ORDERED: That the City Manager be and hereby is requested to ensure that City staff prominently post temporary notices that pedestrian cycles and pedestrian signals have been changed when such changes have taken place.

WHEREAS: Many bus stops also pose risks to children from heavy, confusing or unpredictable traffic patterns; now therefore be it
