9. Petition from Harvard University requesting a sub-surface easement located between 1720 and 1737 Cambridge Street for the purpose of constructing an underground pedestrian and service tunnel beneath Cambridge Street.

10. The proposed amendment to Chapter 8.28 of the Municipal Code, which restricts youth access to tobacco and prohibits smoking in workplaces and public places, would prohibit smoking in all restaurants and bars. The amendment also modifies the exception for private clubs. The question comes on passing to be ordained on or after February 24, 2003.

1. A communication was received from Donna P. Lopez, Deputy City Clerk, transmitting a report from Councillor Marjorie C. Decker, Chair of the Cable TV, Telecommunications and Public Utilities Committee, for a meeting held on February 4, 2003 to discuss the possibility of Cambridge charging a fee for using the city’s right-of ways for running fiber optic cables, a plan to develop public information cable television spots and coordination of resources between the municipal cable, CCTV and the school department cable.

2. A communication was received from Donna P. Lopez, Deputy City Clerk, transmitting a report from Councillor Brian Murphy, Chair of the Finance Committee, for a meeting held on February 12, 2003 to receive a briefing on the state budget and local option legislative package and to discuss the city’s credit rating, General Obligation Bond Sale and the FY 02 Comprehensive Annual Financial Report.

WHEREAS: The City of Cambridge website contains a link to a FEMA site with directions on how to prepare for a chemical or biological attack; and
WHEREAS: These directions include assembling rolls of duct tape, scissors and plastic sheeting that you should pre-measure and cut for the openings of the internal room in which you will shelter; and
WHEREAS: It has been suggested that the duck tape and plastic may provide very little physical protection and may provide a counter productive false sense of security to our citizens; now therefore be it
ORDERED: That the City Manager be and hereby is requested to confer with Chief Public Health Officer Harold Cox and Director of Environmental Health Sam Lipson to report back to the City Council as to the scientific data supporting duct tape and plastic as an effective protection against chemical or biological attacks; and be it further
ORDERED: That the link to these directions be disconnected until the scientific basis for these preparations has been researched and reported back to the City Council.

COUNCILLOR DECKER
WHEREAS: It has come to the attention of the Cambridge City Council that the Gaiety Theater in Boston is in grave danger of demolition; and
WHEREAS: The Gaiety Theater is a century-old, 1,700 seat theater at 659 Washington Street in Chinatown; and
WHEREAS: At the height of the Jazz Age in the 1920’s, the Gaiety Theater was one of only two theaters in Boston that regularly booked African American or integrated acts (the other theater, the Casino on Hancock Street, was razed forty years ago); and
WHEREAS: The Gaiety Theater is a monument to the important contribution of African American artists to the Jazz Age and to vaudeville; and
WHEREAS: The Boston Landmarks Commission is currently studying whether the theatre, which Kensington Investment Company is proposing to tear down, should be designated a landmark; now therefore be it
RESOLVED: That the City Council go on record expressing its opinion that the Gaiety Theater is an historic al and cultural landmark worthy of preservation and celebration and urging the Boston Landmarks Commission to designate the building a local landmark; and be it further
RESOLVED: That the City Clerk be and hereby is requested to forward a suitably engrossed copy of this resolution to Ellen Lipsey, Executive Director of the Boston Landmarks Commission on behalf of the entire City Council.

WHEREAS: Several of these locations jeopardize particularly the safety of young children and Senior Citizens; and
WHEREAS: One such location is at 85 Bishop Richard Allen Drive where children from the Henry Buckner school cross the street into traffic as well as a loading zone and the entrance/exit of a municipal parking lot; and
WHEREAS: Another such area is the natural crossing pattern from the Cambridge Senior Center to Cambridge City Hall; now therefore be it
ORDERED: That the City Manager be and hereby is requested to instruct the Director of Traffic, Parking and Transportation to review these locations and determine if crosswalks like the one from Harvard Yard to Harvard Bookstore can be placed there.

WHEREAS: While the former Louis Agassiz School has been renamed the Maria Baldwin School, the Agassiz School label continues as the prominent and apparent name of the school; now therefore be it
ORDERED: That the City Manager be and hereby is requested to instruct with the Acting Superintendent of Schools and the School Committee as to future intentions regarding signage and whether or not there are perceived budgetary constraints regarding signage changes.

WHEREAS: Tech Square is emerging as a true center of Science, Industry and Technology. This emergence seems to be very rapid and very concentrated but does not appear to have the effective involvement of the Community Development in planning a lively streetscape with first floor retail and a mix of services, restaurants and shops; now therefore be it
ORDERED: That the City Manager be and hereby is requested to provide the City Council with a report on the Community Development Department’s efforts to create a Tech Square, which is more integral to the Cambridge citizens who are in technologies and those who are not.

ORDERED: That the City Manager be and hereby is requested to report to the City Council on the expected impact of state funding cuts on city services, said report to include an analysis of which cuts we know Cambridge will experience, any anticipated further cuts, and how the city plans to respond to various cuts-which cuts are essential to the function of the city and the delivery of services and how much of the City’s reserves will have to be tapped to subsidize the state cuts.
