Maher and Councillor Brian Murphy, Co-Chairs of the Ordinance Committee, for a meeting held on January 15, 2003 for the purpose of further consideration of a proposed amendment to the Smoking Ordinance to ban smoking in bars and restaurants.

RESOLVED: That the City Council go on record requesting that the Massachusetts federal delegation file federal legislation that would allow OSHA regulations to be enacted which would regulate second hand smoke and tobacco in work place safety regulations; now therefore be it

WHEREAS: Cities and Towns across Massachusetts unilaterally have been and are considering enacting public health regulations or ordinances regulating second hand smoke in the work place and places of public accommodations in their respective cities and towns; and
WHEREAS: Millions of dollars in lobbying and organizing efforts are being spent to regulate second hand smoke on municipality by municipality bases; and
WHEREAS: Many municipal officers have expressed concerns with respect to the economic impact on local businesses because of the lack of consistency with the regulations from city to city; and
WHEREAS: Enacting state-wide legislation would establish a consistent plan for all communities and save millions of dollars which ultimately could be spent on what should be the overriding goal of reducing smoking in general; now therefore be it
RESOLVED: That the City Council go on record supporting a state-wide ban on smoking in the work place and places of public accommodations and convey the support of the Cambridge City Council to the Massachusetts State delegation in this regard.

VICE MAYOR DAVIS
WHEREAS: The City of Cambridge has been in the forefront of upholding principles
of democracy and respect for all and is a diverse city which includes
immigrants, veterans and neighborhood residents many of whom know all too well
the terrible cost of war; and
WHEREAS: The Cambridge City Council supports the role of the United States as a
leader in the international community for building consensus and pursuing a
diplomatic resolution with Iraq which allows the on-going inspections process to
continue; and
WHEREAS: Any preemptive strike by the U.S. violates our commitments under the
U.N. Charter, goes against established international law, sets a dangerous
precedent for the world community, and further isolates the U.S. from the rest
of the world; and
WHEREAS: A war with Iraq has been declared by nearly all U.S. religious leaders
as unjust; and
WHEREAS: A war with Iraq would put at risk the lives and future aspirations of
Cambridge residents who serve or have family members and friends who serve in
the United States Armed Forces at a time when veterans of previous wars are
facing cuts in services and health and housing problems; and
WHEREAS: The current projected cost to the nation is estimated to be more than
200 billion dollars, thus depleting the reserves, harming the economy, and
resulting in further neglect of education, health care, housing, veteran's
services and the infrastructure on a national level as well as economic hardship
for Cambridge's citizens, institutions and businesses; now therefore be it
RESOLVED: That the Cambridge City Council joins with cities and towns across the
United States including Brookline and Somerville, Massachusetts, Washington,
D.C.; Chicago, Illinois, Seattle, Washington; Albuquerque and Santa Fe, New
Mexico; Baltimore and Tacoma Park, Maryland; Oakland, Santa Barbara, Santa Cruz,
and San Francisco, California; Ithaca and Syracuse, New York; New Haven,
Connecticut; Madison, Wisconsin; Burlington, Vermont; and Ann Arbor, Kalamazoo,
Traverse City and Detroit, Michigan; and The National Council of Churches, the
Teamsters Union, our Congressman Michael Capuano and Senator Edward Kennedy in
opposing war with Iraq; and be it further
RESOLVED: That the governing body reaffirms The Universal Declaration of Human
Rights and the principles of international law, and calls on the Bush
administration and our representatives in Congress to provide leadership in
encouraging the alternatives to war of fostering peace, democracy, and respect
for human rights in Iraq and throughout the Middle East through diplomacy and
international cooperation; and be it further
RESOLVED: That the City Council directs the Clerk/Treasurer to provide copies of
this resolution to President Bush, Secretary of State Colin Powell, Secretary of
Defense Donald Rumsfeld and our congressional delegation.
