UNFINISHED BUSINESS
8. Petition from Harvard University requesting a sub-surface easement located between 1720 and 1737 Cambridge Street for the purpose of constructing an underground pedestrian and service tunnel beneath Cambridge Street.

9. The proposed amendment to Chapter 8.28 of the Municipal Code, which restricts youth access to tobacco and prohibits smoking in workplaces and public places, would prohibit smoking in all restaurants and bars. The amendment also modifies the exception for private clubs. The question comes on passing to be ordained on or after February 24, 2003.

10. The proposed amendment to Section 2.121.030 (b) of the Municipal Code, regarding the calculation of the yearly cost of living adjustment to the Living Wage Ordinance. The question comes on passing to be ordained on or after March 31, 2003.

11. Consent Agenda #5 of March 17, 2003 relative to the Disposition Report for Trolley Square, prepared by the Community Development.

APPLICATIONS AND PETITIONS
1. An application was received from Tellos Clothing Company, requesting permission for a display of merchandise at the premises numbered 596 Massachusetts Avenue.

2. Approval of constable bond surety was received from James M. Desrosiers.

3. A petition was received from Carolyn Thall, et al., requesting to rezone Plat 112-Plots 49, 50, 51, 52, 53, 54, 55, 56, 95 and 96, currently zoned as Residence C-1, for inclusion in the adjacent Residence B District.

4. An application was received from Newtowne Variety, requesting permission for a sign and four awnings at the premises numbered 93 Windsor Street. Approval has been received from Inspectional Services, Community Development Department and abutters.

1. A communication was received from Judge Santo Ruma and family, transmitting appreciation for the resolution adopted by the City Council on behalf of Mary Ruma.

2. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor E. Denise Simmons, Chair of the Human Services Committee, for a meeting held on February 27, 2003 for the purpose of continuing the discussion on out-of-school (OST) time programs.

3. A communication was received from Donna P. Lopez, Deputy City Clerk, transmitting a report from Vice Mayor Henrietta Davis, Chair of the Public Safety Committee, for a meeting held on March 13, 2003 to discuss the City’s education campaign regarding bicycle and pedestrian safety.

4. A communication was received from Donna P. ORDERED: That the City Manager be and hereby is requested to report to the City Council the following information relative to property taxes paid and not paid by the universities in Cambridge:
   * Identify the for profit buildings which the universities own and pay property taxes on
   * Describe the criteria by which these properties are determined to be taxable or tax exempt
   * For all exempt properties, specify the date on which the property became exempt and the amount of property taxes paid in the last tax year prior to the exemption
   * For each said exempt property, provide information as to the amount paid in lieu of property tax, if any
   * For each said exempt property calculate the taxes that would have been paid had the property stayed on the tax role
   * For each property, calculate the net difference between the total in lieu of tax payment 
      and the total taxes that would have been paid if the property had remained on the tax roles.
