To the Honorable, the City Council:

In response to Awaiting Report 22-11, which requested that the City work with DCR on the continuation of the Saturday and Sunday Riverbend Park openings that have occurred in the past two year, and considering the potential to expand Riverbend Park to include areas east of Western Avenue, Traffic, Parking & Transportation Director Joseph Barr reports the following:

Regarding the first item, we have spoken with senior staff from DCR, and they are very interested in working to continue to expand the hours during which Riverbend Park is open (and Memorial Drive is closed) to include both Saturdays and Sundays for the 2022 season. This could potentially involve opening Riverbend Park for the entire weekend (from Saturday morning through Sunday evening) rather than continuing the previous plan under which Memorial Drive was reopened from Saturday evening through Sunday morning. In addition, DCR has indicated an interested in exploring the process that would be required to make these full weekend openings of Riverbend Park permanent, rather than simply being a temporary measure connected to COVID-19 response.

Regarding the second item regarding the physical expansion of Riverbend Park, DCR has also expressed an interested in looking at this in the future, through a community and stakeholder engagement process. DCR is still planning to restart the planning and design process for the segment of Memorial Drive between the Anderson Memorial Bridge/John F. Kennedy Street and the Boston University Bridge, which has been separated from the remainder of the Memorial Drive Phase III project (which extends from the Eliot Bridge to JFK Street). This appears to be the most appropriate venue to discuss the potential to expand Riverbend Park farther east, since it will include both a community engagement process and an opportunity to evaluate potential physical design changes that might help support the expansion of Riverbend Park. As that planning and design process move forward, we will continue to engage with DCR to ensure that Riverbend Park expansion is part of the discussion.

Interesting that the loss of one or two parking spaces at this location due to a curb cut gets so much pushback when elsewhere hundreds of parking spaces are being permanently removed for “quick build” bike lanes that impact businesses, health care providers, day care facilities, churches, and more.

Attached is a petition signed by over 1,050 names requesting changes to the Cycling Safety Ordinance. The supporters of this petition have been writing, calling, and meeting with city trying to ensure all stakeholders have a voice in the redesign of Cambridge’s streets. A compromise and solution has yet to be found that will ensure that Small Businesses can survive, residential neighborhoods will remain free from diverted commercial traffic, and commuters of all modes of transportation can safely use our roads. There have been policy orders passed that have yet to be acted on, and community meetings held that have not substantially provided needed parking for our businesses or preserved the quiet of our neighborhoods. The strict deadlines and requirements of the Cycling Safety Ordinance need to be evaluated and modified.

We are requesting a City-Wide Project Manager in Charge of implementation. The city is continuing to install over 22 miles of vertically separated bicycle lanes without looking at how these lanes affect the city as a whole. The project areas divide major roadways into small subsections without regard to how disrupting one roadway affects abutters and others in the city. Pushing traffic off major commercial ways and onto nearby residential streets does not make our roads safer. It simply moves the hazards onto other roads, and other populations. Meetings, letters, and calls to the city are met with a runaround and no solutions, as each Department throws responsibility to another City Department. There needs to be one responsible Project Manager that has the authority to reach out to the needed city departments to address concerns. Policy Order #276 was passed on January 10, 2022 requiring the creation of a Cycling Safety Ordinance Implementation Advisory Committee, with the appointments to be announced no later than January 31, 2022. This Advisory Committee has yet to be named, convened, or allowed to give input. Deadlines written into the ordinance are approaching. This advisory Committee working with City-Wide Project Manager in Charge of implementation of the Bicycle lanes needs to be allowed to meet and give input that is actually heeded before construction continues.

The Petition calls for an Evaluation process with goals and target points set, to be used on new and existing protected bike lanes. The ordinance required an impact analysis for the Mass Ave 4, and one has been accepted by the city, but it does not include Financial and Economic impact. The City Council and the City Manager should be requesting this financial information to be provided as required by the ordinance. A policy order, POR 2022 #29 was passed but it is targeting the area of Mass Ave between Alewife Brook Parkway and Dudley Street. There are many vertically separated bicycle lanes that have already been built. Data is already available on the affects the separated bicycle lanes have on our businesses and residents. This data needs to be compiled and used quickly before more construction is completed.

Shared Parking that protects residents’ ability to park on their streets and also lets others use available spaces during daytime hours needs to be developed. If shared parking programs can allow Business owners, employees to park on nearby streets it would help to compensate for some removal of parking spaces. Short term stopping for 15 to 30 minutes does not help patients of doctors, dentists and therapists, or other people needing services. Shared parking may help these patients retain access to medical and other service providers.

We support the businesses and neighborhoods that rely on Mass Ave as a major roadway for our city. We need a plan for the city that will Improve Safety for everyone, will help Traffic flow, preserve Parking and support Public Transportation and Businesses. If the Cycling Safety Ordinance will not allow for a plan that meets those goals, the ordinance needs to be changed.

Petition for Citywide Stakeholder Oversight and Evaluation for Protected Bike lanes in Cambridge

We the undersigned request that the City of Cambridge:

*Appoint a City-Wide Project Manager in Charge of the construction of protected bicycle lanes throughout Cambridge with the authority to reach out to the needed city departments to address concerns. The City-Wide Project Manager should work along with a group of Stakeholders that is specifically charged with oversight of how all these segments of protected bike lanes affect the city as a whole.

*Require an Evaluation process with goals and target points set, to be used on new and existing protected bike lanes constructed as Cambridge as a whole. A structured evaluation process is needed to determine if the design is working to achieve its stated goals and if it needs to be adjusted. Results should be made public and available no later than 3 months after the protected lane construction or March 1, 2022 for sections already completed. Comparisons of before and after construction should include:

• The number of Accidents and severity of accidents involving bicycles

• Is it increasing Bicycle ridership

• Business effect revenue and closure rate

• Resident’s ability to park, and traffic concerns

• Effect on Commuters of all major modes of Transportation- Car, Bike, MBTA

*Adoption of Shared Parking programs that would allow temporary on-street parking on residential streets during daytime hours is needed to compensate for the removal of Parking spaces on Mass Ave.

WHEREAS: The Cambridge Police Department and the Cambridge Department of Public Works collect hundreds of lost and stolen bicycles each year which they sell annually at auction after a set waiting period; and
WHEREAS: Those departments have been unable to donate bicycles collected because there is currently no language on file in Cambridge that would permit such donations; and
WHEREAS: There are local charitable organizations that exist whose missions contain a commitment to connecting donated bicycles to resident who need them, such as Cambridge Bike Give Back Program, Bikes not Bombs, and others; and
WHEREAS: Many other municipalities including Arlington, Belmont, Waltham, and Watertown allow their Police and Public Works departments to donate bicycles to charitable organizations; and
WHEREAS: Massachusetts General Law 30B Section 15(g) states:
“Notwithstanding any other requirement of this section, a governmental body may by majority vote, unless otherwise prohibited by law, dispose of a tangible supply no longer useful to the governmental body but having resale or salvage value, at less than the fair market value to a charitable organization which has received a tax exemption from the United States by reason of its charitable nature;” now therefore be it
ORDERED: That the City Manager be and hereby is requested to direct the City Solicitor to draft language to enable the Cambridge Police Department and Department of Public Works to donate abandoned bicycles to charitable organizations as outlined under MGL 30B Section 15(g); and be it further
ORDERED: That the City Manager be and hereby is requested to report back on this matter in a timely manner.

WHEREAS: Graduate student workers at the Massachusetts Institute of Technology formally announced a campaign to establish the MIT Graduate Student Union (MIT GSU) affiliated with the United Electrical, Radio and Machine Workers of America (UE); and
WHEREAS: MIT is able to function on a day-to-day basis largely because of MIT graduate students who provide essential services such as teaching classes, conducting research, writing papers, filing patents, running programming, staffing conferences, and applying for grants; and
WHEREAS: MIT GSU is advocating for:
  • Fair expectations and access to materials and resources necessary for their work
  • Safe, equitable, and dignified workplace free of systemic barriers and harassment
  • Affordable housing, dental insurance and comprehensive benefits
  • Equal academic and professional opportunities for international students; and
WHEREAS: Over the last 6 months, the majority of MIT graduate students have signed union authorization cards; and
WHEREAS: MIT graduate students have requested voluntary recognition of their union and a commitment to establish and protect fair working conditions for student workers who are holding a unionization vote on April 4-5, 2022; and
WHEREAS: MIT has actively campaigned against these efforts and should remain neutral by allowing graduate students to form a union and advocate on their own behalf; now therefore be it
RESOLVED: That the City Council go on record in support of the MIT GSU and their right to collectively bargain for their rights; and be it further
RESOLVED: That the City Council urges the MIT administration to remain neutral on the upcoming MIT GSU formation vote; and be it further
RESOLVED: That the City Clerk be and hereby is requested to forward suitably engrossed copies of this resolution to the MIT GSU, and members of the MIT administration, including President Reif.

WHEREAS: The Commonwealth of Massachusetts enjoys a long and distinguished history in the fight for workers’ rights and protections from exploitation from capitalists and corporate interests for more than 150 years; and
WHEREAS: Today, Massachusetts is now the most labor friendly state in the Union, with workplace protections that include protections from racial and gender discrimination, sexual harassment, and family leave protections that states such as California, Pennsylvania, New York, and others have emulated; and
WHEREAS: For society to work fairly for everyone, large tech companies, like Uber and Lyft, must follow the same rules as every business in the Commonwealth; and
WHEREAS: Uber and giant tech companies fail to pay into Social Security, do not pay important business taxes, and do not pay their workers fairly or consistently by the same rules that apply to all businesses in Massachusetts; and
WHEREAS: Attorney General Healey is currently suing Uber and Lyft for failing to follow Massachusetts law; and
WHEREAS: In an attempt to escape these violations, these companies have filed House Bill 1234 in the Massachusetts legislature and a 2022 state ballot question, asking Massachusetts legislators and voters, respectively, to grant them special exemptions from our labor, civil rights, and consumer protection laws; and
WHEREAS: The Big Tech sponsored bill exempts these "gig economy" companies from paying into Social Security and unemployment compensation, which would, if passed, cost Massachusetts taxpayers hundreds of millions of dollars, and weaken these programs for everyone; while shielding these companies from liability and financial responsibility if customers or members of the public are injured; and
WHEREAS: The bill or ballot question, if passed and signed into law, would create a permanent underclass of low-wage, mostly Black, Brown, and immigrant workers by allowing these companies to pay their workers less than the federal and state minimum wage and provide few, if any, benefits; and
WHEREAS: At a moment of racial reckoning in our country, the bill would exclude app-based workers from the robust protections against racial discrimination and sexual harassment under the Massachusetts Civil Rights Act, MGL c. 151B; and
WHEREAS: According to many civil rights, sociologists, and experts in employment law, passing this bill would be among the biggest steps backwards in the fight for equity and opportunity at work since the passage of the 1964 Civil Right Act; and
WHEREAS: Last year, in California, the same companies pushing House Bill 1234 spent more than $200 million in advertisements and commercials to win a ballot initiative campaign in the height of the pandemic; and
WHEREAS: These companies now believe they can buy a law to avoid paying state business taxes, and Social Security, further harming workers and consumers; and
WHEREAS: Big Tech executives seek to present a false choice, suggesting that if low-wage workers are given any control over their schedules, they must sacrifice the rights and benefits our laws provide; yet there is nothing that prevents these companies from offering flexible scheduling while also following our civil rights and labor laws today; and
WHEREAS: The Cambridge City Council is being called upon to lend its voice with the many who believe in workplace justice, fairness, and the core principles of workplace protections; now therefore be it
ORDERED: That the Cambridge City Council go on record standing with the working people of our city and the Commonwealth of Massachusetts ensuring that protections workers have enjoyed for generations, not be tampered with, or removed by any interests, particularly out of state corporate interests; and be it further
ORDERED: That the Cambridge City Council go on record standing with members of the Massachusetts General Court, our congressional delegation, the Massachusetts AFL-CIO, the Coalition Massachusetts is Not for Sale, and citizens of good will from this city and across the Commonwealth in urging the Massachusetts Legislature and the residents of Cambridge to oppose House Bill 1234 and the proposed 2022 state ballot initiative and ensuring that the rights of workers remain solid and strong for generations to come; and be it further

WHEREAS: In March 2021, the Autism Society announced it was formally shifting references of “Autism Awareness Month” to “Autism Acceptance Month,” to foster acceptance and ignite change through improved support and opportunities in education, employment, accessible housing, affordable health care, and comprehensive long-term services; and
WHEREAS: The City of Cambridge has proudly observed Autism Awareness Month in years past and recognizes and accepts Cambridge’s autistic students and residents; now therefore be it

WHEREAS: The City Auditor James Monagle will be retiring on May 31, 2022; and
WHEREAS: The City Council is the appointing authority for the hiring of the City Clerk, and in light of Auditor Monagle’s impending retirement, the City Council needs to hire a new auditor; and
WHEREAS: After conferring with the Chair of Government Operations, Vice Mayor Mallon, as well as Councillor Nolan, they have agreed to lead the ad-hoc committee for the City Auditor position; and
WHEREAS: In order to begin the application and interviewing process for the new City auditor, and to assure a level of confidentiality for applicants, the City Council may appoint a preliminary screening committee that is entitled to meet and enter executive session pursuant to the Massachusetts Open Meeting Law before reporting back to the full City Council for the public interviewing of recommended finalists; now therefore be it
ORDERED: That Vice Mayor Mallon and Councillor Nolan shall work with the City Manager to request that the City Manager appoint three senior City staff as members of the preliminary screening committee, along with two additional Councillors.

Report on working with the American Red Cross to establish a workforce development program for life guarding that includes free certification and recertification courses throughout the year for anyone who can pass the swim test and include incentives that may entice qualified applicants including (but not limited to) higher wages, retention and signing bonuses, and the option to work more than 19.5 hours per week if desired.

Report on working with staff of the BB&N school to provide a solution to cars idling beyond the five-minute legal limit, stalled traffic, blocked driveways, and a forced one-way path up Buckingham Street toward Concord where drivers face the risk of coming head-to-head with a vehicle trying to bypass the pickup line; and, such as a tiered drop-off system, a parking area for parents, or more drop-off and pick-up locations.
