8. Transmitting communication from Robert W. Healy, City Manager, relative to an appropriation of $730.00 to the Grant Fund Human Services Other Ordinary Maintenance account in donations from the Frisoli Youth Holiday Wreath Sale Fundraiser to be used to purchase equipment and supplies to enhance the activities offered at the Frisoli Youth Center.

9. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of the Harvard Pilgrim Health Care Foundation mini-grant in the amount of $500.00 to the Grant Fund Human Service Programs Other Ordinary Maintenance account and will be used at the Frisoli Youth Center to support their Snowflake Serenade event, a semiformal dance for Cambridge preteens that was held in mid-February 2007.

10. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of user fees received from Cambridge Homeless Service Provider Agencies and surrounding communities to support the new Cambridge Homeless Management Information System (a citywide tracking system for homeless persons receiving services through the participating programs) in the amount of $3,600.00 to the Grant Fund Human Service Programs Department Other Ordinary Maintenance account and will be used to pay the HMIS subcontractor for its technical and hosting services.

Sullivan, Co-Chairs of the Ordinance Committee, for a meeting held on Dec 13, 2006 for the purpose of considering the recommendations for changes to the Neighborhood Conservation District Ordinance and the Avon Hill Neighborhood Conservation District Order, submitted by the Avon Hill Neighborhood Conservation District Boundary Study Committee and endorsed by the Historical Commission. UNFINISHED BUSINESS
5. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor Timothy J. Toomey, Jr., Co-Chair of the Ordinance Committee, for a meeting held on Nov 18, 2004 for the purpose of considering proposed amendments to Chapter 2.74 of the Cambridge Municipal Code, the Police Review and Advisory Board Ordinance. The question comes on passing to be ordained on or after Feb 14, 2005. [Four sections of the proposed amendment were passed to be ordained as amended. Ordinance #1284. The remaining proposed amendments to chapter 2.74 remain on unfinished business.]

6. A communication was received from D. Margaret Drury, City Clerk transmitting a report from Councillor Brian Murphy and Councillor Michael A. Sullivan, Co-Chairs of the Ordinance Committee, for a meeting held on Dec 13, 2006 for the purpose of considering a proposed amendment to the zoning ordinance filed by the City Council to require public review for smaller scaled residential and commercial developments in Business A, Business A-1, and Business A-2 Districts, and to limit the height in Business A-2 districts to 35 feet within 50 feet of residential district with a 35 foot height limit and to require 20 foot side yard setbacks in BA-2 districts for side yards that abut residential lots. The question comes on passing to be ordained on or after Jan 22, 2007. Petition expires Mar 13, 2007.

7. Transmitting communication from Robert W. Healy, City Manager, relative to an order requesting the authorization to borrow an amount not to exceed $42,000,000. The purpose is to refinance existing General Obligation Bonds to acquire lower interest rates than those currently being paid. Specifically, this will refinance those portions of the February 1998 (Hospital), August 1998 (Water), and November 1999 (Water) General Obligation bond issues that are eligible to be refinanced. The question comes on adoption on or after Feb 26, 2007.  Loan Order adopted 9-0-0

ORDERS
1. That the City Manager is requested to draft language to amend the zoning ordinance to permit covered bicycle parking as of right and without adding to gross floor area (GFA) as is possible when automobile parking is sited in a garage.   Councillor Davis, Councillor Murphy, Vice Mayor Toomey and Councillor Simmons

9. That the City Manager is requested to direct the appropriate City staff to develop a City Ordinance for the City Council to review that would prohibit the discharge of air pollutants from building and water heating systems at a level that is noticeable to the human nose at the property line.   Councillor Kelley  amended

10. That the City Manager is requested to have City staff work with the Cambridge Public School Department staff and the Transportation, Traffic and Parking Committee of the City Council to review Safe Routes to School opportunities in Cambridge and to develop a comprehensive Safe Routes to School program for the City and the Cambridge Public School Department.   Councillor Kelley

11. That the City Manager is requested to confer with the appropriate Department heads to ensure that the appropriate resources are provided by the City to support the Area Four Clean-Up Day.   Councillor Simmons

12. That the City Manager is requested to provide additional funding for the Cambridge Pop Warner Program.   Councillor Sullivan

13. That the Cambridge City Council go on record expressing its enthusiastic support for Lesley University’s application for a grant from the Massachusetts Cultural Council for funding towards an inclusive and culturally oriented community process for the integration of the Art Institute into the Porter Square community.   Councillor Sullivan and Councillor Murphy

14. That the Cambridge City Council as a Mayors for Peace city welcomes members of the Massachusetts Mayor’s Association to Cambridge and encourages their support and those of all Massachusetts mayors and city councils for the Mayors for Peace initiative and go on record in opposition to the expansion of nuclear capabilities.   Mayor Reeves

15. That the City Manager is requested to report back to the City Council on whether there is a quota or requirement or other similar system for the issuance of parking and/or moving violation tickets and if there is any such system, how it interacts with the City’s community policing goals.   Councillor Galluccio

16. That the City Manager be and hereby is requested to consider broadening the enforcement authority as it relates to rodent control and trash disposal violations to include the Inspectional Services Department as an enforcing authority.   Councillor Galluccio

17. That the City Manager is requested to report back to the City Council as to whether sand is used on city streets and sidewalks during ice storms, and if not, why not.   Councillor Galluccio and Councillor Kelley

18. That the City Manager is requested to confer with the Assistant City Manager for Human Services and the Superintendent of Schools with the view of Workforce Development and Rindge School of Technical Arts conducting a building trades apprenticeship awareness program.   Councillor Galluccio

19. That the City Manager is requested to confer with the Commissioner of Public Works about the feasibility of indicating the location of storm drains through snow cover and posting a map of these locations on the Department’s website.   Councillor Murphy and Councillor Kelley

20. That the City Manager is requested to instruct all City departments to replace all incandescent light-bulbs with energy efficient fluorescent bulbs upon their next-needed replacement.   Councillor Murphy

21. Support of the Human Rights Commission in their efforts to finding ways to eliminate or at least diminish discrimination experienced by CRLS students as described in a recent report by the Commission.   Mayor Reeves


22. That the City Manager is requested to instruct relevant City officials to immediately investigate the ongoing rehab project at 57 Otis Street.   Councillor Kelley, Vice Mayor Toomey and Councillor Sullivan

WHEREAS: The City of Cambridge hereby condemns the assassination of Turkish-Armenian journalist Hrant Dink on Jan 19, 2007; and
WHEREAS: On Jan 19, 2007, Turkish-Armenian journalist Hrant Dink was murdered as he exited the Istanbul, Turkey, office of Agos Newspaper; and
WHEREAS: Hrant Dink was a staunch defender of the freedom of the press and speech and a champion of human rights and tolerance; and
WHEREAS: Hrant Dink was a man of conviction and principle who believed in democratic ideals and peace; and
WHEREAS: In 1996 in Istanbul, Turkey, Hrant Dink founded a bilingual newspaper called Agos; and
WHEREAS: Hrant Dink has been honored for his courage and principles and was awarded the prestigious Bjornson Prize for Literature for his publications on the Armenian Genocide;
WHEREAS: Hrant Dink was prosecuted and convicted under Article 301 of the Turkish Penal Code for speaking about the Armenian Genocide; and
WHEREAS: The city of Cambridge is the sister city of Yerevan, Armenia; now therefore be it
RESOLVED: That the City Council go on record honoring the memory and legacy of Hrant Dink and calling on all government entities to recognize the Armenian Genocide.

WHEREAS: Air pollution is both unhealthy and unpleasant for people to experience; and
WHEREAS: Monitoring and quantifying local air pollution sources would be a difficult task for the City; and
WHEREAS: Vented heating systems may discharge pollution at the site of the vents; and
WHEREAS: Vented heating systems, especially for house and small apartment buildings, may be located at ground level in an area where air pollutants will have the most detrimental impact on neighbors and passersby; now therefore be it
ORDERED: That the City Manager be and hereby is requested to direct the appropriate City staff to develop a City Ordinance for the City Council to review that would prohibit the discharge of air pollutants from building and water heating systems at a level that is noticeable to the human nose at the property line; and be it further
ORDERED: That the City Manager be and hereby is requested to confer with the appropriate City staff to investigate and report back to the City Council on the problem of the discharge of air pollutants from building and water heating systems at a level that is noticeable to the human nose at the property line; and be it further
ORDERED: That said report include information about the nature and scope of the problem in Cambridge, whether there are other legal/regulatory remedies already in existence, whether other localities have adopted ordinances to prohibit activities that result in the discharge so described, and what their experience with said regulation has been; and be it further

WHEREAS: Lesley University is beginning to plan for a process that will eventually lead to relocation of the Art Institute of Boston to Porter Square on the site of the North Prospect Church; and
WHEREAS: Lesley University has expressed its desire to include as part of this process input from as many as possible of the groups and individuals interested in the vitality and future of Porter Square; and
WHEREAS: Lesley University intends to submit a grant application to the Massachusetts Cultural Council for funding towards that process; and
WHEREAS: The additional resources and the art and cultural focus that such a grant would bring to the process would be very beneficial to build a process that celebrates and strengthens the artistic and cultural vitality of Porter Square, the varied and vibrant fabric of the entire Porter Square community and the potential for an expansion of its arts economy; now therefore be it
RESOLVED: That the Cambridge City Council hereby goes on record expressing its enthusiastic support for Lesley University’s application for a grant from the Massachusetts Cultural Council for funding towards an inclusive and culturally oriented community process for the integration of the Art Institute into the Porter Square community; and be it further
RESOLVED: That the City Clerk be and hereby is requested to forward a suitably engrossed copy of this resolution to Jay Paget, Cultural Facilities Fund Program Director, Massachusetts Cultural Council and President Margaret McKenna, Lesley University on behalf of the entire City Council.

WHEREAS: In August 1945, atomic bombs instantaneously reduced the cities of Hiroshima and Nagasaki to rubble, taking hundreds of thousands of precious lives and today, more than fifty years after the war, thousands of citizens still suffer the devastating aftereffects; and
WHEREAS: In 1982, Mayors for Peace was launched at the United Nations by then Mayor Takeshi Araki of Hiroshima to offer cities a way to transcend national borders and work internationally to raise consciousness about nuclear weapons abolition as well as pursuing world peace by working to address starvation, poverty, refugee welfare, human rights abuses, environmental destruction, and other problems that threaten peaceful coexistence; and
WHEREAS: The membership of Mayors for Peace (which officially became a UN NGO with "Special Consultative Status" in 1990) is currently 1,577 cities in 120 countries and regions who have endorsed the call for a nuclear weapons free world; and
WHEREAS: The Massachusetts State House of Representatives and State Senate have passed the first ever resolutions in support of Mayors for Peace and calling for the abolition of nuclear weapons by 2020; and
WHEREAS: Cambridge has signed on as an active member of Mayors for Peace since 2002 and designated Cambridge as a "City of Peace" in 2007 in honor of 25 years of the Cambridge Peace Commission; and
WHEREAS: There are currently twenty-five Mayors for Peace cities or municipalities in Massachusetts (Agawam, Amesbury, Amherst, Boston, Chicopee, Easthampton, Framingham, Gloucester, Greenfield, Holyoke, Leverett, Lincoln, Medford, Newburyport, Newton, North Adams, Northfield, Northampton, Pittsfield, Salem, Springfield, Sunderland, Westfield, West Springfield, Worcester) who have endorsed its Emergency Campaign for the negotiation of the elimination of all nuclear weapons by 2020; and
WHEREAS: The assembled Mayors of Massachusetts will be meeting in Cambridge on Feb 28, 2007; and
WHEREAS: Mayor Clair Higgins of Northampton, the former president of the Massachusetts Municipal Association has played a leading role in Mayors for Peace; and
WHEREAS: The Bush Administration is pressing Congress to fund "Complex 2030" the vast expansion of the U.S. nuclear weapons production infrastructure with an ultimate price tag of $150 billion at the expense of essential human and community needs and support the development of the misnamed "Reliable Replacement Warhead", a new generation of nuclear weapons; now therefore be it
RESOLVED: That the Cambridge City Council as a Mayors for Peace city welcomes members of the Massachusetts Mayor’s Association to Cambridge and encourages their support and those of all Massachusetts mayors and city councils for the Mayors for Peace initiative; and be it further
RESOLVED: That The Cambridge City Council as a "Mayors for Peace" City does go on record in opposition to this expansion of nuclear capabilities; and be it further
RESOLVED: That The Cambridge City Council invites the mayors and city councils of Massachusetts to join in this effort; and be it further
RESOLVED: That the Cambridge City Council urges U.S. Representative Michael Capuano and Senators Edward Kennedy and John Kerry to actively oppose funding for "Complex 2030" and for the development and production of all new nuclear weapons.

ORDERED: That the City Manager be and hereby is requested to report back to the City Council on whether there is a quota or requirement or other similar system for the issuance of parking and/or moving violation tickets and if there is any such system, how it interacts with the City’s community policing goals.

WHEREAS: The City of Cambridge has committed itself toward energy conservation in order to promote environmental sustainability; and
WHEREAS: Many governments have come to the conclusion that continued use of outdated technologies no longer remains an option for achieving this goal; most notably Australia, who plans to outlaw the use of incandescent light bubs which convert most of the energy they use to heat in favor of energy-saving fluorescent light bulbs; and
WHEREAS: Actions have been taken by the City government to promote energy-efficient light bulbs among its residents; now therefore be it
ORDERED: That the City Manager be and hereby is requested to instruct all City departments to replace all incandescent light-bulbs with energy efficient fluorescent bulbs upon their next-needed replacement; and be it further
ORDERED: That this phase-out process be completed within three years.

WHEREAS: The function of the Cambridge Human Rights Commission is to act on complaints of discrimination within the City; and
WHEREAS: A written survey conducted by the Commission among students at Cambridge Rindge and Latin High School revealed that a surprising and dismaying number of these students assert that they are discriminated against in a variety of ways --- by the police, by merchants, by the high school itself; now therefore be it
ORDERED: That the City Council go on record in support of the Human Rights Commission in their efforts to finding ways to eliminate or at least diminish this discrimination.
